Background Summary:
In February, 2004, the City of Auburn accepted the "10 percent Application for Annexation" from
Evergreen Tucci (aka Lakeland East, LCC) to start the annexation process on several parcels of Pierce
County property generally located east/southeast of the existing city limits in that area.
Based on that acceptance, City staff prepared and distributed the 60 percent annexation petitions to the
known property owners within the proposed annexation area. Property owners representing 84% of the
total assessed valuation signed the petition and returned them to the City. In October 2004 the Pierce
County Assessor -Treasurer declared the petitions were sufficient to meet the statutory requirements for
the 60% petition method of annexation. In February 2005, the cities of Auburn and Bonney Lake resolved
the issue involving a parcel that was located partially inside and partially outside of the City of Auburn's
PAA. That parcel is now entirely within the City's PAA. The proposed annexation is now ready to go
before the Pierce County Boundary Review Board.
City staff request the Council consider the proposed annexation and call for a public hearing. The subject
of the public hearing will be to authorize staff to submit the required "Notice of Intent" to the Pierce County
Boundary Review Board. The Boundary Review Board must take action within 45 days after the receipt
of the "Intent to Annex" unless they call for a formal hearing. In such cases, the Boundary Review Board
is required to approve, deny or modify the proposed annexation within 120 days.
Following the approval of the Boundary Review Board, the City Council will need to consider an
ordinance adopting the proposed annexation.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, ACCEPTING
THE SIXTY PERCENT PETITION TO ANNEX
CERTAIN PROPERTY LOCATED IN PIERCE
COUNTY ADJACENT TO THE CITY'S SOUTHERN
BOUNDARY AND SETTING A PUBLIC HEARING
THEREFOR
WHEREAS, the City of Auburn, Washington, has received an application
(ANX04-0002) to annex approximately 271 acres of land located in Pierce
County adjacent to the City's southern boundary; and
WHEREAS, at a regularly scheduled Council meeting on February 17,
2004, the City Council authorized City staff to prepare the necessary annexation
petition stating that said area, if annexed by the City of Auburn, will assume the
pro rata portion of the existing bonded indebtedness of the City of Auburn; and
WHEREAS, the City received petitions representing 84% of the assessed
valuation of the property lying within the limits of the proposed annexation area;
and
WHEREAS, on October 22, 2004, the Pierce County Assessor -Treasurer
declared that a sufficient number of petitions were received and verified to meet
the statutory requirements for a petition to annex; and
WHEREAS, on February 14, 2005, the cities of Auburn and Bonney Lake
resolved an issue involving a parcel that was located partially inside and partially
outside the City of Auburn's PAA so that it is now located entirely within Auburn's

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED DOES
HEREBY RESOLVE THAT:
Section 1. The City of Auburn hereby accepts the Sixty -percent Petition
for Annexation received in connection with the requested annexation and hereby
sets a Public Hearing for May 2, 2005, at 7:30 p.m., or as soon thereafter as the
matter may be heard, at the Auburn City Council Chambers, Auburn City Hall, 25
West Main Street, Auburn, Washington, for the City Council to hear all persons
wishing to speak to said annexation, and to consider its position with respect to
the annexation.
Section 2. The Mayor is hereby authorized to implement administrative
procedures necessary to carry out the directives of this legislation.
Section 3. This resolution shall be in full force and effect upon its
passage and signatures hereon.

City of Auburn, bears the names and purported signatures of persons who are .
owners or part owners of parcels lying within the proposed annexation and are
owners of 60% of the assessed value of the area proposed for annexation. The
undersigned cannot certify the authenticity of the signatures of such named
owners, because authenticated signatures of all such owners are not required to
be kept in the records of Pierce County for such real property.
