' Hl,. 1. . ?% 2 49 N" to ' APR ?. w4 aCt WHEREAS, the City Council of the City of Auburn, Washington, have passed and adopted Resolution No. 1178, resolving that a public hearing shall be had for the purpose of determining whether or not the hereinafter described alley right-of-way located on that portion of land designated as a public alley located approximately 40 feet on the west side of the north-south alley adjacent to railroad right-of-way between "L" and "M" Street Southeast south of 4th Street Southeast, within the corporate limits of the City of Auburn, shall be vacated, said portion to be vacated hereinafter legally described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate'the portion of a certain alley right-of-way located on that portion of land designated as a public alley located approximately 40 feet-on the west side,of,the-north-south alley adjacent to railroad right-of-way between "L" and"M" Street Southeast south of 4th Street Southeast, within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 1178 was held on the 17th day of February, 1981, at 8:00 P.M. in the Council Chambers of the Auburn City Hall, no objections thereto were filed with the City Clerk or presented to the City Council at said hearing; and WHEREAS, the City Council, having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; 1 o/- 607- 51-'3- vva -%z NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: ------------------ Ordinance No. 3611 Page One 2-24-81 r r l1?r/?_ Section 1. That the following described portion of a certain alley right-of-way situated on that portion of land designated as a public alley located approximately 40 feet on the west side of the north-south alley adjacent to railroad right-of-way between "L" and "M" Street Southeast south of 4th Street Southeast, within the corporate limits of the City of Auburn, Washington, t and more particularly described as follows: Beginning at the southeast corner of Lot 4, Block 3, Knickerbocker's Second Addition as recorded in Volume 20 of Plats, page 89, Records of King County, Washington said point being on the north line of the Burlington .,r. Northern Railroad right of way; thence north along the + east line of said Lot 4, 26.63 feet; thence northeasterly along the easterly line of Lot 3, 14.38 feet; thence south parallel with the east line of said Lot 4 to the north line of the Burlington Northern Railroad right of way; thence west along the Burlington Northern Rail- road right of way 10 feet more or less to the point of beginning. be and the same is hereby vacated, and the property lying in said portion of a certain alley right-of-way described hereinabove, shall be returned and belong to the abutting property owners, of said portion of a certain alley right-of-way located on that portion of land designated as a public alley located approximately 40 feet on the west side of the north-south alley adjacent to railroad right-of- way between "L" and "M" Street Southeast south of 4th Street Southeast, lying within the corporate limits of the City of Auburn, Washington. Section 2. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor. -------------------- Ordinance No. 3611 Page Two 2-24-81 Section 3. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
