HomeMy WebLinkAbout3158 ORDINAfJCE N0. 3 1 5 8 Aid ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND aSSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0. 288, WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING FOR THE CONSTRUCTION AND INSTALLATION OF ROADWAY SURFACING, CURS AND GUTTER, STJRM DRAINAGE, SIDEWALKS AND FIRE HYDRANTS ASSEMBLY ON 23RD STREET NORTHEAST, EAST AND WEST OF "E" STREET NORTHEAST, INSIDE THE CORPORATE LIMITS OF THE CITY OF AUBURN; AS PROVIDED 3Y ORDIfVANCE N0. 3099, OF THE CITY OF AUBURN, AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST TNE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY UPON SAID ROLL. WHEREAS, the assessment roll levying the special assessments against the properties located in the Local Improvement District No. 288 of the City of Auburn, Wasnington, created under Ordinance No. 3099, has been filed with the City Clerk of the City of Auburn, as provided by law; and WHEREAS, notice of the time and place of hearing thereof and making objections and protests to said roll was duly published at and for the time and in the manner provided 5y law, fixing the time and place of hearing thereon for the 22nd day of February 1977, at the hour of 8:00 P.M. in the Council Chambers of the City Hall of Auburn, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner shown on said roll; and WHEREAS, at the time and place fixed and designated in said notice of hearing was duly held and no protests were filed at said hearing; and WHEREAS, after the hearing was held the assessment roll was accepted as presented and ordered confirmed. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That there is hereby in all respects approved and confirmed the assessment and assessment roll in Local Improvement District No. 288, providing for the construction and installation of raodway surfacing, curb and gutter, storm drainage, sidewalks and fire hydrants assembly on 23rd Street Northeast, east and west of "E" Street Northeast, inside the corporate limits of the City of Auburn, according to plans prepared and on file in the office of the City Engineer of the City of Auburn, for the benefit of the foliowing described property: Ordinance No. 3158 Page ane 2-25-77 . • . Lot 20, Mardel Addition Division #2, as recorded in Vol. "of Plats, pg Records of King County, Washington That por of the J. Lake Donation Claim #41 in Sec 7, Twp 21 y, R 5 EWM desc. as follows: The W 25 ft of the N 455.45 ft of the S 480.2 ft of E 955.91 ft of D.C. less Co. Rd and less N 120 ft of E 395 ft lyg W of St. Rd and less N 100 ft of S 360.2 ft of E 217.8 ft and less por platted as Mardel Add. Div. #2. That por of the J. Lake D.C. #41 in Sec 7 Twp 21 N, R 5 EWM desc as follows: The West 120 of 430 ft of S 30 ft of said D.C. less street. That por of J. Lake D.C. #41 in Sec 7, Twp 21 N, R 5 EWM desc as foliows: The W 120 ft of the E 600 ft of said D.C., less streets. Section 2. That each of the lots and other property upon said assessment roll is hereby declared to be especially benefited by said improvements in at least the amount charged against the same, and that the assessment appearing against each of the sa-ne is in proportion to the several assessments appearing on said roll. That all of the property shall be assessed according to the lineal frontage of the property abutting said property to be improved and shall be assessed according to their proportionate share of the several assessments appearing upon the said assessment roll and there is hereby levied and assessed against such lots and other property appearing upon said ro17, the amount finally charged.therein against the same; said amount, or any portion thereof, may be paid at any time within thirty (30) days from the date of the first publication of the Notice of Coliection of said assessments without penalty, interest or cost; there- after the sum remaining unpaid, if any, may be paid in ten (10) equal annual installments, with interest on the whole unpaid sum at the rate of seven and one-half percent (7.5%) per annum. Commencing with the first year after the last day, such assessments, or any portion thereof, may be paid without penalty, interest or cost (30 days from the date of the first publication of the Treasurer's Notice of Collection of Assessments) and each year thereafter, one of said installments, together with Ordinance No. 3158 Page Two 2-25-77 J ~ the interest due, shall be collected as provided by law and the Ordinances of the City of Auburn, assessments or installments of assessments not paid when due shall be delinquent and there shall be added to the same a penalty of five percent (5%) of the amount of the overdue installment and interest, and such penalty shall become a part of the lien u.pon the property assessed. Section 3. All monies collected by the City Treasurer upon any of the assessments levied, as authorized herein, shall be paid into " Local Improvement District No. 288 Fund" created by Ordinance No. 3099, and shall be used only for the purpose of redeeming warrants and/or bonds drawn upon or issued against said fund. Section 4. That this Ordinance shall take effect and be i.n force five (5) days from and after its passage, approval and publication, as provided by law.
