3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
A CONDITIONAL USE PERMIT TO ALLAW A NURSING HOME TO BE
4 SITUATED IN A C-3 (HEAVY CObIl�fERCIAL) ZONE AND LOCATED ON THE
WEST SIDE OF "I" STREET N.E. IN THE 2800-2900 BLOCKS, WITHIN
5 THE CITY OF AUBURN, WASHINGTON.
6 WHEREAS, Application No. CUP0009-90 dated Septembe= 28,
� 1990, together with site plans therefore, has been submitted
8 to the City of Auburn, Washington, by MARK and ANDY CHAVERS
9 requesting a Conditional Use Permit to allow a nursing home to
10 be situated in a C-3 (Heavy Commercial) zone and located on
� 11 the west side of "I" Street N. E. in the 2800-2900 blocks,
� 12 within the City of Auburn, Washington, hereinafter described
� 13 in Section 2 of the Ordinance; and

� WHEREAS, said request above referred to, was referred to
15 the Hearinq Examiner for study and public hearinq thereon; and
16 {�EREAS, the Hearing Examiner, based upon staff review,
17 held a public hearing to consider said petition in the Council
18 Chambers of the Auburn City Hall, on January 22, 1991, at the
19 conclusion of which the Hearinq Examiner recommended the
Z� approval of the issuance of a Conditional Use Permit to allow
21 a nursing home to be situated in a C-3 (Heavy Commercial) zone
22 and located on the west side of "I" Street N. E. in the 2800-

2 2900 blocks, based upon the following Findings of Fact and
3 Conclusions, to-wit: .

5 FINDINGS OF FACT
6 1. The applicants, March and Andy Chavere, applied for a
7 Conditional Use Permit to allow a nursing home to be
situated in a C-3 (Eieavy Commercial) zone.
8 2. The subject property is located on the west side of "I"
9 Street N.E. in the 2800-2900 blocks and is currently
vacant. It is zoned C-3, heavy commercial, and the
10 Comprehensive Plan designates the subject site for heavy
commercial uses.
11 3. Existing zoning and land uses in the vicinity include C-
O% 12 3, parking, to the north; C-3, vacant, to the south; R-4,
0 riursincj home, to the east; and C-3, commercial, to the
west. The Comprehensive Plan suggests heavy commercial
O13 uses in all directions with the exception of to the east
C'7 14 which is desiqnated for high density residential uses.

p� 15 4. The applicant requests a Conditional Use Permit so that
an 87 ui►it, thiee story nursing home can be constructed.
16 The subject property is 2.52 acres in size.
1� 5. The proposal is for a total of 87 units. Of these units,
26 will be studios, 56 will be one bedroom, and 6 will be
1S two bedroom. The units will have s6me kitchen facilities
however a central dining facility will be piovided to
19 serve the residents.
20 6. Across the street from the subject proposal on the east
sicle of '-'I" Street N.E. there is an existing nursing home
21 which is owned by the proponents of this application.
The existing nursing home will provide for meal
22 preparation and other services for the proposed home.
Meals will be transported to the home and will be staged
23 within a holding kitchen of the proposed nursing home.

2 7. The site plan in addition illustrates two phases for
future construction. This conditional use permit will
3 allow only for the construction of the first 87 units.
The future phases will require additional enviiorimental
4 review and a further conditional use permit.
5 8. The Zoning Ordinance would require 34 parking spaces for
the proposed use and the site plan illustrates 52 parking
6 spaces.
7 9. The staff report, with its recommendation of conditional
approval, is incorporated herein by reference as though
8 set forth in full:

Q' 11 1. The Zoning Co3e sets forth a series of criteria which
0 must be established before a conditional use permit can
be granted. The first of these criteria is that the use
O12 as proposed will have no more of an adverse effect on
C�'7 13 health, safety, or comfort of persons living or working
p in the area than would any use .generally permitted in the
p� 14 district. The use will not have an adverse effect on the
a=ea since it is consistent with other nursing homes
15 across "I" Street N.E. The use is more compatible with
existing uses than would uses allowed outright within the
16 heavy commercial zone.
17 2 . The proposal is in accordance with the goals, policies,
and objectives of the Comprehensive Plan since it would
18 preclude a commercial strip development on this portion
of "I" Street. The use is also in character with the
19 remainder of "I" Street which is planned for primarily
residential uses.

3 . All of the other criteria required for a conditional use
Z1 permit have been established by this application. The
conditional use permit should be conditionally approved.

2 For each of the above referenced reasons, the
3 recommendation of the Hearing Examiner to the Ai�buin City
4 Council on this Conditional Use Permit to allow a nursing home
5 to be situated in a C-3 (Heavy Commercial) zone and located on

2 Section 3. This permit is issued for Phase I only.
3 Phase I must meet all the minimum site development standarde
4 as required for the phase.
5 Future phases will require additional conditional use
6 permits and environmental review.
� Bection 4. This facility shall be defined as a "nursing
$ home", pursuant to the Zoninq Ordinance, and shall meet all
9 applicable Zoning Code standards.
10 Beation 5. Upon the passage, approval and publication of
� 11 this Ordinance as provided by law, the City Clerk of the City
O 12 of Auburn shall cause this Ordinance to be recorded in the
p 13 office of the Ring County Auditor.
� Bection 6. The Mayor is hereby authorized to implement
� 14
15 such administrative prbcedures as may be necessary to carry
16 out the directions of this legislation.
17 Bection 7 . This Ordinance shall take effect and be in
18 force five days fiom and after its passage, approval and
19 publication as provided by law.
