HomeMy WebLinkAbout3021 ORDINANCE NO. 3 0 2 1 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF STREET RIGHT-OF-WAY SITUATE ON A PORTION OF "H" STREET NORTHWEST BETWEEN 6TH STREET NORTHWEST AND 15TH STREET NORTHWEST, SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN, WASHINGTON. WHEREAS, the City Council of the City of Auburn, have passed and adopted 'c Resolution No. 533, resolving that a public hearing shall be had for the purpose 0 of determining whether or not the hereinafter described street right-of-way situate ON on a portion of H Street Northwest between 6th Street Northwest and 15th Street I Northwest, within the corporate limits of the City of Auburn, shall be vacated, said portion to be vacated being hereinafter legally described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate the portion of a certain street right-of-way known as "H" Street Northwest between 6th Street Northwest and 15th Street Northwest, lying within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 533 was to be held on the 18th day of September, 1972, at 8:00 P.M. in the Council Chambers of the City Hall of the City of Auburn , Washington, no objections thereto were filed with the City Clerk or presented to the City Council at said hearing; and WHEREAS, the City Council , having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1 . That the following described portion of a certain street right- of-way situated on a portion of "H" Street Northwest between 6th Street Northwest and 15th Street Northwest, within the corporate limits of the City of Auburn, more particularly described as follows: Beginning at a point at the SW corner of the S 1/2 of the N 1/2 of the NW 1/4 of the NE 1/4 of Section 13, Township 21 North, Range 4 East W.M. ; thence along the South line of said land parcel 100 ft; thence North along the East 10-15-75 PaaP One • right-of-way line of the Milwaukee-Union Pacific Railroad 43.5 feet to the TPOB; thence continuing North along the East right-of-way line of the Milwaukee-Union Pacific Railroad to the South right-of-way of 15th St. N.W. ; thence East along the South right-of-way line of 15th St. S.W. 40.0 feet; thence South on a line parallel with said Railroad right-of-way to a point 43.5 feet North of the South line of the S 1/2 of the N 1/2 of the NW 1/4 of the NE 1/4 of Section 13, Township 21 North, Range 4 East W.M.; thence West 40.0 feet to the TPOB situate in the City of Auburn, County of King, State of Washington. be and the same is hereby vacated, and the property lying in said portion of a gitr certain street right-of-way described hereinabove, shall be returned and belong .43 to the abutting property owners, CHICAGO, MILWAUKEE, ST. PAUL & PACIFIC RAILWAY Cr CCD COMPANY and the MILWAUKEE LAND COMPANY, of said portion of a certain street right- Lo of-way situate on a portion of "H" Street Northwest between 6th Street Northwest and 15th Street Northwest, lying within the corporate limits of the City of Auburn. Section 2. That the reqeust for vacation of street right-of-way be granted subject to a public utility easement over, across , upon and underneath the entire vacated street for ingress and egress for the purpose of installing and maintaining all public utilities. Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor. Section 4. That this Ordinance shall take effect five (5) days from and after its passage, approval and publication, as provided by law.
