HomeMy WebLinkAbout12-18-2001~'HEARING EXAMINER MINUTES DECEMBER 18, 2001 The meeting of the Auburn Hearing Examiner was held on December 18, 2001 at 7:00 p.m. in the Council Chambers of the Auburn City Hall. Those in attendance were as follows: HEARING EXAMINER: Diane L. VanDerbeek STAFF: Lynn Rued and Patti Zook Ms. VanDerbeek called the meeting to order at 7:00 p.m. explaining the order of procedures and swore in staff and those in the audience intending on testifying. PUBLIC HEARINGS: 1. APPLICATION NO. REZ01-0006 Hearing Examiner opened the public hearing. Assistant Planning Director Rued presented the staff report. Auburn Properties has requested to rezone two parcels. One parcel would be rezoned fi.om the existing R-3, Duplex to M-2,'Heavy Industrial. The other parcel would be rezoned fi.om the existing C-3, Heavy Commercial to M-2, Heavy Industrial. The property is located north of29~ Street SE and east ora Street SE. Last year City Council amended the Comprehensive Plan for these parcels. Staff recommend approval of the rezone with no conditions. J.B. Rupert, Rupert Engineering, represents the applicant and presented a brief history of the property. The site is owned by Utility Vault Company since 1968 and the property was fenced in 1976. The property is used for storage, but no buildings will be on the property. When purchased the property was zoned M-2 and the City rezoned the parcel in the 1980s, but the owners were unaware of the rezone. The owners discovered the rezone a few years ago and then sought the Comprehensive Plan map change which was approved by City Council. There was no public testimony; therefore, the public hearing was closed. Hearing Examiner will issue the written decision within 10 days. She indicated to the applicant that she will recommend approval of the rezone. 2. APPLICATION NO. REZ01-0007 Hearing Examiner opened the public hearing. Assistant Planning Director Rued presented the staff report. James Armstrong has requested to rezone property fi.om the existing C-3, Heavy Commercial to M-2, Heavy Industrial for property located at 2709 Auburn Way North. The property is split by two zoning classifications. The rezone is consistent with the Comprehensive Plan map. Staff recommends approval of the rezone with no conditions.. Mr. Armstrong was present, but did not testify. There was no public testimony; therefore, the public hearing was closed. Hearing Examiner will issue the written decision within 10 days. She indicated to the applicant that she will recommend approval of the rezone. APPLICATION NO. CUP01-0004 and VAR01-0005 Hearing Examiner opened the public hearing. Assistant Planning Director Rued presented the staffreport. St. John Investments has requested a conditional use permit that would allow for the existing group facility, located at ! 111 - 4* Street NE, to be converted into four- plex and duplex development. There would be a total of 12 residential dwelling units. A variance is also being requested that would allow for the existing buildings, that do not meet current zoning setbacks, to remain in their current location. The property was used historically as a 'group residence facility' and has been vacant a number of PAGE 1 HEARING EXAMINER MINUTES DECEMBER 18, 2001 years. The R3 zoning allows the use to continue. There have been some attempts to reoccupy the site as group residence. The maximum number of units allowed is 12 dwelling units. The site will be upgraded with new windows, roofs, siding, etc., enough improvements that may exceed the 50 percent valuation. He mentioned the setback requirements which necessitated the variance application. Granting the variance will allow improvements beyond the 50 percent valuation. Staff recommends approval ofthe conditional use permit and variance applications. He reviewed the conditions. . Hearing Examiner inquired when the buildings were constructedand Assistant Planning Director Rued replied in the early 1970s. Bob Zanoni, is the architect for the project, and agree with the staff conclusions. The required lot line adjustment is under review and stated that they will meet all requirements. Hearing Examiner asked Mr. Zanoni if he objected to any of the conditions and Mr. Zanoni replied no. Hearing Examiner asked what Mr. Zanoni plans to do with the vacant parcel located to the north and Mr. Zanoni said they are unsure and suggested it might be used for recreational parking for the residents. There was no public testimony; therefore, the public hearing was closed. Hearing Examiner will issue the written decision within 10 days. She indicated to the applicant that she will recommend approval of the rezone. 4. APPLICATION NO. PLT00-0004, PUD00-0001 and SHR00-0004 CamWest Development has requested approval of a preliminary plat and planned unit development of 118 single family detached on 20.92 acres. They also request a shorelines substantial development permit to allow the development of a stormwater infiltration pond and park space. The subject site is located in the 3200-3300 block of "I" Street NE (if extended). Assistant Planning Director Rued advised that these applications were scheduled for hearing tonight, but issues have not yet been resolved with the Traffic Division of Public Works. Hearing Examiner continued the hearing to the January 23, 2002 meeting at.7:00 pm.
