AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROUIDING FOR THE REZONING
OF A PARCEL OF LAND LOCATED ON THE EAST SIDE OF "M" STREET S.E.,
NORTH AND ADJACENT TO THE BURLINGTON NORTHERN RAILROAD RIGHT-OF-
WAY, SITUATE WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE
ZONING CLASSIFICATION THEREOF FROM R-4 TO R-4 WITH A CONDITIONAL
USE PERMIT.

~ WHEREAS, a petition dated February 23, 1977, together with plot plans
Q and exterior elevations therefor, has been submitted to the Council of the City
~ of Auburn, by MICHAEL W. 0'BRIEN, requesting an R-4 (Multi-Family) with a

Conditional Use Permit, which would allow for the construction of a display
model home on property located on the east side of "M" Street S.E., north
and adjacent to the Burlington Northern Railroad and Highway 18, within the
City of Auburn, Washington, which property hereinafter described in Section 1
of this Ordinance and which property presently carries an R-4 (Multiple Family)
classification; and
WHEREAS, said request above referred to was referred by the City Council
to the City Planning Corrrrnission for study and public hearing thereon; and
WHEREAS, the planning Commission held a public hearing to consider the
request in the City Hall of the City of Auburn, at 7:30 P.M. on March 8, 1977,
and subsequent thereto the City Planning Commission approved the issuance of the
rezoning of R-4 to R-4 with a Conditional Use Permit, finding that the proposed
use illustrated by the site development plans of the petitioners would not be
unduly detrimental to the adjacent and surrounding properties and the enjoyment
thereof; and
WHEREAS, the City Council of the City of Auburn held a public hearing to
consider said petition in the City Hall of the City of Auburn at 8:00 P.M. on
April 4, 1977, at the conclusion of which the City Council concurred with the
recommendations of the Planning Commission as hereinabove stated;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURiV, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. That an R-4 with a Conditional Use Permit be granted for the .
purpose of constructing a display model home on property located on the east side
of "M" Street S.E., north and adjacent to the Burlington Northern Railroad and
Highway 18, situated within the City of Auburn, and legally described as follows:
The S 100 ft of Lots 25 and 26, East Auburn Acres as recorded
in Vol 14 of Plats, page 41, King County, Wash. located in Sec
18, Twp 21 N, R 5 EYJiN and situated in City of Auburn, County •
of King, State of Washington. .

Section 2. That the off-street parking be arranged so that vehicles
when leaving the parking lot will not have to back out onto "iN" Street S.E.
Section 3. That any sign advertising the sale of buildings and/or the
company name be restricted to a low profile ground sign no more than 42 inches
in height or a face sign attached to the wall of the building. These signs
shall be indirectly lit and shall not have any beacon, moving or flashing
lights. The size and design of the sign shall be approved by the Planning
Director.
Section 4. That the City Clerk of the City of Auburn is hereby authorized
and directed to file a certified copy of this Ordinance with the King County
Auditor's Office.
Section 5. That this Or.dinance shall take effect and be in force five
(5) days frum and after its passage, approval and publication, as provided by
law.
