- AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR
THE ANNEXATION TO THE CITY OF AUBURN OP A CONTINGUOUS AREA OF LAND LYING
ON THE NORTHEAST CORNER OF "R" STREET AND 4TH STREETS N:E., WHICH LAND IS
DESCRIBED IN A PETITION DULY FILED WITH THE CITY COUNCIL OF THE CITY Of
AUBURN, WASHINGTON.
. ' WHEREAS, the City Council of the City of Auburn was notified by owners of
property having more than ten percent in balue of the assessed valuation .
within the;proposed area?to be annexed, that they desired to circulate a peti-
tion to cormnence annexation proceedings to the City of Auburn; and
. WHEREAS, the petition for annexation of the property hereinafter descri6ed
was duly filed with the City Council of the City of Auburn on the 20th day of
July, 1981, which.petition was signed by the owners of more than 75% in
value of all of the proper,ty lying within the limits of the proposed area to •
be annexed according to the assessed valuation for general taxation of the •
property for which an annexation :is petitioned, said petition setting for the
legal description of the property to be annexed and being accompanied by a .
plat outlining the boundaries of said area sought to be annexed; and
WHEREAS, the C:ity Council of the City of Auburn fixed a date for~public
hearing to be held atr8:00,.P.M. in'CouncilChambers of the Auburn City Hall on

September 8, 1981, setting forth notice of said public hearing for annexation
to be published in the•official C:ity.newspaper of the City of Auburn in one
issue of said newspaper, and.pr,oviding for the posting in three puhlic places

within the area proposed for annexation of copies of said notice of public
hearing; and
WHEREAS, notice of public hearing of said petition'of annexation to the
• City of Auburn has been duly published in the official newspaper of the City
of Auburn in one regular issue of said newspaper, and.the said notice of
public hearing having been posted in three public places within the area pro- ,
posed for annexation by the City Clerk of the City of Auburn, and said public ,
hearing being held at 8:00 P.M. in the Council Chambers of the Auburn City
Hall,on September 8,,1981, and the City Council of the City of Auburn having

determined that said annexation is in the best interest and welfare of the
-City of Auburn, did accept and approve the petiton above described and
directed the filing of a notice of its intention to annex the hereinafter
described property with the Boundary Review Board as requ5retl by Section 9 of
Chapter 189 of Laws of the State of Washington for the year 1967; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AS FOLLOWS:
Section 1. That the petition for annezation of the property hereinafter
tlescr.ibed in Section 6 of this Ordinance has been duly and properly filed with
the City Council of the Cify of Auburn, and complies with all requirements of
1aw.
Section 2. That by regular motion adopted and passed by the City Council
on the 20th-day.of July, 1981, it was ordered that a public hearing be had on
said petition for the annexation at 8:00 P.M. in the Council Chambers of_the
Auburn City Hall on September 8, 1981, providing for the proper notice to be
published and posted accordirig to law.,
Section 3. That proper notice of.public hearing was duly published in the
official newspaper of the;City of Auburn; and was duly.posted in three public
places with'in the area proposed for annexation.hereinafter described, and that

a public hearing was held at 8:00 P.M. in the Council Chambers of the Auburn
City Hall on the 8th day of September, 1981.
Section 4. That at the conclusion of the public hearing in the City Hall
Council Chambers of the City of Auburn on the 8th day of September, 1981, the
City Council did approve the petition for annexation and directed the filing
of a notice of its intention to annex the fiereinafter described property with
the Boundary Review Board as required in Section 9 of Chapter 189 of the State
of Washington taw :for the Year 1967. .

Section'5. That notice of intention to annex was filed with the Boundary
Review Boacd effective October 16, 1981, and the Boundary Review Board
received no request for review and did not itself choose to invoke
jur.isdiction; therefore, inasmuch as the sixty-day period"subsequent to filing
' prov.ided for in RCW 36.93.100 has elapsed, the Notice of Intention was deemed
approved as of December 10, 1981, and the Boundary Review Board forwarded '
their findings to the'City Council of the City of Auburn. • Section b. That the property lying continguous on the'Northeast corner of '
"R"; Street.and 4th Streets.N.E., hereinafter described be and the same is . r
hereby annexed to the City of Auburn; said property being.more particularly
described as follows, to-wit:
That portion of Section 17,.Township 21 North, Range 5 E.W.M.
described as follows:,.
Lots 1 and 2 of.King County Short Plat No. 376064 as recorded under
• King County.File No..7606210660; .
Together with that portion of 4th Street N:E: atiutting the south line
'of said Lots 1 and 2. • ' • '
. Section 7. That the effective; ~date of`the,annexation of tfie above

described property to the :City of Auburn shall be the_effective tlate of the.
• passage of this Ordinance providing for, such!' annexat•ion. . : ,
Section 8. That in accordancewith the.terms:of. the' petition for annexa-
tion of the.above descri6ed prop'erty,.the areatorbe annexed shall assume the
indebtedness of the City of Auburn ezisting at the effective date of`the
passage of this Ordinance. •

Section 9. This Ordinance sha1J take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.
