HomeMy WebLinkAbout3594t i ?r0/ co S-V 3 dod t/ Z 3 - / 5 ? is f EL LASHSI. < .... lORDINANCE NO. 3 5 9 4 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF STREET RIGHT-OF-WAY, SITUATED ON A PORTION OF 49TH NORTHEAST BETWEEN "D" AND "G" STREETS N.E., WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN. WHEREAS, the City Council of the City of Auburn, Washington, have passed and adopted Resolution No. 1092, resolving that a public hearing shall be had for the purpose of determining whether or not the hereinafter described street right- of-way located on a portion of 49th Northeast between "D" and "G" Streets N.E., within the corporate limits of the City of Auburn, shall be vacated, said portion 4X7 to be vacated being hereinafter legally described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate the portion of a certain street right-of-way located on a portion of 49th Northeast between "D" and "G" Streets Northeast lying within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 1092 was held on the 16th day of June, 1980, at which time the public hearing was continued until August 4, 1980; and WHEREAS, at the August 4, 1980 public hearing the matter was continued until September 2, 1980; and WHEREAS, at the September 2, 1980 public hearing the matter was continued until October 6, 1980; and WHEREAS, at the October 6, 1980 public hearing the matter was continued until November 17, 1980; and WHEREAS, at the November 17, 1980 public hearing the matter was once again continued until December 15, 1980, at 8:00 P.M., in the Auburn City Hall Council Chambers, 25 West Main, Auburn, Washington, no objections thereto were filed with the City Clerk or presented to the City Council at said hearings; and WHEREAS, the City Council, having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; NOW THEREFORE, THE CITY COUNCIL OF THE-CITY OF-AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: I * , % . . : P 1. ------------------- Ordinance No 3594 " Page One 1-9-81 RECORPi ?1 THJ(' FEB 9 2 35 P1,11 Lo, Section 1. That the following described portion of a certain street right-of-way situated on a portion of 49th Northeast between "D" and "G" Streets Northeast, within the corporate limits of the City of Auburn, Washington, and more particularly described as follows: That portion of 49th St. N.E. (S. 280th St.) lying in that portion of the White River Valley Home Tracts un- recorded in Section 31, Township 22 North, R 5 EW1, desc as follows: Beginning at a point on the east line of "D" St. N.E. (86th Ave. S.) said point being 10 feet north of the NW corner of Tract 37 of said White River Valley Home Tracts; thence North along the extended east line of "D" St. N.E. 65 feet to a point on the west line of Tract 45 of said White River Valley Home Tracts; thence along a curve to the left having a radius of 15.00 feet through a center angle of 91°01'23" an arc distance of 23.83 feet to the north right of way line of 49th St. N.E. (S 280th St.); thence east along the north right of way line of 49th St. N.E. 945.22 ft. to the beginning of a curve to the left having a radius of 15 feet through a central angle of 88°58'37" an arc distance of 23.29 feet to a point on the west right of way line of "G" St. N.E. (90th Ave. S.) thence S. 00°07'07" W along the extended west line of "G" St. N.E. to the south line of 49th St. N.E. as established by City of Auburn Vacation Ordinance No. 2627 and re- corded under A.F. No. 7301120384; thence west along the south line of 49th St. N.E. to the point of begin- ning, situate in the City of Auburn, King County, WA. be and the same is hereby vacated, and the property lying in said portion of a certain street right-of-way described hereinabove, shall be returned and belong to the abutting property owners, of said portion of a certain street right-of-way situated on a portion of 49th Northeast between "D" and "G" Streets Northeast, lying within the corporate limits of the City of Auburn, Washington. Section 2. That an easement be retained for public utility purposes over the north 20 feet of that portion of 49th Street N.E. to be vacated as legally described in Section 1. Said easement shall be over and across, upon and underneath the aforesaid north.20 feet for ingress and egress and for the purpose of laying, maintaining and installing public utilities. ------------------ Ordinance No. 3594 Page Two 1-9-81 Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in m the office of the King County Auditor. Section 4. That this Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN."
