HomeMy WebLinkAbout6660 ORDIfVANCE NO. 6 6 6_0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, APPROVING AN AREAWIDE REZONE FOR PROPERTIES ZONED ENVIRONMENTAL PARK TO LIGHT INDUSTRIAL WHEREAS, on August 7, 2006 the Auburn City Council approved Ordinance No. 6036 which created a new industrial designation called the Environmental Park (EP) zone; and WHEREAS, since the inception of this zoning designation there has been very little private sector investment into the privately owned properties within the EP zone; and WHEREAS, in contrast, there has been substantial investment in the nearby M-1 and M-2 industrial zoning designations; and WHEREAS, there are approximately 270 aeres of land zoned as EP, of which, 112 acres are comprised of the eity owned Auburn Environmental Park, and the remaining 158 acres held in private ownership; and WHEREAS, on December 14, 2015 the Auburn City Council approved Ordinance No. 6584 which amended the City's Cornprehensive Plan by removing the EP zone as one of the implementing industrial land use designations; and WHEREAS, staff introduced the area wide rezone proposal, under City file number ZOA17-0005, to the City's Planning Commission on August 8, 2017; and WHEREAS, the Planning Commission noticed and held a public hearing on the draft area wide rezone on September 6, 2017, Notice of the public Ordinance No. 6660 October 18, 2017 Page 1 of 4 hearing was provided to all affected property owners by direct mail and published in the August 17, 2017 Seattle Times; and 1NHEREAS, public testimony was provided during the public hearing in support of approving the area wide rezone. The City's Planning Commission deliberated on the matter and voted to ma.ke a recommendation to City Council to approve the area wide rezone; and WHEREAS, the Auburn City Council finds that a contributing factor to the success or failure of the EP Zone is at least partially based on the lack of incentives that were intended to be developed when the zone was created; and WHEREAS, while fhe lack of incentives should not further delay owners of EP Zoned property from realizing the level of economic opportunity shared by owners of the M-1 zone, it is City Council's continued intention to work towards developing incentives that will encourage activity and investment in#his portion of the City; and WHEREAS, City Council seeks to add policy and regulatory incentives as part of the staff prepared, and Planning Commission reviewed, 2018 Comprehensive Plan annual amendment cycle. NOW, THEREFORE, THE CITY GOUNCIL OF THE CITY OF AUBURN, HEREBY RESOLVES as follows: Section 1. Approval. The City Council ("Council") adopts and approves the rezone of approximately 158 acres of privately owned Environmental Park (EP) zoned land to Light Industrial (IVI-1) zoning. The property is identified in Exhibit"A" attached hereto and incorporate herein. Ordinance No. 6660 October 18, 2017 Page 2 of 4 Section 2. Direction and Implementation. The Council directs the Mayor to prioritize evaluation of the area of the former Environmental Park (EP) zone north of West Main Street with heavy emphasis on incentives The Mayor is also hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidify of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Section 4. Recording. Upon passage, approval and publication of this ordinance as provided by law, the City Clerk of the City of Auburn shall cause this ordinance to be recorded in the office of the King County Auditor. Section 5. Effective date. This ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
