WHEREAS, a petition dat2d -yovember 29, 1976, tagether with plot plans and exterior elevations therefor, has been submitted to the Council of the CI~ B~f"'~► ~ City of Auburn, by GERALD C. LYBECK, requesting a Conditional Use Permit, which would allow for the construction of a professional office located on the southwest corner of 4th and "D" Streets Uortheast, within the City of Auburn, Washington, which property hereinafter described in Section 1 of this Ordinance and which property presently carries an R-4 (Multi-family) classifi- cation; and WHEREAS, said request above referred to was referred by the City Council to the City Planning Commission for study and public hearing thereon; and WHEREAS, the Planning Commission held a public hearing to consider the requ2st in the City Hall of the City of Auburn, at 7:30 P.M. on January 4, 1977, and subsequent thereto the City Planning Commission approved the issuance of the rezoning of R-4 (Multi-Family) to a Conditional Use Permit, finding that the aroposed use illustrated by the site development plans of the petitioner would not be unduly deterimental to the adjacent and surrounding properties and the enjoyment tnereof; and c•1iiERcAS, the City Council of the City of Auburn held apublic hearing to consider said petition in the City Hall of the City of Auburn, at 8:00 P.M. on February 7, 1977, at the conclusion of !vhicn the City Council concurrad with the recom;iiendations of the Planning Comunission as hereinabove stated; iVOrJ, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURy, 'rJASHINGTOiJ, DO ORDAIN AS FOLLOWS: Ordinance yo.3155 Page One 2-14-77 . f ♦ y ' • ~ \ Section l. That a Conditional Use Permit be granted for the puraose of constructing a professional office on aparcel of land located on the southwest corner of 4th and "D" Streets Northeast, situated within the City of Auburn, and legally described as follows: Lots 1 and 2, Block E, Arthur C. Ballard's Condict Addition as recorded in Vol. 19 of Plats, page 88, records of King County, Washington, together with vacated street adj and C~ situated in Section 18, Township 21 N, Range 5 EWM, City of Auburn, County of King, State of Washington. f~- f~ in accordance witfi the plot plans and exterior elevations for said development t"3 ~ submitted with the request for Conditional Use Permit, a copy of which is attached N hereto, designated Exhibit "A" and by this reference made a part hereof as though set forth in full herein. Section 2. That off-street parking as prescribed by the parking ordinance, in addition to those required by the residence, be constructed. Section 3. That any sign advertising the business located on the property, shall be restricted to a low profile ground sign or attached to the face of the building and may be illuminated indirectly. Section 4. That the City Clerk of the City of Auburn is hereby authorized and directed to file a certified copy of this Ordinance with the King County Auditor's Office. Section 5. That this Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
