HomeMy WebLinkAbout3609ORDINANCE NO. 3 6 0 9 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ADOPTING THE 1979 EDITIONS OF THE UNIFORM BUILDING CODE, UNIFORM BUILDING CODE STANDARDS, i UNIFORM ADMINISTRATIVE CODE, UNIFORM MECHANICAL CODE, UNIFORM HOUSING CODE, UNIFORM PLUMBING CODE, UNIFORM CODE FOR THE ABATE- MENT OF DANGEROUS BUILDINGS, THE UNIFORM FIRE CODE AND THE UNIFORM FIRE CODE STANDARDS, ALL NAMED CODES HAVING SPECIFIED APPENDIXES INCLUDED AND INCLUDING DELETIONS, AMENDMENTS AND ADDITIONS, IN- CLUDING THE UNIFORM BUILDING CODE ACCUMULATED SUPPLEMENT BEGINNING WITH THE 1980 EDITION AND ALL SUPPLEMENTS AS PUBLISHED EACH YEAR RELATING TO THE UNIFORM BUILDING CODE AS REFERRED TO IN THIS TITLE, AND REPEALING AND CREATING CERTAIN SECTIONS TO AUBURN CODIFIED CITY ORDINANCE CHAPTER 15. THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. There is hereby adopted by reference, upon the effective date of this Ordinance, and upon filing with the City Clerk, three (3) copies of the following described Codes, 1979 editions promulgated by the International Conference of Building Officials, together with appendixes, deletions, amend- ments and additions: A. The Uniform Building Code, 1979 Edition, with supplements as published; B. The Uniform Administrative Code 1979 Edition, as amended; C. The Uniform Building Code Standards, 1979 Edition; D. The Uniform Mechanical Code, 1979 Edition; E. The Uniform Housing Code, 1979 Edition; and F. The Uniform Code for the Abatement of Dangerous Buildings, 1979 Edition. Section 2. There is hereby adopted by reference, upon the effective date of this Ordinance, and upon filing with the City Clerk, three (3) copies thereof, the Uniform Fire Code 1979 Edition, and the Uniform Fire Code Standards 1979 Edition, promulgated by the International Conference of Building Officials and Western Fire Chiefs' Association, together with appendixes thereto, deletions, amendments and additions as set forth hereafter. ------------------- Ordinance No. 3609 Page One 2-23-81 Section 3. There is hereby adopted by reference, upon the effective date of this Ordinance, and upon filing with the City Clerk, three (3) copies thereof, the Uniform Plumbing Code 1979 Edition promulgated by the International Association of Plumbing and Mechanical Officials together with appendixes, deletions, amend- ments and additions as set forth hereafter. Section 4. Auburn Codified City Ordinance 15.04.080 is hereby repealed in its entirety and a new section 15.04.080 is hereby created to read as follows: "15.04.080 VIOLATION PENALTY. Unless another penalty is expressly provided by law, every person convicted of a violation of any provision of this title shall be punished by a fine of not more than Five Hundred Dollars ($500.00) or by imprisonment for not more than one hundred eighty (180) days, or by both such fine and imprisonment." Section 5. Auburn Codified City Ordinance Chapter 15.08.010 is hereby repealed in its entirety and anew Chapter,15.08.010 is hereby created and shall 14 read as follows: "15.08.010 GENERALLY. Certain codes; as hereinafter referred to and as promulgated by the International Conference of Building Officials, 5360 South Workman Mill Road, Whittier, California, together with amendments and/or additions thereto, are adopted subject to the additions, deletions and changes contained in this title. Said codes, by reference, are made a part of this title with the force and effect as though set out in this title in full. Three (3) copies of each are on file in the office of the City Clerk: A. Uniform Building Code, 1979 Edition, related standards and succeeding supplements, except Chapter 51, and including appendixes, Chapter Numbers 11, 12, 23, 32, 35, 38, 48, 49, 55, 57, and 70; Add new sub-paragraph to Section 307 of the .Uniform Building Code, to be known as sub-paragraph 'f': Any building occupied prior to issuance of a Certificate of Occupancy or final approval shall be required to pay a second permit charge. The building shall be vacated and a new permit charge equal to the original fee shall be paid prior to a final inspection for a Certificate of Occupancy being issued contingent upon the total compliance to all City building, fire and zoning code requirements. This section does not relieve the contractor from any penalties which the Uniform Building Code may also indicate in Chapter 2 or in the State Building Code Act of 1957; Amend Section 301 (b) (1) to read as follows: One-story detached accessory buildings used as tool and storage sheds, play houses and similar uses, provided the projected roof area does not exceed fifty (50) square feet; ------------------- Ordinance No. 3609 Page Two 2-23-81 B. Uniform Administrative Code, 1979 Edition,.as amended; C. Uniform Mechanical Code, 1979 Edition, including appendixes A, B, and C; D. Uniform Housing Code, 1979 Edition, as amended; E. Uniform Code for the Abatement of Dangerous Buildings, 1979 Edition, as amended; F.' Uniform Sign Code, 1979 Edition, as amended; G. State Standards for Access to Buildings and Facilities for the Physically Disabled Person as mandated per Chapter 110, Laws of 1975; H. The Uniform Plumbing Code, 1979 Edition, as promulgated by the International Association of Plumbing and Mechanical Officials, together with appendixes; A, B, C, D, E, G, H, amendments and/or additions thereto heretofore made including Chapter 11, is adopted by reference subject to the additions, deletions and changes con- tained in the title, and by reference is made a part of this title with the force and effect as though set out in this title in full; 1. The Uniform Fire Code, with appendixes thereto, 1979 Edition, published by the International Conference of Building Officials and the Western Fire Chiefs' Association; J.' The Uniform Fire Code'Standards; 1979 'Edition; K. The Standard Specifications for Municipal Public Works Construction, latest publication with amendments, as published by the American Public Works Association." Section 6. Auburn Codified City Ordinance 15.12.010 is herewith repealed in its entirety, and a new Chapter 15.12.010 is hereby created and shall read as follows: "15.12.010 ADDITION TO CHAPTER 4. There shall be added to the Uniform Housing Code, 1979 Edition, Chapter 4, "Definitions", the following: "Hereinafter, wherever the term 'Director of Public Works' appears, it shall mean the Director of Planning and Community Development, City of Auburn." Section 7. Auburn Codified City Ordinance 15.12.030 is herewith repealed in its entirety and a new Chapter 15.12.030 is hereby created and shall read as follows: - "15.12.030 SECTION H-1305(i) ADDED-INJUNCTIVE RELIEF. There shall be added to the Uniform Housing Code, 1979 Edition, Chapter 13, Section H-1305, a new subsection (8) to read as follows: ------------------ Ordinance No. 3609 Page Three 2-23-81 "(i) Order Issured by the Building Official. Any person affected by an Order issued by the Building Official or Board of Appeals pursuant to the provisions of this code may, within thirty (30) days after the posting and service of the Order, petition the Superior Court for an injunction restraining the Building Official from carrying out the provisions of the Order. In all such proceedings the Court is authorized to affirm, reverse, or modify the Order, such trial shall be heard de nova." Section 8. There is herewith added to the Auburn City Code Chapter 15.14 which shall read as follows: "CHAPTER 15.14 UNIFORM ADMINISTRATIVE CODE 15.14.010 GENERALLY. The purpose of this code is to provide for the administration and enforcement of the technical codes adopted by this jurisdiction. 15.14.020 AMENDMENTS. TABLE 3-A -- Add item 5 -- Mobile Home Placement Fee -- $10.00 TABLE 3-B -- Delete in its entirety. TABLE 3-D -- Delete items 4 and 5 concerning cesspools and private sewage systems. Section 301 (a) Permits Required -- Add item 1. Mobile home placement in mobile home courts or when placed on private lots, each mobile home/factory home shall first obtain a separate permit for placement. All mobile homes shall be securely fastened to the ground as outlined in the National Fire Code." Section 9. Auburn Codified City Ordinance 15.16.030 is herewith repealed in its entirety and a new Chapter 15.16.030 is hereby created and shall read as follows: "15.16.030 TERM AMENDMENTS IN SECTION 801(a). Reference is made to Chapter 8, Section 801(x) of the Uniform Code for the Abatement of Dangerous Buildings, 1979 Edition. Where the term "Director of Public Works is used therein, it shall be amended to read the "Director of Planning and Community Development." ------------------ Ordinance No. 3609 Page Four 2-23-81 Section 10. Auburn Codified City Ordinance 15.20.010•is`herewith repealed in its entirety and a new Chapter 15.20.010 is hereby created and shall read as follows: "15.20.010 GENERALLY. All mechanical equipment, appliances and parts thereof and installation of same, including gas piping and vents for water heaters, shall be in conformity with the 1979 Edition of the Uniform Mechanical Code, as published by the International Conference of Building Officials, and the Uniform Plumbing Code as published by the International Association of Plumbing and Mechanical Officials." Section 11. Auburn Codified City Ordinance 15.24.010 is herewith repealed in its entirety and a new Chapter 15.24.010 is hereby created and shall read as follows: "15.24.010 AMENDMENT GENERALLY. The provisions of the Uniform Plumbing Code, 1979 Edition, as referred to in this title, shall reflect certain amend- ments, additions and deletions as set forth in this chapter." Section 12. Auburn Codified City Ordinance 15.24.030 is herewith repealed in its entirety and a new Chapter 15.24.030 is hereby created and shall read as follows: "15.24.030 PLUMBING PERMIT - REQUIRED. All persons engaged in doing plumbing, whether as a contractor or a property owner, are required to obtain all applicable plumbing permits from the building official and pay the fee as provided in the Uniform Administrative Code, 1979 Edition." Section 13. Auburn Codified City Ordinance 15.24.040 is herewith. repealed in its entirety. Section 14. Auburn Codified City Ordinance 15.32.0.10 is herewith repealed in its entirety and a new Chapter 15.32.010 is hereby created and shall read as follows: 1115.32.010 ADDITIONAL PROVISIONS ADOPTED. I'n addition to the provisions of Chapter 3 of the Uniform Sign Code, 1979 Edition, there shall be added certain provisions as pertain to the City." s _ _ _ Ordinance No. 3609 Page Five 2-23-81 • r? Section 15. Auburn Codified City Ordinance 15.32.020, 15.32.050, 15.32.060 and 15.32.070 are hereby repealed in their entirety and a new Chapter 15.32.020 is hereby created and shall read as follows: "15.32.020 SIGN FEES, INSPECTIONS AND GENERAL REQUIREMENTS. Sign fees, inspections and general requirements shall be as provided in Chapter 18.62, entitled "Signs", of the Auburn City Code." Section 16. Auburn Codified City Ordinance 15.36.010 is herewith repealed in its entirety and a new Chapter 15.36.010 is hereby created and shall read as follows: "15.36.010 ADOPTION. There is adopted by the City, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the Uniform Fire Code recommended by the Western Fire Chiefs' Association and the International Conference of Building Officials, being particularly the 1979 Edition thereof, together with all amendments thereto, and except such portions as are modified or amended in this Chapter, and Volumes 1 through 16 of the 1980 National Fire Code, as written by the National Fire Protection Association, including supplements "A" and "B", and the UniformFire Code Standards of which codes not less than three f _ (3) copies have been and now'am4on fide in the office of the City Clerk, and the same are adopted and incorporated as fully.as.-if set out at length in this Chapter, the provisions thereof shall be controlling within the City limits." Section 17. Auburn Codified City Ordinance 15.36.040 is hereby repealed in its entirety and a new Chapter 15.36.040 is hereby created and shall read as follows: "15.36.040 SECTION 77.105 AMENDED - BOND FOR BLASTING. Section 77.105 of the Uniform Fire Code is amended to read as follows: "Before a permit to do blasting as required under Section (a) 3 of Section 77.104 shall be issued the applicant for such permit shall produce a valid permit from the Department of Labor and Industries of the State of Washington before filing a bond deemed ------------------- Ordinance No. 3609 Page Six 2-23-81 adequate in each.case by the Bureau of Fire Prevention, which bond shall become available for the payment of any damages arising from the permitted blasting. Section 18. Auburn Codified City Ordinance 15.36.050 and 15.36.060 are hereby repealed in their entirety. Section 19. Auburn Codified City Ordinance 15.36.080 is hereby repealed in its entirety and a new Chapter 15.36.080 is hereby created and shall read as follows: "15.36.080 WELDING OR CUTTING OPERATIONS. There is hereby added to Article 49, a new Section to be known as Section 21.114, "Welding or Cutting Operations Permits" which shall read as follows: A. A permit shall be required of each company, corporation, copartnership or owner-operator performing welding or cutting operations except as provided in Section 31.1148. This permit shall not be required to each welding or cutting job location. The company, corporation, copartnership or?ownei-operator shall notify the Bureau of Fire Prevention in advance where such-work+is taking place, except where such work is done in response to an emergency call that does not allow time for the Bureau of Fire Prevention to be notified in advance of the work. B. A permit shall not be required of any company, corporation, copartnership or owner-operator: (1) Where the welding or cutting is performed in areas approved for the purpose, or, (2) Having an approved permit system established for control of the fire hazards involved. C. Application for a permit required by this Article shall be made by the company, corporation, copartnership or owner/operator performing the welding or cutting operation or by his duly authorized agent. D. A permit for welding or cutting operations shall not be issued unless the individuals in charge of performing such operations are capable of doing such work in a safe manner. Demonstration of a working knowledge of the provisions of the adopted codes and standards governing cutting and welding operations shall constitute acceptable evidence of compliance with this requirement. ------------------ Ordinance No. 3609 Page Seven 2-23-81 E. Companies, corporations, copartnerships and owner-operators required to have a permit shall maintain a record of all locations where welding or cutting operations are performed and have it available for inspection by the Bureau of Fire Prevention." Section 20. Auburn Codified'City Ordinance 15.40.010, 15.40.020, 15.40.030 and 15.40.040 are to be repealed in their entirety. Section 21. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
