8 Seotion 1. Pur�oae. The purpose of this ordinance is to
9 update the provisions oP Auburn City Code Chapter 2.72
l0 . entitled "Cemetery". This update requires repealinq certain
ll sections and addinq and amending certain sections.
12 ' Section 2. 'New Beation. There is hereby added to Auburn
13 City Code Chaptar 2.72 entitled "Cemetery" a new Section
141 2'�2'025 entitled °Definitions°, to read as follows:
15 2•�2•�Zg Definitions.
16 A. "Burial" means the placement of human remains in a
qrave.
17 B. "Cemetery" means any one, or combination of more
18 than one, of the followinq, in a place used, and
dedicated for cemetery purposes:
19 1. A burial place for earth interments.
� 2. A mausoleum for crypt interments.
21 3. A columbariwn, for interment of cremated
22 remains.

1 C. "Col�bari�" means a structure or other space
Z containinq niches for permanent inurnment of
cremated remains.
3 D. "Committal° means that
part of a funeral service
4 which commits the remains of the deceased to their
final sestinq place.
5 E. "Cremated .remains" means a human body after
6 cremation in a crematory.
� F. "Crypt" means a space in a mausoleum of sufficient
size, used or intended to be used, to entomb
$ unczemated human remains.
9 G. "FUneral" means a memorial service for a deceased
person.
10 g_ pGrave" means a Bpace of ground in a cemetery, used.
T1 or intended to be used for burial.
12 I. "Companion qrave" means two single qraves side by
side or one double depth grave.
13 J. "Grave owner" or "owner" means any person in whose
14 name an intermant plot stands of record as owner, in
the records of the cemetery authority.
15 �, nHUman remains° or °remains° means the body of a
16: deceased parson, and includes the body in any atage
of decomposition eaccept cremated remains.
17 L. "Interment^ means the disposition of human remains
18 by cramation and inurnmeat, entombment, or burial in
a cemetery.
19 M. °Marker and/or memorial" means any qrave marker,
20 headstone or monument that is intended to
permanently mark a qrave.
21 N. "Mausoleum^ means a st=ucture or buildinq for the
22 entombment of human remains in crypts in a place
used, or intended to be used, for cemetery purposes.

planninq, capital improvements, fee structure, cemetery
12 expansion, rules and regulations, and budqet of all
cemeteries belonging to the city. The board shall not
13 have authority to enter into any contract, incur any
indebtedness, or take any personnel action unless
14 $Pecifically authorized by the mayor and city counciL
The board Bhall :have the right to ( (eaa#gn) ) desianate
15 certain portions of the .city's cemeteries for the burial
of infants, sinqle and double deoth burials, persons of a
16 Particular reliqion, ( (if-aeeeasarp) ) certain areas where
no monuments sliall project above the surface of the
17 ground, ( (ead) ) the interment of cremated remains ( (s) )
and the burial of veterans. The board may also solicit
18 or receive on behalf of the citp council any qifts or
bequests of money for cemetery purposes; however, gifts
19 of real or peisonal property will not be accepted without
prior approval of the city counc3l.

6 2.72.060 Bnles anfl requlations - Purpose - Amendments.
� The rules and regulations contained in this chapter are
made only for the benefit of the ( (�et) ) arave o�mers and
8 are desiqne.d to limit their rights insoPar as such
limitations are for the benefit of all. If rules and
9 requlations are not made, the exercise by cartain ones,
of what would seem to be their proper riqhts, wouTd
10 interfere with the rights and enjoyment of others, as
well as destroy the qeneral scheme and beauty of the
11 property. No rule has been adopted except as is
necessary to preserve the rights of all for whom the city
12 considers itself the trustee.
13 These rules and regulations may be changed or amended
( (riEkan�-net�ee) ) at any time by the city council, and
14 will_ be so changed and amended when a� rule is found to
be detrimenta7. to the best interests of the ( (�et) ) grave
15 �ers as a whole or wheri new conditions require the
adoption of other or further 'regulations.

2.72.07o Sndored care.
18 No ( (�ats) ) araves, niches, crvots, will be sold in the
19 Auburn cemetery without endowed care. °Endowed care°
includes the upkeep of driveways and walks and other
�p improvements belonging to the cemetery, mowing the qrasa
at reasonable intervals, pruning shrubs and trees and
21 such work as shall be neceseary.

with endowed care without additional charqe and are

exempt from taxation and cannot be sold for debt or

prohibited and liable to severe penalty according to

improper, it. wiTl be removed. Patrons are requested not
18 to offer money to ( (werlemea) ) the stafP. Bills due the
city for labor and materials � supplies are a lien on.

have the riqht to make exceptions Prom the foreqoinq

21 as rescindinq or waiving any oP these rules. Any waiver
that may be made by the city council shall not be or
22 considered to be a contiauinq waiver and shall not bar
the city or city council from enforcing the usual rules
23 and regulations at any later time � it may be desired so
to do.

8 it does meet cemetery standards.

l0 �apter 2.72 entitled "Cemetery", a new Section 2.72.305
11 entitled "Welfare Burlals", to read as follows:
12 2.72.305 Welfare Burials.
13 Welfare burials will be accevted if the deceased's
residence- was. within the city limits at the time of death

17 Seation 8. Authoritv. The Mayor is hereby authorized to
18 implement such administrative procedures as may be necessary
19 to carry out the directives of this legislation.
2O Seation 9. Sffective Date. This Ordinance shall become
21 effective within five (5) days from and after its passaqe,
22 approyal and publication, as proeided by law.
