ORDINANCE NO. 2639
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, GRANTING A SPECIAL PERMIT FOR THE USE
OF CERTAIN PROPERTY LOCATED WEST OF THE WEST VALLEY HIGHWAY NEAR 15TH STREET S.W.
SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, FOR GRAVEL REMOVAL
PURPOSES PURSUANT TO CHAPTER 11.16.220 OF THE AUBURN CITY CODE, AS AMENDED.
WHEREAS, Petition 5-72, dated February 17, 1972, together with comprehensive gravel
removal and reclamation plan and other supporting documentation therefor has been sub~
mitted to the Council of the City of Auburn by MICHAEL R. MASTRO and JOAN K. MASTRO, his
wife, JOE M. FEIST and MARY A. FEIST, his wife, MAX MONDSCHEIN and SUE MONDSCHEIN, his
wife, ALBERT P. TERRANA and GRACE TERRANA, his wife, and JOSEPHINE MICHILOTTI, a widow,
requesting a speciiif"permit for the rem~va1 of gravel' fro"m certain property owned by
petitioners hereinafter described in Section 1 of this Ordinance, which property presently
carries the zoning classification of A~l; and,
WHEREAS, said request above referred to was referred to the Planning Commission by
the City Council for study and public hearing thereon; and,
WHEREAS, the Planning Commission has held a public hearing to consider said petition
in the City Hall of the City of Auburn at 8:00 P.M. on March 7, 1972 and April 4, 1972,
at which time the public hearing was closed, and subsequent thereto the Planning Commission
has submitted its recommendations to the City Council, approving the issuance of the
Special Permit, subject to certain conditions and restrictions more particularly set forth
hereinafter; and,
WHEREAS, the City Council of the City of Auburn, Washington, held a public hearing
to consider said petition in the City Hall of the City of Auburn at 8:00 P.M. on May 1,
1972, at the conclusion of which the City Council concurred with the recommendations of
the Planning Commission, subject to certain conditions and restrictions applicable to
the issuance of the Special Use Permit, all as hereinafter set forth:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS
FOLLOWS: '
Section 1. That a Special Permit be granted for gravel removal on the following
described property, located West of the West Valley Highway near 15th Street S.W. within
the corporate limits of the City of Auburn, to-wit:
Parcel #1: That portion of the E 1/4 of the NW.1/4 of See 231 Twp 21 ~,
R 4 E W.M., described as follows: Beg at a pOlnt on the W 11ne of sald
subdi~ision where it is intersected by the N line of the S 16.5 acres of
the E 1/2 of the SE 1/4 of the NW 1/4 of said See 23; th N along the W line
of said E 1/4 of the NW 1/4, a distance of 400 ft.; th E to the E line of
said E 1/4 of the NW1/4; th S along said S 16.5 acres tract; th W along
said N line to the point of beginning.

Parcel #2: The N 250 ft. of that property described as: The S 16.5 acres
of the E 1/2 of the SE 1/4 of the NW 1/4 of See 23, Twp 21 N, R 4 E, W.M.,
LESS State Road #69, situate in the City of Auburn, County of King, State
of Washington.
Section 2. That the issuance of said permit shall be,contingent upon the compliance
by the petitioners and/or their assigns with the conditions and restrictions contained
in that certai nAgreement between the City ot' Auburn and sai d petiti oners, an executed
copy of which is attached hereto and denominated Exhibit "A".
Section 3. That the City Clerk of the City of Auburn is hereby authorized and
directed to file a certified copy of this Ordinance with the King County Auditor's office.
Section 4. 'That the amenament to the Comprehensive Zoning Map of the City of Auburn
encompassing the issuance' of this permit, which amendment is designated Exhibit "B"
hereof, be and the same is hereby' approved.
Section 5. That this Ordinance shall take effect five (5) days from and after its
passage, approval and pub 1 i cati on, as provi ded by 1 aw.: '
