ORDINANCE IVO. 5 6 3 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED BETWEEN AUBURN WAY NORTH AND I. STREET iN THE 4200 BLOCK WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION FROM R-4 (MULTI-FAMILY) TO C-3 (HEAVY COMMERCIAL). WHEREAS, Application No. REZ01-0001 dated February 15, 2001, has been submitted to the Cify of Aubum, Washington, by George Kawasaki of Kawasaki Limited Partnership, requesting the rezoning of the. parcel of land at Aubum Way North and I Street in the 4200 Block from R-4 (MULTI-FAMILY) to C-3 (HEAVY COMMERCIAL) and hereinafter described below and as identified , on Exhibit "A" attached hereto and incorporafed in this Ordinance bythis ~ ~ . reference; and ~ 0 ° WHEREAS, said request above referred to the Hearing Examiner for study and public hearing thereon; and . c WHEREAS, the Hearing Examiner, based upon staff review, held a - public hearing to consider the request in the Council Chambers of Aubum City Half on January 30, 2002, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property; and . WHEREAS, the Cify Council, on January 30, 2002, considered said request and affirmed the Hearing Examiner's recommendation for rezone Ordinance 5636 February 11, 2002 Page 1 based upon the following Findings of Fact and Conclusions of Law and Decision, to-wit: FINDINGS OF FACT 1. Kawasaki Limited Partnership has requested to have its property located easterly of Aubum Way North and westerly, , of the proposed "I" Street` , corridor, generally in the 4200 block, be rezoned from its existing zoning of R-4, Multi-family to a proposed zoning of C-3, Heavy CommerciaL The . property is 2.3 acres in size and is currently used to grow agricultural crops. 2. The parcel that is proposed to be rezoned is part of a larger parcel that lies between Aubum Way North and the proposed "I" Street corridor. The total parcel is 4.16 acres in size. That portion of the parcel (1.86 acres) that fronts Aubum Way North is now. zoned C-3, Heavy CommerciaL This portion of the parcel is also used to grow agricultural crops. 3. The City ofi Aubum Comprehensive Land Use Plan map illustrates the subjecf parcel to be °Heavy Commercial". The City Council in 2000 amended the Comprehensive Land Use Plan map to change the map. designation from multi-family to heavy commercial. The map was ~ amended to be consistent with the commercial uses that abut the property ~ on the south. The heavy commercial designation is now therefore G appropriate for the proposed C-3 zoning. 0 ~ 4. As part of the environmental review process, the applicant has also ~ submitted plans for development of the entire 4.16-acre site. The project o will consist of two single story commercial buildings that together will be c'm about 62,335 square feet. No tenants have yet been proposed for the ; ~ project. . ct.c . 5. The property to the south is zoned C-3 and is developed as a commercial use. The property to the east is agricultural land owned by the applicanf. . To the north is a professional office/counseling facility and to the west across Aubum Way North is an existing use. 6. The contents of the ease file, REZ01-0001, and the environmental file, SEP01-007, of this project are hereby incorporated by reference and made part of the record of this hearing. Ordinance 5638 , February 11, 2002 Page 2 ~ CONCLUSIONS OF LAW The undersigned has concluded that the rezone may be approved in that the proposal is consistent with the Comprehensive Plan IVlap designations, zoning . and existing uses in the area. DECISION For each of the above reasons, the recommendation of the Hearing Examiner to the Aubum City Council on this rezone application is approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Puruose. The above-cited Hearing Examinei's Findings of Fact, Conclusions of Law and Decision, are herewith incorporated in this . ^ Ordinance. ~ ~ Section 2. The invalidity ofi any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validify Ordinance 5636 February 11, 2002 Page 3 of the remainder of this ordinance, or the validity of its application to other persons or circumstances. , Section 4. RecordinQ. Upon the passage, approval and publication of this Ordinance as provided by.law; the City Clerk of the City of Aubum shall cause this 'Ordinance to be recorded in #he office of the King County Auditor, Division of Records and Elections. . Section 5. Imblementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6. Effective date. This Ordinance shaU take' effect and be in ' force five days from and after its passage, approval and publication as provided ~ ~ by law.
