HomeMy WebLinkAbout3595 ORDINANCE NO. 3 5 9 5 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 311, WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING FOR THE CON- STRUCTION AND INSTALLATION OF WATERMAIN ON 37TH S.E. 600 FEET WEST OF "D" TO "M" STREET, ON "M" STREET TO 800 FEET NORTH, INSIDE THE CORPORATE LIMITS OF THE CITY OF AUBURN; AS PROVIDED BY ORDINANCE NO. 3505, OF THE CITY OF AUBURN, AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY UPON SAID ROLL. WHEREAS, the assessment roll levying the special assessments against the properties located in the Local Improvement District No. 311 of the City of Auburn, Washington, created under Ordinance No. 3505, has been filed with the City Clerk of the City of Auburn, as provided by law; and WHEREAS, notice of the time and place of hearing thereof and making objections and protests to said roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 5th day of January, 1981, at the hour of 8:00 P.M. in the Council Chambers of the Auburn City Hall, Auburn, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner shown on said roll; and . WHEREAS, at the time and place fixed and designated in said notice of hearing was duly held, one protest was duly filed at said hearing; and WHEREAS, after the hearing was held the assessment roll was accepted as 1 presented and ordered confirmed. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That there is hereby in all respects approved and confirmed the assessments and assessment roll in Local Improvement District No. 311, pro- viding for the construction and installation of watermain on 37th S.E. 600 feet west of "D" to "M" Street, on "M" Street to 800 feet north, inside the corporate limits of the City of Auburn, according to plans prepared and on file in the office of the City Engineer of the City of Auburn, for the benefit of the following described property: -------------------- Ordinance No. 3595 Page One 1-13-81 That por of Sec 30, Twp 21 N, R 5 EWM, more particularly desc as follows: The East 75 feet of the S 210 feet of the SW 1/4 of NE 1/4 of SE 1/4 said Sec 30 Less Street. The S 150 feet of the E 1/2 of the NE 1/4 of the SW 1/4 said Sec 30, Less Street. The E 75 feet of the N 150 feet of the NIJ 1/4 of SE 1/4 of SW 1/4 said Sec 30 Less Street. The N 150 ft of the E 1/2 of the SE 1/4 said Sec 30 Less Street. The S 150 feet of that por of the NW 1/4 of the SE 1/4 said Sec 30 lying N of 37th St. SE (Willis Road) Less the E 230.77 feet. The W 100 ft of S 100 ft of E 1/2 of E 1/2 of NW 1/4 of SE 1/4 lying N of 37th St. SE (Willis Road). Lots 1, 2 & 3, SP-36-79 as recorded under King Co. Auditor's File No. 8001150358. The E 120 ft Lot 4, SP-18-78 as recorded under King Co. Auditor's File No. 7809200302. The W 150 feet of N 212 feet of W 1/2 of W 1/2 of NE 1/4 of SE 1/4 of said Sec 30 Less Street. The W 150 ft of Por of W 1/2 of W 1/2 of NE 1/4 of SE 1/4 said Sec 30 lying N of 37th Street SE, Less N 432 feet Less S 180 feet Less Street. The S 180 feet of W 130 feet of Por of NE 1/4 of SE 1/4 lying N of 37th St. SE (Willis Road) said Sec 30 Less Street. The N 120 ft of the W 112 of SE 1/4 said Sec 30 lying S of 37th Street SE, (Willis Road), King County, State of Washington. Section 2. That each of the lots and other property upon said assessment roll is hereby declared to be especially benefited by said improvements in at least the amount charged against the same, and that the assessment appearing against each of the same is in proportion to the several assessments appearing on said roll. That all of the property shall be assessed according to the lineal frontage of the property abutting said property to be improved and shall be assessed according to their proportionate share of the several assessments appearing upon the said assessment roll'and there'is hereby levied and assessed against such lots and other property appearing upon said roll, the amount finally charged therein against the same; said amount, or any portion thereof, may be paid ------------------ Ordinance No. 3595 Page Two 1-13-81 at any time within thirty (30) days from the date of the first publication of the Notice of Collection of said assessments without penalty, interest or cost; there- after the sum remaining unpaid, if any, may be paid in ten (10). equal annual installments, with interest on the whole unpaid sum at the rate of nine and three- quarters percent (9.75%) per annum. Commencing with the first year after the last day, such assessments, or any portion thereof, may be paid without penalty, interest or cost (30 days from the date of the first publication of the Treasurer's Notice of Collection of Assessments) and each.year thereafter, one of said installments, together with the interest due, shall be collected as provided by law and the Ordinances of the City of Auburn, assessments or installments of assessments not paid when due shall be delinquent and there•shall be added to .the same a penalty of eight and one-half percent (8.5%) of the amount of the overdue installment and interest, and such penalty shall become'a'part of the lien upon the property assessed. Section 3. All monies collected by the City Treasurer upon any of the assessments levied, as authorized herein, shall be paid into "Local Improvement District No. 311 Fund" created by Ordinance No. 3505, and shall be used only for the purpose of redeeming warrants and/or bonds drawn upon or issued against said fund. Section 4. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
