AN ORDINANCE OF THE CITY OF AUBURN, WASHI.NGTON, PROVIDING FOR A CONDITIONAL
°'3 USE PERMIT ON PROPERTY ZONED R-3 LOCATED ON THE NORTHEAST CORNER OF "F"
AND 9TH STREETS S.E. AKA 816 "F" STREET S.E.,
4 WITHIN THE CITY OF AUBURN, WASHINGTON.

WHEREAS, petition dated October 17, 1983, together with plot plans and
6
exterior elevations therefor, has been submitted to the Council of the City of
7
Auburn, Washington, by MR. and MRS. CONSTANTINE MALESIS, requesting a
8
Conditional Use Permit on property ioned R-3 (Duplex) with a Conditional Use
9 ' . •
Permit, to enable Auburn Youth Resources to enlarge the present building for
10
new facilities, located at 816 "F" Street S.E., within the City of Auburn,
11
Washington, hereinafter described in Section 1 of this Ordinance, which pro-
12
13 perty presently carries a R-3 (Duplex) with a Conditional Use Permit
classification; and
14
WHEREAS, said request above referred to, was referred to the Planning
15
16 Corrunission by the Auburn City Council for study and public hearing thereon;
and
17
WHEREAS, the Planning Cormnission based upon staff review, held a public
18
19 hearing to consider said petition in the Council Chambers of the Auburn City
20 Hall , on November 8, 1983, at 7:30 P.M. , at the conclusion of whYCh the
' 21 Planning Coimnission recommended approval of the issuance of a Conditional Use
22 Permit on property zoned R-3 (Duplex) with a Conditional Use Permit, based
23
upon the following findings of the Department of Planning and Cortununity
24 Development; to-wit:
25 1. The proposal seeks an amendment to an existing valid conditional use permit
which would modify the previously approved site plan to permit a larger
26 building.
27 2. The proposal would add approximately 1078 sq. ft. to a previously approved
professional office. .
28 3. The proposal meets or exceeds the development standards of an R-3 zone, i.e.
29 set backs, lot coverage, landscaping, parking, etc.
30 4. The proposal is located near the co�mnercial uses on Auburn Way South. The
proposal would be compatible with those uses as well as act as a buffer to
31 the residential uses to the east.

1 5. The alley is an integral part of the required off-street parking and should
be paved.

6. "F" Street S.E. is not improved to City Standards.

WHEREAS, the City Council of the City of Auburn, held a public hearing in

the Council Chambers of the Auburn City Hall , at 8:00 P.M. on November 21,

1983, at which time the City Council concurred with the findings of the
6
Department of Planning and Community Development and the Planning Commission
7
as hereinabove stated; and

WHEREAS, the City Council has concluded that conditions must be applied to
9
the proposed use to insure that the proposed conditional use will have no more
lb
adverse effect on health, safety or comfort of persons living or working in
11
the area, and wi11 be no more injurious, economically or otherwise, to pro-
12
perty or improvements in the surrounding area, than would any use generally
13
permitted in the district. �- '

NOW, THEREFORE, THE CITY CAUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
15 ,
ORDAIN A5 FOLLOWS:

Section 1. That a .Conditional Use Permit on property zoned R-3 (Duplex)

with a Conditional Use Permit be granted for the purpose of enlarging the pre-
18
sent professional building, in accordance with the plot plans and exterior
19
' elevations for said development submitted with the request for a ,Conditional
20
Use Permit on property zoned R-3 (Duplex) with a Conditional Use Permit, a
21
copy of which is attached hereto, designated as Exhibit "A" and by this
22
reference made a part hereof as though set forth in full herein, located at
23
816 "F" Street S.E., situate in the City of Auburn, County of King, State of
24
Washington, and legally described as follows; to-wit:

Lots 28, 29, 30, Block 2, Walnut Lawn Addition, per plat recorded
26 in Vol 21 of Plats, pg 40, Records of King County, Washington
situated in Section 19, Twp 21 N, R 5 EWM City of Auburn, County of
27 King, State of Washington.
28 Section 2. That a new fire hydrant will be required to be within 150
29 feet of the proposal .

1 Section 3. That "F" Street S.E. wi:ll�-be required to be improved to half
2 street standards per Ordinance No. 3635 or a delay to be approved by the
3 Street Committee.
4 Section 4. That the alley shall be paved from the east edge of "F" St.
� 5 S.E. to the east property line of subject property.
6 Section 5. That a screening type fence shall be constructed along the
7 east property line.
8 Section 6. That the new parking areas shall �be constructed as to provide
9 for a 24-foot maneuvering area, the 16-foot alley may be used for a portion of
10 this requirement.
11 Section 7. That future expansions may be allowed as long as. the use i.s
12 for professional offices and all the development criteria of the R-3 zone are
13 met.
14 Section 8. That all required improvements shall comply with the require-
15 ments of the City of Auburn Storm Drainage Ordinance.
16 Section 9. That the Conditional Use Permit shall be void if the use is
17 not established within one year from the date of this Ordinance:
18 Section 10. Amendments to the site plan which do not increase the inten-
19 sity of the activities, alter the purpose of the conditional use permit, or
20 modify the relationship of the use to adjacent properties, may be approved by
21 the City Council .
22 Sect.ion 11. That the Legal Department for the GiEy of Auburn is hereby
2 3 authorized to file a certified copy of this ordinance with the King County
24 Assessor.
25 Section 12. The Mayor is hereby authorized to implement such
26 administrative procedures as may be necessary to carry out the directions of
27 this legiSlation.
