AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE
VACATION OF A PORTION OF STREET RIGHT-OF-WAY SITUATE ON A PORTION OF "D" STREET
N.E., IMMEDIATECY NORTH OF AUBURN WAY NORTH WITHIN THE CORPORATE LIMITS OF THE
CITY OF AUBURN, WASHINGTON.
WHEREAS, the City Council of the City of Auburn have passed and adopted Resolution
No. 504 resolving that a public hearing shall be had for the purpose of determining
whether or not the hereinafter described street right-of-way situate on a portion of
"D" Street N.E., immediately North of Auburn Way North within the corporate limits of
the City of Auburn shall be vacateci, said p.ortion to be vacated beino hereinaftzr legally
described in Section 1 of this Ordinance; and,
WHEREAS, notice of public hearing to vacate the portion of a certain street right-
of-way on a portion of "D" Street N.E., immediately North of Auburn Way North lying
within the corporate limits of the City of Auburn, in the time and manner provided by
law, giving notice that the hearing on said Resolution No. 504 was to be held on the
3rd day of April, 1972 at 8:00 P.M. in the Council Chambers of the City Hall of the City
of Auburn, and no objections thereto were filed with the City Clerk or presented to the
City Council at said hearing; and,
WHEREAS, the City Council, having deemed that the petition for vacation was proper
and that no vested rights would be affected by the same;
fVOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. That the following described partion of a certain street right-of-way
situate on a portion of D Street N.E., immediately North of Auburn Way North lying
within the corporate limits of the City of Auburn, more particularly described as follows
The following tract of land is in Sec 31, Twp 22 N, R 5 E. W.M., also known as
part of Lot 36 of White River Valley Home Tracts, 2nd Addition (unrecorded)
Plat Book No. 3, Page 3, Volume , King County, Washington, and that part
vacated for the Kent-Auburn Road S.C. No. 85322 (Kent-Thomas Road) described
as follows:
Beginning at the Ely margin of Auburn Way North and the W margin of "D" St. N.E
(Kent-Auburn Rd.~ (86th Ave. So.), Washington State Highway centerline Sta.
P.O.T. 128 + 63~ as on Feb. 26, 1934; th N on a curve to the right 45.32 ft.
arc length, whose said curve's delta angle is 1°46'32", radius length is 1462.41
ft., tangent length is 22.66, along the W margin of "D" St. N.E.; th Nly on a
curve to the left 140.27 ft. arc length, whose said curve's delta angle is 47°
16'29", radius is 970 ft., tangent length 74.40 ft., to the E margin of "D° St.
N.E.; th SWIy on a curve to the left 190.22 ft. arc length, whose said curve's
delta angle is 7°46'18", radius is 1402.20 ft., tangent length is 95.36 ft.
along the E margin of "D" St. N.E.; th S 82°10'42" W 44.06 ft. to the E margin
of Auburn Way North; th iV 37°03'00° W 32.10 ft. along the E margin of Auburn Wa,
North, to the TPOB.
Be and the same is hereby vacated, and the property lying in said portion of a certain
street right-of-way described hereinabove, shall be returned and belong to the abutting
property owner of said portion of a certain street right-of-way situate on a portion of

"D" Street N.E., immediately North of Auburn Way North lying within the corporate limits
of the City of Auburn.
Section 2. That the request for vacation of street right-of-way be granted subject
to a utility easement over, upon and under the entire parcel of land for public

N Section 3. That this Ordinance shall take effect upon recording of street dedica-
p tion for the realignment of "D" Street N.E. in the office of the King County Auditor and
~ after its passage, approval and publicationS as provided by law.
