2 , AN ORDINANCE Of THE CITY COUNCIL O,F THE CITY OF AUBURN, WASHIN6TON, REPEALING
AUBURN CITY ORDINANCE N0. 3613, CODIFIED AS CHAPTER 15.68, RELATING TO
3 FLOOD HAZARD AREAS, AND CREATIN6 A NEW ORDINANCE TO REPLACE THE SAME.
4 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHIN6TON, DO ORDAIN AS fOLLOWS:
5 Section 1. Auburn City Ordinance No. 3613, passed April 6, 1981, and
6 codified as Auburn Codified City Ordinance Chapter 15.68, relating to flood
ry hazard areas, is, upon the effective date hereof, repealed in its ent9rety.
g Section 2. There is herewith created a new Auburn Codified City Ordinance
g Chapter 15.68, relating to fl ood hazard areas, which shall read as follows,
10 to-wit:
11 SECTION 1.0
12 STATUTO&Y AUTNORIZATION, FINDIN65 OF fACT, PURPOSE AND OBJECTIVES
13 1.1 STATUTORY AUTNORIZATION
14 The Legislature of the State of Washington has in 5tate law de]egated the
15 responsiblity to local governmental units to adopt regulations designated
16 to promote the public health, safety, and general Nelfare of its citi-
17 zenry. Therefore, the City Council of the City of Auburn, Washington,
18 does ordain as foilows:
19 1.2 FIflDINGS OF FACT
20 (i) The flood hazard areas of the City of Auburn are subject to .periodic
21 inundation which results in loss of life and property, health and safety
22 hazards , disruption of commerce and governmental services, extraordinary
23 public expenditures for flood protection and relief, and impairment of
24 the tax base, all of which adversely affect the public health, safety and
25 9eneral welfare.
26 (2) These flood losses are caused by the cumulative effect of obstruc-
27 �tions in areas of special fl ood hazards which increase flood heights ,and
28 velocities , and when inadequately anchored, damage uses in other areas.
29 Uses that are inadequately floodproofed, elevated or otherwise protected
30 from flood damage also contribute to the flood loss.

1 1.3 STATEMENT OF PURPOSE
2 It is the purpose of this ordinance to promote the public health,
3 safety, and general welfare, and to minimize public and private losses
4 due to flood conditians in specific areas by provisions designed:
5 (1) To protect human life and health;
6 ' (2) To minimize expenditure of public money and costly flood control
7 pro f ec ts;
$ (3) To minimize the need for rescue and relief efforts assoc.iated
with the flooding and generally undertaken at the expense of the
9 general public;
10 �4) To minimize prolonged business interruptions;
11 �5) To minimize damage to public facilities and utilities such as
water and gas mains, electric, telephone and sewer lines, streets
12 and bridges located in areas of special fl ood hazard;
13 �6) To help mainta.in a stabie tax base by providing for the sound use
and development of areas of special fl ood hazard so as to mini-
14 mize future flood blight areas;
15 ��) To ensure that potential buyers are notified that property is in
an area of special flood hazard; and,
16
(8) To ensure that those who occupy the areas of special fl ood hazard
17 assume respons9bility for their actions.
18 1.4 METHODS OF RfDUCIN6 FLOOD LOSSES
ly In order to accomplish its purposes, this ord9nance includes methads and
20 provisions for:
21 (1) Restricting or prohibiting uses which are dangerous to health,
safety, and property due to water or erosion hazards, or wh9cti
22 result in damaging increases in erosion or in flood heights or
velocities;
23
(2) Requ9ring that uses vulnerable to fl oods, including facilities
24 which serve such uses, be protected against flood damage at the
time of initial construction;
25
(3) Controlling the alteration of natural flood plains. stream chan-
26 nels, and natural protective barriers, which help accommodate or
channel flood waters;
27
(4) Controlling filling, grading, dredging, and other development
2g which may increase flood damage; and
2g (5) Preventing or regulating the construction of flood barriecs which
wil`1 unnaturally divert flood waters or which may increase flood
30 hazards in other areas.

1 SECTION 2.0
2 DEFINITIONS
3 Unless specifically defined below, words or pharases used in this ordi-
¢ nance sha11 be interpreted so as to give them the meaning they haVe in coimnon
5 usage and to give this ordinance its most reasonable application.
6 °APPEAL° means a request for a review of the City of Auburn Engineering
7 Division's interpretaton of any provisions of this ordinance. or a request for
8 a variance.
9 "AREA OF SNALLOW FLOODINfi° means a designated AO or AH Zone on the Flood
10 Insurance Rate Map (FIRM) . The base flood depths range from one to three feet;
11 a clearly defined channel does not exist; the path of flooding is unpredic-
12 table and 9ndeterminate; and, velocity fl ow may be evident. AO is charac-
13 terized as sheet flow and AH indicates ponding.
14 °AREp OF SPECIAL FLOOD HAZARD" means the land in the flood plain with3n a
15 community subject to a one percent or greater chance of flooding in any g9ven
16 year. Designation on maps always includes the letters A or V.
17 "gpsE FLOOD° means the flood having a one percent chance of being
18 equalled or exceeded in any given year. Also referred to as the °100-year
19 flood." Designtion on maps always includes the letters A or V.
20 °DEUELOPM�NT° means any man-made change to improved or unimproved real
21 estate, including but not limited to building or other structures, mining,
22 dredging, filling, grading, paving, excavation or drilling operations located
2 3 within the area of special flood hazard.
24 °FLOOD° or °FCOODIN6° means a general and temporary condition of partial
25 or complete inundation of normally dry land areas from:
26
(1) The overflow of inland or tidal waters and/or
27
(2) The unusual and rapid accumulation of runoff of
28 surface waters from any source.
29 °FLOOD INSURANCE RATE MAP" _(FIRM) means the official map on which the
30 Federal Insurance Administration has delineated both the areas of special
31 floodhazards and the risk premium zones applicable to the community.

1 "FLOOD INSURANCE STUDT° means the official report provided by: the Fede�al
2 Insurance Administration that includes flood profiles, the Flood Boundary-
3 Floodway Map, and the water surface elevation of the base flood.
4 °FLUODYAY° means the channel of a river or other watercourse and the
5 adjacent land areas that must be reserved in order to discharge the base flood
6 without cumuTatively increasing the water surface elevation more than one
7 foot.
8 °LONETT ROOR° means the lowest floor of the lowest enclosed area
9 (including basement). An unfinished or flood resistant enclosure, usabie
10 solely for parking of vehicles, building access or storage, in an area other
11 than a basement area, is not considered a building's lowest floor, provided
12 that such enclosure is not built so as to render the structure in violat9on of
13 the applicable non-elevation design requirements of this ordinance found in
14 Section 5.2-1(2) .
15 �►�pyUFACTURED HOME° means a structure, transportable in one or more sec-
16 tions, which is built on a permanent chassis and is designed for use with or
17 W�thout a permanent foundation when connected to the required utilities. For
18 {7ood plan management purposes the term "manufactured home" also includes park
19 trailers, travel trailers, and other similar vehicles placed on a site for
20 reater than 180 consecutive da s. For insurance
g y purposes the term
21 "manufactured home" does not include park trailers, travel teailers, and other
22 similar vehicles.
23 °MANUFACTURED HOFIE PARK OR SUBDIVISION" means a parcel (or contiguous
24 parcels) of land divided into two or more manufactured home lots for rent or
25 sale.
26 °NEW CONSTRUCTION° meana structures for which the "start of construction"
27
commenced on or after the effective date. of this ordinance.
28
°START OF CONSTRUCiIOp° includes substantial improvement, and means the
29
date the building permit was issued, provided the actual start of construction,
30
repair, reconstruction, pTacement or other improvement was within 180, days of
31

1' the permit date. The actual start means either the first placement_,of perman-
2 ment construction of a structure on a site, such as the pouring of slab or
3 footings, the installation of piles, the construction of columns, or any work
4 beyond the stage of excavation; or the placement of a manufactured home on a
5 foundation. Permanent construct9on does not include land preparation, such as
6 clearing; grading and filling; nor does it include the insta7lation of streets
ry and/or walkways; nore does it include excavation for a basement, footings,
g piers, or foundation or the erect9on of temporary forms; nor does it include
g the installation on the property of accessory buildings, such as garages or
10 sheds not occupied as dwelling units or not part of the main structure.
11 °STRUCTURE° means a walled and roofed building including a gas or liquid
lg storage tank that is principally above ground.
13 °SUBSTANTIAL IMPROVEMENT° means any repair, reconstruction, or improve-
14 ment of a structure, the cost of which equals or exceeds 50 percent of the
15 market value of the structure either:
16 (1) before the improvement or repair is started, or
17 (2) if the structure has been damaged and is being restored,
before the damage occurred. For the purposes of t6is
18 definition "substantial improvement° is considered to
occur when the first alterat9on of any wall, ceiling,
19 floor, or othec structural part of the building commen-
ces, whether or not that alteration affects the external
2� dimensions of the structure.
21 The term does not, however, include either:
22 (1) any project for improvement of a structure to comply
23 with existing state or local health, sanitary, or safety
code specifications which are solely necessary to assure
24 safe living conditions, or
25 (2) any alteration of a structure listed on the National
Register of Historic Places or a State Inventory of
26 Historic Places.
27 °YARIANCE° means a grant of relief from the requirements of this
28 Ordinance wh9ch permits construction in a manner that would otherwise be pro-
29 hibited by this Ordinance.

1 SECTION 3.0
2 6EflERAL PROVISIONS
3 3.1 LAN�S TO WHICH TF1IS ORDIRANCE_ APPLIES
4 This Ordinance shall apply to all areas of special flood hazards within
5 the jurisdiction of the City of Auburn. (See Exhibit "A", attached hereto
6 and incorporated herein by reference, the State Flood Control Zone Map).
7 3.2 BASIS FOR ESTABLISHING THE AREAS .OF SPECIAL ROOD HAZARD
8 The areas of special flood hazard identified by the Federal Insurance
9 Administration in a scientific and engineering report entitled "The Flood
10 Insurance Study for the City of Auburn", dated June 1, 1981, with accom-
11 panying Flood Insurance Maps is hereby adopted by reference and declared
12 to be a part of this Ordinance. The flood Insurance Study is on file at
13 p5 West Main, Auburn, Washington 98001.
14 3.3 PENALTIES FOR NONCOMPLIANCE
15 No structure or land shall hereafter be constructed, located, extended,
16 converted, or altered without fu11 compliance with the terms of this
17 ordinance and other applicable requlations. Violation of the provisioris
18 of this ordinance by failure to comply with any of its requirements
19
(including violations of conditions and safeguards established in connec-
20 tion with conditions shall constitute a misdemeanor. � An

violates this ordinance or fai15 to comply with any of its requirements
22
shall upon convictions thereof be fined not more than Five Hundred
23 �
Dollars ($500.00) or imprisoned for not more than ninety (90) days, or
24
both, for each violation, and in addition shall pay a11 costs and expen-'
25
ses involved in the case. Nothing herein contained shall preverit the
26
City of Auburn from taking such other lawful action as is necessary to
27
prevent or remedy any violation.

1 3.4 ABR06ATION AND GREATER RESTRICTIONS
2 This Ordinance is not intended to repeal , abrogate, or impair any
3 existing easements, covenants, or deed restrictions. However„ where this
4 Ordinance and another ordinance, easement, covenant, or deed restriction
5' conflict or overlap, whichever imposes the more stringent restrictions
6 shall prevail .
7 3.5 INTERPRETATION
8 In the interpretation and application of this Oridnance, all provis3ons
9 sha11 be:
10 (1) Considered as minimum requirements;
11 (p) Liberally construed in favor of the governing body; and
12 (3) Deemed neither to limit or repeal any other powers granted under
state statutes .

14 3.6 WARNIN6 AND DISCLAIMER OF LIABILITT
T5 The degree of flood protection required by this Ordinance. is considered '
16 ' reasonable for regulatory purposes and is based on scientific and engi-
17 neering considerations. Large floods can and will occur on ra're occa-
18 sions. Flood heights may be increased by man-made or natural causes.
19 This Ordinance does not imply that land outside the areas of special
20 flood hazards or uses permitted within such areas will be free from
21 flooding or flood damages. 7his Ordinance shall not create liability on
22 the part of the City of Auburn, any. officer or employee thereof, or the
23 Federal Insurance Administration, for any flood damages that result from
2q reliance on this Ordinance or any administrative decis9on lawfully made
25 thereunder. ,
26 BECTION 4.0
27 A�NIINISTRATI ON
28 4.1 ESTABLISHMENT OF DEVELQPMENT PERMIT
29 A development permit shall be obtained before construction ar development
30 begins within any area of special flood hazard established in Section 3.2.
31 The permit shall be for all structures including manufactured homes, es set

l forth in the °DEFINITIOIQS°, and for all other development including fill
2 and other activities, also as set forth in the °DEFINITIONS°. Appli-
3 cation for a development permit shall be made on forms furnished by the
4 City of Auburn Building Department and may include, but not be limited
g to: plans in duplicate drawn to scale showing the nature, location,
g dimensions, and elevations of the area in question; existing or. proposed
7 structures, fill , storage of materials, drainage facilities; and the
g location of the foregoing. Specifically, the following information is
g required:
10 (1) Elevation in relation to mean sea level , of the lowest
floor (including basement) of all structures;
11
(2) Elevation in relation to mean sea level to which any
12 structure has been floodproofed;
13 (3) Certification by a registered professional engineer
that the floodproof9ng methods for any nonresidential
14 structure meet the flaodpnoofing criteria in Section
5.2-2; and
15
16 ' (4) Description of the extent to which any watercourse w191
be altered or relocated as a result of proposed develop-
ment.
17 .
Permitting procedures for Flood Control Zone Permits shall conform to
18 Section 3 of Auburn City Ordinance No. 4195 passed on December 15, 1986.
19 4.2 DESI6NATION OF THE CITY OF AUBURN EN6INEERIN6 DIVISION
20 The City of Auburn Engineering ,Division is hereby appointed to administer
21 and implement this Ordinance by granting or denying development penmit
applications in accordance with its provisions. ,
22 4.3 DUTIES AND RESPONSIBILITIES OF THE CIT1' OF AUBURI9 EN6INEERIN6 DIVISION
23 Duties of the City of Auburn Engineering Division shall include, but not
2� be limited to:
25 4.3-1 Permit Review
26 (1) Review of all development permits to determine that
the permit requirements of this Ordinance have been
27 satisfied.
28 (2) Review all development ,permits to determine that all
necessary permits have been obtained from those
29 federal , state or local governmental agencies from
which prior approval is required.
30
(3) Review all development permits to determine if the
31 proposed development is located in the floodway. If
located in the floodway, assure that the encroachment
32 provisions of Section 5.3(1) are met.

1 4.3-2 Use of Other Base Flood Data
2 When base flood elevation data has not been provided in accor-
3 dance with Sect9on 3.2, BASIS FOR ESTABIISHIw6 THE AREAS OF
4 ' SPECIAL ROOD HAZARD, the City of Auburn Engineering Division
5 shall obtain, review, and reasonably utilize any base flood
" 6 ele9ation and floodway data available from a federal , state
7 or other source, in order to administer Sections 5.2-1,
8 SPECIFIC STANDARDS, Residential Construction, 5.2-2 SPECIFIC
9 STANDARDS, Nonresidential Construction, and 5.3 FCOODWAYS.
10 4.3-3 Information to be Obtalned and Maintained
11 �1) Where base fl ood elevation data is provided through
the Flood Insurance Study or required as in Section
12 4.3-2, ob#ain and record the actual elevation (in
relation to mean sea level ) of the lowest habitable
13 floor (including basement) of all new or substan-
tially improved structures, and whether or not. the
14 structure contains a basement.
15 ' {2) For all new or substantially improved floodproofed
structures;
16
(i ) verify and record the actual elevation
T7 (in relation to mean sea level ), and
18 (ii ) maintain the floodproofing certifications
required in Section 4.1(3) .
19
(3) Maintain for public inspection all records pertaining
20 to the provisions of this Ordinance.
21 4.3-4 Alterat9on of Yatercourses
22 (1) Notify adjacent communities and the Department of
Ecology prior to, any alteration or relocation of a
23 watercourse, and submit evidence of such notification
to the Federal Insurance Administration.
24
(2) Require that maintenance is provided within the
25 altered or relocated portion of said watercourse so
that the flood carrying capacity is not diminished.

4.3-5 Interpretation of FIRM:Boundarles -

Make interpretations where needed, as, to exact location of_ , '

29 the boundaries of the areas of special flood. hazards (for
example, where there appears to be a conflict between a mapped

1 boundary and actual field conditions) . The person contesting
2 the location of the boundary shall tie given a reasonable
3 opportunity to appeal the interpretation as provided in
4 Section 4.4.
5 4.4 dARIANLE PROCEDURE
6 Yariance procedures, as stated herein, shall not apply to any
7 portion of the State Flood Control Zone No. 1 and No. 2. (The
8 City of Auburn is in State Flood Control Zone No. 2) .
9 SECTION 5.0
10 PROVISIORS FOR FLOOD HAZARD PROTECTION
11 5.1 6ENERAL STANDARDS
1 2 In all areas of special flood hazards the following standerds are
13 required:.
14 5.1-1 Mchoring
15
(1) A11 new construction and substantial improvements
16 sha11 be anchored to prevent flotat9on, collapse, or
lateral movement of the structure.
17
(2) All manufactured homes must likewise be anchored to
18 prevent flotation, collapse or lateral. mo4ement, and
shall be installed using methods and practices that .
19 minimize flood damage. Anchoring methods may
include, but are not limited to, use of over-the-top
20 or frame ties to ground anchors (Reference .FEMA's
"Manufactured Home Installation in F1ood Hazard
21 Areas° guidebook for additional techniques).
22 5.1-2 Construction Materials and Methods
23 (1) All new construction and substantial improvements
shall be constructed with materials and utility
24 equipment resistant to flood damage.
25 (2) All new construction and substantial improvements
sha11 be constructed using methods and practices that
26 minimize fl ood damage.
2ry (3) Electrical , heating, ventilation, plumbing, and air-
conditioning equipment and other service facilities
2g shall be designed. and/or otherwise elevated or
located so as to ,prevent water from entering or
2g accumulating within the components during conditions
of flooding.

1 5.1-3 Ut111ties
2 (1) All new and replacement water supply systems sha11 be
designed to minimize or eliminate infiltration of
3 flood waters into the system;
4 (2) New and replacement sanitary sewage systems shall be
designed to minimize or eliminate infiltration of
5 flood wate�s into the systems and discharge from the
systems into flood waters; and
6
(3) On-site waste disposal systems shall be located to
7 avoid impairment to them or contaminatlon from them
during fl ooding. •

5.1-4 5ubdivision Proposals
9
10 �1) All subdivision proposals shall be consistent with
the need to minimize flood damage;
11 (2) All subdivision proposals sha11 have public utilities
and facilities .such as sewer, gas, electrical , and
12 water systems located and constructed to minimize
flood damage;
13
14 �3) All subdivision proposals shall have adequate
drainage provided to reduce exposure to flood damage;
15 and,
16 �4) Where base flood elevation data has not been provided
or is not available from another authoritative
17 source, it shall be generated for subdivision propo-
sals and other proposed developments which contain at
18 least 50 lot or 5 acres (whichever is less) .
19 5.1-5 Review of Buildtng Permits
20 Where elevation data is not available either through the Flood
21 Insurance Study or from another authoritative source (Section 4.3-2) ,
22 Applications for building permits shall be reviewed to assure that pro-
2 3 posed construction will be reasonably safe from fl ooding. The test of
gg reasonableness is a Tocal judgment and includes use of histoeical data,
25 high water marks, photographs of past flaoding, etc. , where available.
26 Failure to elevate at least two feet above grade in these zones may
27 result in higher insurance rates. '
28 5.2 SPECIFIC STANUARDS
29 In a11 areas of special flood hazards where base flood elevation data
30 provided as set forth in Sect9on 3.2 BASIS FOR ESTABLISHIRG THE AREAS

l OF SPECIAI fL00D HAZARD or Section 4.3-2, Use of Other Base Flood
2 Data, the following provisions are requ9red;
3 5.2-1 Residential Construction
4 (1) New construction and substantial improvement of any residential
5 structure shall have the lowest floor, including basement, e1e-
6 vated to or above base flood elevation.
7 (2) Fully enclosed areas below the lowest floor that are subject to
8 flooding are prohibited, or shall be designed to automatically
9 equalize hydrostatic flood forces on exterior walls by
10 allowing for the entry and exit of floodwaters. Designs for
11 meeting this requirement must either be certified by a
12 registered professional engineer or architect or must meet or
13 exceed the following minimum criteria: �
14 (i) A minimum of two openings having-a tatal net area of
15 not less than one square inch for every square foot of
enclosed area subject to flooding shall be provided.
16 (i; ) The bottom of all openings shall be no higher than one
17 foot above grade.
18 (iii ) Openings may be equipped with screens, louvers, or other
coverings or devices provided that they permit the auto-
19 matic entry and exit of fToodwaters.
20 5.2-2 Nonresidentlal Construction
21 New constructlon and substantial improvement to any commercial ,
22 industrial or other nonresidential structure shall either have the
23 lowest floor, including basement, elevated to the level of the base
24 fl ood elevation; or, together with attendent utility and sanitary faci-
25 lities, shall :
26 (1) Be floodproofed so that below the base flood level
the structure is watertight with wa11s substantially
27 impermeable to the passage of water;
28 (2) have structural components capable of resisting
hydrostatic loads and effects of buoyancy; and,

l (3) be certified by a registerd profesisanal engineer or
architect that the design and methods of construction
2 are in accordance with accepted standards of practice
for meeting provisions of this subsection based on
3 their deVelopment and/or reView of the structural
design, specifications and plans. Such certifi-
4 cations sha]1 be provided to the official as set.
forth in Section 4.3-3(2) .

6 (4) Nonresidential structures that are elevated, not .
floodproofed, must meet the same standards for space
7 below the lowest floor.as described in' 5.2-1{2) , :
8 (5) Applicants fl oodproof9ng nonresidential bui}dings
sha11 be notified that fl aod insurance prerotums witl
be based on rates that are one foot beloa the ' �
9 floodproofed level (e.g. a building constructed to
10 the base flood 7eve1 will be rated as one foof beiow
that level) .
11 5.2-3 Manufactured Homes
12 All manufactured homes to be placed or substantially improved within
13 Zones A1-30, AH, and AE shall be elevated on a permanent foundation
14 such that the lowest fl oor of the manufactured home is at or atiove the
15 base flood elevation and be securely anchored to an adequately anchored
16 foundation system in accordance with the providions of subsection
17 5.1-1(2)

Located within areas of special flood hazard estabtished in Section 3.2
20
are areas designated as floodways. Since the floodway is an extremely
21
hazardous area due to the velocity of flood waters which carry debris,
22
potential projectiles, and erosion potential , the following provisions
23
apply:
24
(1) Prohibit encroachments, including fill , new construc-
25 tion, substantial improvements, and other develop-
ment unless certification by a registered pro-
26 fessional engineer .is provided demonstrating that
encroachments shal] not result in any increase in
2ry flood levels during the occurrence of the base flood
discharge.

(2) If Section 5.3(1) is satisfied, all new construction
29 and substantial improvements shall comply with all
applicable flood hazard reduction provisions of
, 30 Section 5.0 PROVISIONS FOR FLOOD HAZARD REDUC7ION.

an existing mobile home park or existing mobile home

Section 3. The Mayar is hereby authorized to implement such

administrative procedures as may be necessary to carry out the directions of

this legislation.

Section 4. This Ordinance sha11 take effect and be in force five (5) days

from and after its passage, approyal and pu6lication, as provided by law..
