The meeting of the Auburn Hearing Examiner was held on April 17, 2001 at 7:00 p.m.

Ms. VanDerbeek called the meeting to order at 7:00 p.m. explaining the order of procedures and swore ~n
staff and those in the audience intending on testifying.
PUBLIC HEARINGS:
1. APPLICATION NO. MIS01-0001
Hearing Examiner opened the public hearing.
Assistant Planning Director Rued presented the staff report on the request of Kongkwan Kosaka
for a special home occupation permit to allow music lessons in her home located at 1503 - 58th
Way SE. Staff recommends approval with two conditions.
Hearing Examiner inquired if the homeowners association has any restrictions against the
request, and Assistant Planning Director Rued replied that the applicant spoke with the
association and they indicated approval.
The applicant was present and agreed with staff recommendations and the conditions. She -
contacted the homeowners association and they did not object to the proposal as long as it traffic
was not blocked.
There was no public testimony and the public hearing was closed. Hearing Examiner will issue
the written decision within 10 days. She indicated that the request will be approved.
2. APPLICATION NO. MIS01-0002
Hearing Examiner opened the public hearing.
Assistant Planning Director Rued presented the staff report on the request of Carol Lee for a
special home occupation permit to allow electrolysis services within her home located at 3605
Orchard Street SE. The request is considered to be similar to other personal service shops such
as a beauty shop. Staff recommends approval with two conditions.
Hearing Examiner acknowledged receipt of one unsigned comment letter. She asked Assistant
Planning Director Rued if there is adequate parking for clients and Assistant Planning Director
Rued indicated that parking is sufficient.
The applicant was present and indicated approval with the conditions.
There was no public testimony and the public hearing was closed. Hearing Examiner will issue
the written decision within 10 days. She indicated that the request will be approved.
Hearing Examiner combined items 3 and 4 for public hearing purposes.

APPLICATION NO. PLT00-0014
Request of Evergreen Tucci for preliminary plat approval of 103 single family lots and one
commercial tot. The plat is located north of Lake Tapps Parkway, east of Lakeland Hills Way.
APPLICATION NO. PUD01-0001
Request of Evergreen Tucci Partners to amend the Lakeland South PUD final development plan
map. The amendments include relocation of school sites, park sites, senior residential housing
and commercial sites. The amendments only include those properties, known as Lakeland South,
that are in Pierce County.
Hearing Examiner opened the public hearing.
Assistant Planning Director Rued presented the staff report for the PUD first. Using the overhead,
he pointed out what is being changed. The PUD was adopted by Pierce County a number of
years ago and the City has adopted what Pierce County approved. The City adopted the
Lakeland South zoning district. The amendments are considered to be minor compared to the
overall development and staff recommends approval.
Hearing Examiner asked if the park will remain the same size. Assistant Planning Director Rued
spoke about the pre-annexation agreement with the developer. He spoke about the park land the
City is acquiring. Park acreage will reflect population once area is developed. Hearing Examiner
inquired why the senior center site and the school site are being exchanged and Assistant
Planning Director Rued said the developer will answer this.
Assistant Planning Director Rued presented the staff report and pointed out location of the
preliminary plat. Auburn will provide sewer while the City of Bonney Lake provides water. The
City has an agreement with Bonney Lake. Auburn will provide fire protection. There is an
agreement pertaining to traffic. The preannexation agreement spells out building permit
thresholds and they are almost half way there. Lake Tapps Parkway will open later this year.
School impact fees are being collected for the school district. Parks are well covered in this
developed.. East of the property remains undeveloped and the owner is working with Pierce
County on a development. This area is within the City's Potential Annexation Area. Staff
recommends approval of the preliminary plat and amendments to the PUD.
Hearing Examiner asked about the number of units approved by Pierce County and Assistant
Planning Director Rued explained that the cap is being maintained.
Dennis Hanberg, Apex Engineering introduced himself and Chris Huss, counsel for
EvergreenFFucci. They support staff comments. The minor amendments reflect flexibility as time
goes on. The minor corrections are necessary because of physical constraints of the site. They
must work with topography, utilities, design criteria and marketing. The school district prefers the
other sites. The park facilities are advocated because of physical constraints, trail head and tie in
to other amenities. The other changes reflect minor corrections to the development. The
commercial area was out of place and needed to be consolidated with other commercial.
Regarding the preliminary plat, the commercial lot is to provide for a lot of record. He spoke about
deeding land to City for linear park.
Hearing Examiner asked if the commercial area wilt have a gas station and Mr. Hanberg said they
do not have any specific uses for the commercial area.

Tracy Bidoff, resident, asked if this means that the park on Viewridge 5 will not exist anymore. Mr.
Huss said the topography of the park is too steep and not usable and they want to develop a more
usable park to be located north of the community center with a trail. The level portion of the park
will be a trail head. They must wait and see if the park meets their PUD requirements otherwise
more park area will be developed. Some of the earlier identified park areas do not make sense
because of site topography.
There was no public testimony and the public hearing was closed. Hearing Examiner will issue
the written decision within 10 days.

With no further items to come before the Hearing Examiner, the meeting was adjourned at 7:50 p.m.
