O0 ORDINANCE NO. 4 1 1 2 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR A CONDITIONAL USE PERMIT ON PROPERTY ZONED R-2 (SINGLE FAMILY) LOCATED AT THE SOUTHWEST CORNER OF 17TH AND "M" STREETS S.E., WITHIN THE CITY OF AUBURN, WASHINGTON. WHEREAS, a petition dated December 30, 1985, together with plot plans and exterior elevations therefor, has been submitted to the City of Auburn, Washington, by ROBERT F. KERR, M.D., requesting a Conditional Use Permit on property zoned R-2 (Single Family), to allow operation of a private, family practice physician's office, located at the southwest corner of 17th and "M" Streets S.E., within the City of Auburn, Washington, hereinafter described in Section I of this Ordinance, which property presently carries an R-2 (Single Family) classification; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on January 21, 1986, at 7:30 P.M.,at the conclusion of which the Hearing Examiner recommended approval of the issuance of a Conditional Use Permit on property zoned R-2 (Single Family), based upon the following Findings of Fact and Conclusions, to-wit: ® The applicant Robert F. Kerr, M.D., seeks a Conditional Use Permit to allow a family practice physicians office on a site located on the southwest corner of 17th and "M" Street S.E. The site is currently zoned R-2 and the existing land use is a single famil home. The Comprehensive Plan designates the subject site for commercial use, and existing zoning and land uses in the vicinity include C-3 and a service station to the north; R-2 and a single family residential uses to the south; C-3 and commercial uses to the east; R-2 and single family uses to the west. Medical or dental clinics are permitted in the R-2 zoning district if the requirements for a conditional use permit can be established pursuant to Chapter 18.70 of the Auburn Zoning Ordinance. One previous conditional use permit has been issued for a two-work station hair care service at this location, however, a previous request for a child care use was denied. 5. The proposal calls for the physician to see an average of 10-15 patients each day, five days a week, from 10:00 A.M. to 6:00 P.M. 6. The site is accessed by 17th and "M" Streets both of which are designated as arterials in the City's Comprehensive Plan. 7. The proposed use will generate approximately 18 trips per day. The site plan calls for installation of 13 parking stalls. There is a requirement for additional five feet of right of way on "M" Street S.E. and a five foot landscaping strip. Accordingly, to comply with these requirements, these parking spaces may have to be reduced. 9. Additional landscaping may be required to comply with Zoning Ordinance Section 18.56.030. 10. The staff report, submitted to the Hearing Examiner, containing the staff recommendation of this Conditional Use Permit, is incorporated herein by reference as though fully set forth. CONCLUSIONS Section 18.07.030 of the Auburn Zoning Ordinance sets forth the require- ments for a conditional use permit. The ordinance allows the issuance of a conditional use permit provided the use will have no more adverse affects upon the health, safety, or comfort of the persons living or working in the area and will be no more injurious, economically or other- wise, to property improvements in the surrounding area than would any use generally permitted in the district. Considerations include traffic flow and control, access and circulation within the property, and off-street parking and loading. The traffic to be generated by the proposal, particularly considering the hours of operation proposed from 10:00 A.M. to 6:00 P.M., will not adver- sely impact the traffic in the vicinity of the driveway at the front of the property is removed and the driveway at the rear of the property is widened to City standards. Adjacent residential properties in the vicinity will not be adversely affected by the additional parking on-site provided the parking is screened by a six foot high fence and landscaping. 4. The parking lot is located and configured so that turning movements will not occur close to the intersection. 5. The proposed use complies with the City's Comprehensive Land Use Plan. WHEREAS, the City Council of the City of Auburn, considered the con- ditional use permit at the regular council meeting in the Council Chambers of the Auburn City Hall, at 7:30 P.M. on February 3, 1986, at which time the City Council concurred with and adopted the Findings of Fact and Conclusions of the Hearing Examiner as hereinabove stated. Ordinance No. 4112 Page Two 2/10/86 1 3 4 § 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 For all of the above reasons, the recommendaton of the Hearing Examiner to the Auburn City Council on this Conditional Use Permit is approved, with the following conditions: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A Conditional Use Permit on property zoned R-2 (Single Family) be granted to allow operation of a private, family practice physician's office, in accordance with the plot plans for said development submitted with the request for a Conditional Use Permit on property zoned R-2 (Single Family), a copy of which is attached hereto, designated as Exhibit "A" and by this reference made a part hereof as though set forth in full herein, located at the southwest corner of 17th and "M" Streets S.E., situate in the City of Auburn, County of King, State of Washington, and legally described as follows, to-wit: Lot 10 in Rainier Vista, as per plat recorded in Volume 57 of Plats, on Page 26, Records of King County, State of Washington, situated in Section 19, Twp 21 N, R 5 EWM City of Auburn, County of King, State of Washington. Section 2. The above cited Hearing Examiner's Fi'ndings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 3. The property shall be screened at the west and south property lines by a continuous, wood, 6 foot high fence and landscaping planted in accordance with Section 18.56.030 of the Auburn Zoning Ordinance. Section 4. The required five feet of right of way along "M" Street S.E. and the right of way required to enlarge the radius, at the corner of "M" and 17th Streets S.E., to 30 feet shall be dedicated to the City. Section 5. The applicant shall submit an application for a street delay agreement with the City for future improvements to "M" Street S.E., as directed by the City Engineer. Section 6. The existing driveway on 17th Street S.E. shall be removed and replaced with curb and gutter constructed to City standards. This driveway and adjacent parking space shall not be used for parking or vehicular access to the property. The practice shall be limited to one physician practicing on- site at any one time. Section 8. The Legal Department for the City of Auburn is hereby authorized to record this Ordinance with the Records Section of the King County Records & Elections Division. Section 9. The Mayor is hereby authorized to implement such administra- tive procedures as may be necessary to carry out the directions of this legislation. Section 10. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided bylaw.
