HomeMy WebLinkAbout392631 5 1 ORDINANCE NO. 3 9 2 6 2 N ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, ADDING 3 NEW SECTIONS TO TITLE 12 - STREETS, SIDEWALKS AND PUBLIC WORKS - OF THE CODIFIED ORDINANCES OF THE CITY OF AUBURN RELATING TO CONSTRUCTION 4 SIDEWALKS. 5 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: 6 Section 1. Definitions. Except where specifically defined in this sec - 7 8 ion, all words used in this ordinance shall carry their customary meaning. 9 A. "Contractor" means the person, firm or corporation doing or performing 10 work for the property owner, city or other municipal corporation. A 11. "bonded contractor" shall be adequately bonded to the city. 3-2 B. "Permittee" means the person, firm or corporation who is applying for 13 a permit or to whom a permit has been issued for sidewalk construction 14 pursuant to this ordinance. 15 16 C. "Property owner" means the person, firm.or corporation who has legal 17 title to the property on which the sidewalk to be constructed fronts or is being made, including his legal agents. 18 19 D. A "sidewalk" will be considered as any thoroughfare, the primary func- 2 0 tion of which is to serve pedestrian traffic. 21 22 Section 2. Specifications. Any and all sidewalks required to be onstructed pursuant to the terms in this ordinance shall be constructed in 23 24 accordance with the specifications that are incorporated by reference in 25 Section 12.04.010 of the Auburn Codified City Ordinances. 26 Section 3. Requirement generally. Whenever a sidewalk and/or driveway is 27 installed, it shall be installed in conformance with a valid permit issued 28 ursuant this ordinance, except as otherwise required under Auburn City rdinance No. 3635. 29 Section 4. Permit --Procedure generally. The party requesting the permit shall make application therefor in 2 writing and will file with the city engineer drawings showing the 3 location and plan of the P sidewalk to be constructed e together with a 4 � i full description of the nature of such work. The permit fee shall include the cost to the 1,5 city for making the necessary survoys and for the inspection of all public 16 improvements.,. The person, firm, or corporation constructing a 2 sidewalk pursuant to the terms of this article shall erect a d, so long as conditions exist and any danger may continue, maintain along the property upon 4 which the sidewalk is to be constructed a good and substantial barrier. This 5 barrier is to. -be in compliance with Chapter 12..28 of the Auburn Codified City 6 Ordinances. The above persons shall cause to be maintained during every night 7 from sunset to sunrise around the obstruction, sufficient warning light or flares, including any requested by the city engineer. In :the event the per- 9 mittee is not immediately available, the city engineer may install, at 1® permittee's expense, ad.ditional barricades,lights and/or safety devices.to 13. protect the p public_. Section 7.. Guarantee by contractor. Any sidewalk constructed under per - .13 mit authorized by'this ordinance shall be backfilled, tamped and settled in 14 such manner that: the new sidewalk and ,any abutting sidewalks shall not become 15 undermined, and should the sidewalk settle within a period of one year, it 1.6 shall be repaired at the expense of the original contractor. 17 Section 8. Monument dis.u.rbance during construction. The permittee shall 18 not disturb any survey monuments or hubs found within the boundaries of the 19 sidewalk to be constructed unless authorized to do so'by.the city engineer. 2p In the event that such monuments or hubs are to be removed be�ease ff the sidewalk construction, themust be replaced under the su ' 21 y erysi p p on of the 22 city,eng.ineer at the permittees or his agent's eXpense,. 23 Section :9 . Confinement .withri _ ht-of-wav limes and easement . It shall 24 be the-permittee's responsibility to confine his construction activities 25 within the ' street right-of-way lines and limits of . easements described on the 26 permit. Any damage resulting from trespassing beyond, these limits'shall be 27 the sole responsibility of the permittee. 28: Section 10. Acceptance prerequisites. No sidewalk improvement 29 constructed pursuant to the terms of this ordinance -will be accepted until the 30 city engineer` is satisfied that the work has been performed according to -the. i requirements of this ordinance and to the lin.esand grades as established and 2 staked. 3 Section 11.
