I 1 property which will be especially benefited by the proposed improvements .2 and the estimated amount of'the cost and expense thereof to be borne by each 3 lot, tract.and parcel of land or other property. 4 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON DO 5 ORDAIN AS FOLLOWS: 6 Section 1. That the property legally described in Section 2 of this 7 Ordinance, situate ins.ide the corporate limits of the City of Auburn, be 8 improved by the construction and installation of curb and gutter, street, 9 sidewalk, and street lighting on 40th Street N.E. between Auburn Way North and 10 "I" Street N.E., all in accordance with plans and specifications prepared by 11 the City Engineer and filed with the City Clerk. 12 Section 2. That there is hereby created and established a Local 13 . Improvement District to be designated Local.Improvement District No. 323, 14 which said district,is legally descr.ibed as follows: 15 , That portion of the H. H. Jones Donation Claim No. 39 in Sec 6, Twp 16 `21 N, R 5, E.W:M.'described as follows: 17 ' King County Tax Lots 12, 13, 28 and 42. 18 That portion of the George E. ' 31 32 Ordinance No. 3734 Page Two of Four , 2_9_82 . . . . . , ~ ~ . ..i 1 inspection;advertising, publication and notices, and all other expenses 2 incident thereto, shall be levied and assessed against all of the property 3 legally and properly assessable therefor, as provided by the laws of the State 4 of Washiington and the Ordinances of the City of Auburn. 5 Section 5. That said improvements shall be made by the City of Auburn ~ 6 under the:supervision of the City Council thereof or such committee or person . 7 as the City Council may designate. 8 Section 6'. 'Assessments or any portion thereof, may be paid at any time 9 within.thirty (30) days from the date of the first publication of the Notice 10 of Collection of such assessments without penalty, interest, or cost, and 11 thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal 12 annual installments, wi.th interest on,the whole,unpaid sum at the rate of 13 one half (1/2) of one percent (1%) in excess of the net effective rate of the 14 Local Improvement District bonds with the interest in no case being greater 15 than thirteen percent (13%). Commencing with the first year after the last 16 day, such.-assessments or an , y portion thereof, may be paid without penalty, 17 interest or cost (th'irty (30) days from`the date of the first publication of 18 . .L . . , < : 0 the Treasurer's.Notice'of Col]ection of Assessments) and each year thereafter 19 one of said .installments, together,with'the interest due, shall be collected 20 as provided by law and the Ordinances of the City of Auburn; assessments or 21 installments-of' assessments not paid.when due shall be delinquent and there 22 shall be added to the same a penalty of twelve percent (12%) of the amount of 23 the overdue installments and interest 'and such . , penalty shall become a part of 24 the lien upon'the property assessed. 25 Section 7. That there is hereby created in the Office of the Finance 26 Director for the City of Auburn, a fund of the City.to be known as "Local 27 .
