HomeMy WebLinkAbout1846 • • ORDINANCE NO. 1846 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTIONS 9.04.020, 9.04.320, 9.04.430, 9.15.010, 9. 18.020, 9.22.010, 9.22.060, 9.22.080, 9.22.090, 9.22.120, 9.22.140, 9.22. 160, 9.22.220, 9.22.230, 9.22.240, 9.22.250, AND 9.26.020 OF THE AUBURN CITY CODE, AND REPEALING SECTIONS 9.04.230, 9. 12.010, 9.12.020, 9.12.030, 9.22.280, AND 9.22.290 OF THE AUBURN CITY CODE, SAID SECTIONS OF THE AUBURN CITY CODE AMENDED AND RE- PEALED RELATING TO CERTAIN TRAFFIC AND PARKING REGULATIONS OF THE CITY OF AUBURN AND THE ENFORCEMENT THEREOF. THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That Section 9.04.020 of the Auburn City Code be amended, so that, as amended, said section shall read as follows: "204.020 Vehicles, Traffic, Etc. _Defined. (A) Right-0E-way, The right of one vehicle or pedestrian to proceed in a lawful-manner in preference to another vehicle or pe- destrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other. (Ei) Stop. When required, means complete cessation of move- ment. (C) Stop or Stopping. When prohibited means any halting even momentarily of a vehicle, whether occupied or not, except when nec- essary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control sign or signal . (D) Stand or Standing. Means the halting of a vehicle, whether occupied or not, otherwise than for the purpose of and while actually engaged in receiving or discharging passengers. (E) Park or Parking. Means the standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. (F) Official time standard. Whenever certain hours are named herein, they shall mean standard time or daylight-saving time as may be in current use in this city. (G) Police Officer. Every officer of the municipal police department of the City of Auhurn or any officer authorized to direct or regulate traffic or to make arrests for violations of the traffic regulations of the City of Auburn. (H) Curb Loading Zone. A space adjacent to a curb re- served for the exclusive use of vehicles during the loading or unloading of passengers or materials. ( I ) Passenger Curb Loading Zone. A place adjacent to a curb reserved for the exclusive use of vehicles during the load- ing or unloading of passengers. (.l) Freight Curb Loading Zone. A space adjacent to a curb for the exclusive use of vehicles during the loading or unload- ing of freight ." Page One • Section 2, That. Section 9.04.320 of the Auburn City Code be amended, so that, as amended, said Section shall read as follows: "9.04.320 Traffic Regulations Applicable During Processions And Parades. (a) It shall be unlawful for any pedestrian, equestrian, driver or operator of a vehicle, except authorized emergency vehicles, to pass through, or drive between the vehicles comprising, or inter- rupt, any regularly ordered funeral procession, or any procession authorized by permit of the Chief of Police as herein provided. This provision shall not apply at intersections where traffic is controlled by traffic-control signals unless a police officer is present at such intersections to direct traffic so as to preserve the continuity of the procession or parade. • (b) No person shall leave any vehicle upon any street which is being or has been cleared for parade purposes. All persons, except those participating in parades, shall keep off the streets temporarily closed for parades," Section 3. That Section 9.04,430 of the Auburn City Code be amended, so that, as amended, said section shall read as follows: "9,04.430 Pedestrian's duties. (a) Pedestrians shall not step into that portion of the street open to moving traffic at any point between intersections in the Central Business District, in any business district, on any arterial highway, or between adjacent intersections of streets protected by stop signs, except, at marked crosswalks or other places specially provided. (b) Pedestrians shall not cross street intersections diagonally except at such signalized intersections that provide For a pe- destrian all-walk phase. (c) Pedestrians crossing a roadway other than at marked cross- walks shall yield the right-of-way to all vehicles upon the roadway." Section 4. That Section 9. 13.010 of the Auburn City Code he amended, so that, as amended, said section shall read as fol lows : "9.16.010 One wa.y alleys - designated. Upon those alleys hereinafter described vehicular traffic shall move only in the indicated direction when signs indicating the direction of traf- fic are erected and maintained at every intersection where move- ment in the opposite direction is prohibited, and a vehicle pass- ing around a rotary traffic island shall he driven only to the right of such island: (a) From "B" Street Northwest to "C" Street Northeast on the alley immediately north of Main Street, in an easterly direction. (b) On the alley immediately south of Main Street running in an easterly and westerly direction, and between "B" Street Southwest and "C" Street Southeast, in a westerly direction." Page Two Section 5. That Section 9.18.020 of the Auburn City Code be amended, so that, as amended, said Section shall read as follows: "9.13.020 Duty to stop when directed by school police officer - penalties for violation thereof. No driver of any vehicle shall fail to stop his vehicle when directed to do so by any school police officer, and shall not again place such vehicle in motion until directed to do so by such officer. Any person who shall violate or fail to comply with any of the provisions of this chapter, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine in any sum not to exceed three hundred dollars." Section 6. That Section 9.22.010 of the Auburn City Code be amended, so that, as amended, said Section shall read as follows: "9.22.010 Definition of terms. (a) The definition of words and phrases contained in RCW 46.04.010 through 46.04.680, except 4.04.440 and 46.04.070, heretofore adopted by reference in Chapter 9.02.020 of the Auburn City Code shal I , For the purpose of this chapter, have the same meanings ascribed to said words and phrases therein. (b) The following words and phrases, when used in this chapter shalI, for the purpose of this chapter have the mean- ings respectively ascribed to them in this Section, unless where used the context thereof shall clearly indicate to the contrary: (1) COMMERCIAL LOADING ZONE: A designated portion of the street along the curb reserved For use in loading and unloading commodities, merchandise, produce, Fre ight or animals by com- mercial vehicles only. (2) INDIVIDUAL PARKING SPACE: A portion of the paved section of the street, of sufficient length and depth from the sidewalk curb to accomodate a vehicle to he parked, as shalI be specified and marked off by the Street Divirs'i•on: : of the City of Auburn. (3) NON-METERED PARKING ZONES: Non-metered parking zones shat I mean port ions of streets described and established by the City Council as zones within which the parking of vehicles shall he control led, regulated and inspected by the park ing enforcement personnel of the City of Auburn. (4) PARKING: The standing of a vehicle upon a street, whether such vehicle is occupied or not, and whether such ve- hicle be accompanied or not, by an operator, for a period of time in excess of two minutes. (5) PASSENGER LOAD ING ZONE: A designated portion of the street along the curb reserved for use in loading and unloading passengers by passenger vehicles only. (6) STREET: Shall mean and include streets, avenues, ways, boulevards, drives, highways, and all places, except alleys, open to the public for the use of vehicles." Sect ion 7. That Sect ion 9.22.060 of the Auburn City Code be amended, so that, as amended, said section shall read as follows: "9.22.060 Truck parking in residential districts prohibited. No vehicle exceeding in width seven and one-half feet, or exceed- Page Three • ing in length twenty feet, shall be parked on any street in any residential districts in the City of Auburn, for a period exceed- ing one hour continuous time, except for the expeditious loading or unloading of articles and materials." Section 8. That Section 9.22.080 of the Auburn City Code be amended, so that, as amended, said section shall read as follows: "9.22.080 Parallel parking required--Exceptions. (a) All vehicles within the City of Auburn shall park parallel as here- in defined, except as follows: On the west side of "B" Street N. E. from Main Street to First Street N. E.; "E" Street S. W. - • east side between West Main Street and First Street S. W. : "F" Street S. W. - West side between West Main Street and first alley south of West Main Street, and on all other streets and highways where angle parking shall be indicated by white lines drawn on the pavement or signs posted at the curb all vehicles shall park on an angle as herein defined. (b) In any place where parallel parking is permitted or required it shall be unlawful to park a vehicle with the right wheels of said vehicle, or either of them more than one foot from the curb nearest said vehicle. In any place where angle parking is permitted or required, it shall be unlawful to angle park a vehicle otherwise than with the right front wheel abutting against and touching the curb immediately in front of such ve- hicle where there is such a curb. (c) In all other streets and highways vehicles shall park as herein defined unless angle parking shall he indicated by white I ines drawn on the pavement or signs posted, at the curb. Angle parking shall not be permitted upon the streets designated as forming a part of the route of a primary state highway. (d) On all streets, and highways where angle parking is designated by I i nes drawn on the pavement or curbs, al ve- hicles shall be angle parked in such a manner that the entire portion of such vehicles shall be located within the stall or parking space designated by such lines." Section 9.L, That Section 9.22,090 of the Auburn City Code be amended, so that, as amended, said section shall read as follows: "9_22.090 Parking restrictions. (a) It shall be unlawful for any person to stop, park or angle park any vehicle upon a street in such a manner or under such conditions as to leave available less than ten feet of the width of the roadway For free movement of vehicular traffic, except temporarily during the actual loading or unloading of passengers, or when necessary to avoid traffic conflict or in obedience to traffic regulations or traffic signs or signals or a police officer. (b) When, under the provisions of this chapter, it shall be lawful to park in an alley, it shall be unlawful for any per- son to stop or park in such alley any non commercial vehicle, except loading or unloading purposes, for periods in excess of five minutes, unless written permit first be secured from the Chief of Police. Commercial vehicles may stop or park in such restricted areas for loading or unloading purposes only. (d) On portions of the street where angle parking is al- lowed, it shall be unlawful to angle park a vehicle the length Page Four • • • of which exceeds twenty feet over all . (e) It shall be unlawful to park or angle park a vehicle on more than one side of any street or avenue on which the width of the pavement is twenty-five Feet or less between the curbs. (f) It shall be unlawful to park or angle park a vehicle on either side of a roadway twenty Feet or less in width. (g) On portions of street contiguous to a block in which is located a public or private school , it shall he unlawful to park or angle park a vehicle where so indicated by signs." Section 10. That Section 9.22. 120 of the Auburn City Code he amended, so that, as amended, said section shall read as follows: "9.22. 120 Authority of council--Additional parki2 regula- tions. The City Council may, by ordinance or resolution, adopt additional regulations as to parking, angle parking, and may, by ordinance, alter or amend the provisions of this chapter." Section 11. That Section 9.22. 140 of the Auburn City Code be amended, so that, as amended, said section shall read as follows : Or "9.22.140 Prohibited parking places. (a) It shall be unlaw- ul for the operator of a vehicle to stop, stand, park or angle � I park such vehicle in or on any of the following places except when ✓ necessary to avoid conflict with other traffic or to comply with ����� other provisions of this code or with the direction of a police officer or traffic control sign or signal : (1) Within an intersection. (2) On a crosswalk. (3) Between a safety zone and the adjacent curb or within twenty-Five Feet of points on the curb immediately opposite the end of a safety zone, unless some other distance is indi- cated by a sign as herein authorized. (4) Within twenty Feet of a crosswalk or of the intersec- tion of property lines at street intersections . (5) Within thirty Feet upon the approach to any flashing beacon, stop sign, traffic control signal , or traffic de- vices located at the site of the roadway. (0) In front of, or within Fifty feet of the driveway en- trance to any fire or police station or within any marked area contiguous to such driveway, when properly signposted. (7) In front of or within fifteen feet of a Fire hydrant. (8) In front of a publ ic or private driveway, or within five feet to the end of the curb radius leading thereto. (9) On a sidewalk or parking strip. (10) Alongside or opposite any street excavation or obstruc- tion when such stopping, parking or angle parking would ob- struct traffic. Page Five • (11) In any alley; except that trucks or properly marked vehicles may park or angle park in alleys for such time, not in excess of thirty minutes, as may he necessary for the expeditious loading or unloading of such vehicles or the delivery or pickup of articles or materials. (12) Upon any bridge, overpass, underpass, trestle, or approaches thereto. (13) Within any space marked as a Fire exit . (14) On that portion of any street contiguous to and oppo- site any outside court, corridor, passage, fire escape, exit or entrance door or any other place adjacent to, or any door open- ing in any outer wall of any building containing, in whole or in part, any theatre, public auditorium, church, dance hall or other place of public assembly through which the publ ic must pass to leave such building, while such building is being utilized for public gatherings. And it shall be incumbent upon, and the duty of the owner or agent of the property used for the purpose here- in specified to designate such prohibited areas by the placement of stanchions or signs or curb markings of the form and type satis- factory to the City Engineer of the City of Auburn. (15) On the roadway side of any vehicle stopped or parked at the edge or curb of a street. (16) At any place where official traffic signs have been erected prohibiting parking and/or angle parking. (17) Outside of the limits of the individual parking spaces (stalls) designated for vehicular non-metered on-street parking by the Street Division of the City of Auburn. (IS) So that the left side of such vehicle, iF parked par- �t alley, or the front left wheel , if angle parked, shall be next +10" , ,A.(' to the curb. LIOV (19) Within thirty feet of the nearest rail of a railroad Crossing. (20) At any place where all official signs prohibit stop- ping. (b). No person shall niove a vehicle not owned by him into any such prohibited area or away from a curb such distance as is unlawful ." Section 12. That Section 9,22.160 of the Auburn City Code be amended, so that, as amended, said section shall read as follows: "9.22.160 Identification of no parking_and_prohibited parking areas. The Street Supervisor shall paint the curb adjoining all no parking and prohibited parking areas yellow or shall post signs prohibiting parking on the curb adjoining no parking and prohibited parking areas in order to identify such restricted zones. It shall be unlawful for any other person to paint the curbs or post no park- ing signs in such restricted zones unless said person shall he given authority to do so by the City Council ." Section 13. That Section 9.22.220 of the Auburn City Code be amended, so that as amended, said section shall read as follows: "PARKING ENFORCEMENT PERSONNEL 9,22.220 Parking Enforcement Personnel--Employment. The • Page Six city treasurer of the City of Auburn is authorized and empowered to employ personnel of suitable age, physical condition and qualifications in said treasurer's discretion, to enforce the provisions of the traffic ordinances of the City of Auburn per- taining to nonmoving traffic violations in the nonmetered parking • zones thereof, concurrently with the police department of the city." Section 14. That Section 9.22.230 of the Auburn City Code be amended, so that, as amended, said section shall read as follows: "9.22.230 Parking enforcement personnel--Deputized. Such • personnel shall be deputized by the City of Auburn to issue ci- tations pertaining to nonmoving traffic violations in the non- metered parking zones of the city only, and for no other purposes." Section 15. That Section 9.22.240 of the Auburn City Code be amended, so that, as amended, said section shall read as Follows: "9.22.240 Parking enforcement personnel --Supervision_ Said personnel shall be considered as employees' of the city treasurer's office, and shall be under the direction, supervision and con- trol of the city treasurer, and shall not be a member or a part of the police department of the City of Auburn." Section 16. That Section 9.22.250 of the Auburn City Code be amended, so that, as amended, said section shall read as follows: "9.22.250 Identification of commercial and passenger loading zones. The street supervisor shall paint the curbs adjoining all commercial and passenger loading zones white in order to identify such loading zones." Section 17. That Section 9.26.020 of the Auburn City Code be amended, so that, as amended, said section shall read as follows : "L26.020 Designation of spaces--Compliance . The Street Supervisor shall place lines or marks within the municipal off- street parking facilities operated by the City of Auburn to des- ignate the parking spaces to be utilized by vehicles therein, and all vehicles utilizing said facilities shall park within the lines or markings so established. It shall be unlawful to park any vehicle across any such line or mark or to park said vehicle in such a way that the seine shall not be within the area so des- ignated by such lines or marking." Section 18. That Sections 9.04.230, 9.12.010, 9. 12.020, 9.12.030, 9.22.280, and 9.22.290 of the Auburn City Code be and the same are hereby repealed. Section 19. That this ordinance shall take effect Five (5) days From and after its passage, approval and publication, as provided by law.
