HomeMy WebLinkAboutComcast Motion to Withdraw AuburnBefore the FEDERAL COMMUNICATIONS COMMISSION Washington, D.C. 20554 In the Matter of Comcast Cable ) Communications, LLC, on behalf of its ) Subsidiaries and affiliates ) CSR-7856-E For Determination of Effective Competition in: ) 9 Algona, Washington-Area Franchise Areas ) To: Chief, Media Bureau MOTION TO WITHDRAW AUBURN WASHINGTON FROM PETITION FOR SPECIAL RELIEF Comcast Cable Communications, LLC, on behalf of its subsidiaries and affiliates (together "Comcast" or the "Company"), by its attorneys, hereby moves to withdraw the Auburn, Washington Franchise Area (WA0096 and WA0829) from the Company's Petition for Special Relief seeking a determination of effective competition, filed on or about April 3, 2008 ("Petition") in the above-captioned proceeding. Comcast maintains its Petition for the remaining eight (8) franchise areas in the above-captioned proceeding.' Comcast seeks to withdraw Auburn to evaluate the impact of very recent annexations on the DBS penetration calcualtion for that community. Comcast withdraws Auburn from the Petition without prejudice and reserves the right to seek a determination of effective competition for Auburn in the future. Good cause exists for granting this request, as it will relieve the Bureau of reviewing this community in its consideration of Comcast's Petition. ' The remaining communities include Algona, Black Diamond, Covington, Des Moines, Enumclaw, Maple Valley, Pacific, and Tukwila Accordingly, Comcast respectfully requests that the Bureau grant the Company's motion to withdraw the Auburn Franchise Area from the Petition.
