Regular meeting of the City Council of the City of Auburn held at 8:00 p. m. in the
Council Chambers at the City Hall.
The meeting was called to order by Mayor Gaines.
Councilmen present: Hoyt, Lea, Kline, Fitzsimmons, Calkins, Aaby and Sonnemann.
Minutes of the previous meeting held July 19, 1965, were approved as mailed. Minutes
of the special meeting held at 10 a, m. July 28, 1965, were approved as mailed with
the addition of the names of Lea, Sonnemann, Calkins, Aaby and Kline, councilmen
present at this meeting.
PUBLIC HEARINGS
The mayor declared the public hearing open on the petition of John Bocek requesting
rezoning from R-2 to R-5 on property located across from the Chinook School on the
Enumclaw Highway,
The Auburn Planning Commission recommended that this request be granted provided that
a 40 ft. buffer zone be retained on the south portion of the property. A letter from
the City Engineering Dept., signed by George A. Schuler, suggested this could be
best accomplished by changing the zoning classification on all but the south 40 feet.
It was moved by Calkins, seconded by Aaby, that the public hearing be closed.
MOTION CARRIED
It was moved by Calkins, seconded by Kline, that the Council concur with the
recommendation of the Planning Commission and Engineering Dept. and approve rezoning
from R-2 to R-5 on the property of John Bocek located across from the Chinook School
with the exception of the south 40 ft and that the City Attorney be instructed to
draw up the necessary ordinance to implement this action.
MOTION CARRIED
Mayor Gaines declared the public hearing open on the petition of R. I. Heinz to
rezone from R-3 to C-I property located on the SW corner of East Main and K Sts.
The Auburn Planning Commission recommended this request be granted.
There being no discussion, it was moved by Calkins, seconded by Sonnemann, that the
public hearing be closed.

It was moved by Sonnemann, seconded by Kline, that the Council approve the recommendation
of the Auburn Planning Commission to rezone from R-3 to C-1 the property of R. 1. Heinz
located on the SW corner of East Main and K Sts. and the city attorney be instructed
to draw up the necessary ordinance to implement this rezoning.
MOTION CARRIED
Mayor Gaines declared the public hearing open on the petition of William L. Snodgrass
to rezone from A-1 to M-1 property located on R St. NW at 30th. The Auburn Planning
Commission recommended that this request be granted.
There being no discussion, it was moved by Kline, seconded by Hoyt, that the public
hearing be closed.
MOTION CARRIED
It was moved by Calkins, seconded by Aaby that the Council concur with the recommendation
of the Auburn Planning Commission and approve the rezoning of the property of
William L. Snodgrass located on B St. NW at 30th from A-1 to M-1 and the city attorney
be instructed to draw up the necessary ordinance to implement this action.
MOTION CARRIED
Mayor Gaines declared the public hearing open on the request of Richard Huseby to
rezone from R-2 to R-4 property located at H and 18th St. SE. The Auburn Planning
Commission recommended this request be granted provided the easterly 30 feet be dedicated
for street right--of-way.
Huseby submitted a quit claim deed to the city for the 30 foot street right-of-way on
the east side of his property.
It was moved by Calkins, seconded by Hoyt, that the public hearing be closed.

It was moved by Sonnemann, seconded by Kline, that the Council concur with the
recommendation of the A. P. C. and approve the rezoning of the Richard Huseby
property located at H and 18th St. SE from R-2 to R-4; that the city attorney be
instructed to file the quit claim deed submitted by Huseby and that he draw up the
necessary ordinance to implement this rezoning.

Mayor Gaines declared the public hearing open on the request of Robert Hoyt to
rezone from R-2 to C-1 property located adjacent to the Rhododendron Motel on Auburn
Avenue. The A. P. C. recommended this request be granted provided that the
easterly 30 feet and northerly 20 feet be dedicated for street right-of-way.
Joe Klontz suggested the street dedication on the north should be 30 feet instead
of 20 to make a 50 foot street. The City Engineer stated the 50 foot width was
sufficient for the need of this particular street.
It was moved by Kline, seconded by Calkins, that the public hearing be closed.
MOTION CARRIED
It was moved by Fitzsimmons, seconded by Aaby, that the Council concur with the
recommendations of the A. P. C. and approve the rezone of the Robert Hoyt property
located on Auburn Avenue adjacent to the Rhododendron Motel from R-2 to C-1 and
that the city attorney be instructed to draw up the necessary ordinance to implement
this rezoning.
Roll Call Vote: All Councilmen voted yeas with the exception of Hoyt who abstained
from voting.

Mayor Gaines declared the public hearing open on the request of Willard Kee to rezone
from R-2 to R-5 property located at 2216 D St. SE. The A. P. C. recommended that
this request be denied because it would not conform to existing zoning in the area
and would be surrounded on three sides by R-2 residential zoning; also that a
petition signed by sixteen property owners in the area had opposed this request.
There being no discussion, it was moved by Kline, seconded by Hoyt, that the public
hearing be closed.
MOTION CARRIED
It was moved by Kline, seconded by Hoyt that the Council concur with the recommendation
of the Auburn Planning Commission and deny the petition of Willard Kee to rezone
from R-2 to R-5 r)rooerty located at 2216 D St. SE.

Mayor Gaines declared the public hearing open on the Petition of Commonwealth
Properties for vacation of Portion of the Corrected Plat of Sportsman's Paradise
Estates, Division No. 2.
City Engineer Hagestad and Alex Sonnicksen, engineer for Commonwealth, answered
questions of Jack Stinebaugh, property owner, regarding the proposed vacation.
It was moved by Calkins, seconded by Kline, that the public hearing be closed.
MOTION CARRIED
It was moved by Fitzsimmons, seconded by Sonnemann, that the Council approve the
request of Commonwealth Properties to vacate Portion of the Corrected Plat of
Sportsman's Paradise Estates, Division No. 2, and the city attorney be instructed
to draw up the necessary ordinance to implement this vacation.
MOTION CARRIED
Mayor Gaines declared the public hearing open on the request of Mack McEuen to rezone
from R-3 to R-4 property located at 1309 M St. SE. The A. P. C. recommended this
request be denied because of extensive neighborhood opposition to this rezoning.
Attorney Ingalls representing the McEuens outlined the use of property in the area
and presented reasons why the request should be granted.
Loren Hoganson presented a petition signed by eleven residents stating their objections
to the rezoning. Mrs. Phil Grey also spoke against the rezoning.
It was moved by Kline, seconded by Hoyt, that the public hearing be closed.

It was moved by Aaby, seconded by Lee, that the Council concur with the recommendation
of the Auburn Planning Commission and deny the request of Mack McEuen to rezone from
R-3 to R-4 property located at 1309 M St. SE.

Mayor Gaines declared the public hearing open on the proposed amendments to section
15, 17, 35 and 36 of the Zoning Ordinance.
There being no discussion, it was moved by Calkins, seconded by Hoyt, that the public
hearing be dosed.

It was moved by Sonnemann, seconded by Aaby, that the city attorney be instructed
to draw up the necessary ordinance to implement the proposed amendments to Sections
15, 17, 35 and 36 of the Zoning Ordinance.

The City Clerk read the results of bids opened at 3 p. m. July 29, 1965, for the
construction of storm sewer, grading, ballasting and two course bituminous surfacing
on 8th St. NE between Harvey road and R St. NE as follows:

CORRESPONDENCE
A letter from Dick Wooding requested an access easement from the city for property
adjacent to the city's water reservoir tank.
Mayor Gaines referred the request to the Water —Sewer Committee and the Engineering
Department.
A letter from Ctark, Coleman and Rupeiks outlined need for updating the Comprehensive
Plan of the city and recommended the 1966 budget include a minimum of $10,000 for
this purpose in order to qualify for the "701" Program, two third matching funds to
finance this project.
Letter was ordered filed with copy to George Schuler, Planning Director.
A letter from Pacific Northwest Bell Telephone Company enclosed easement agreement,
executed by their division engineer, for Council approval.
It was moved by Calkins, seconded by Aaby that the mayor and city clerk be authorized
to sign the easement.

A letter from the Park Commission submitted a Comprehensive Park Plan for the City
of Auburn from 1965 to 1980.
A letter from Robert Kuzmer submitted a proposal to lease the vacant property owned
by the city and located east of the sewage lagoon for airport purposes.
A letter from Hill and Ingman, Consulting Engineers for the City of Auburn stated they
had made a detailed inspection of the sewers in the Lea Hill Interceptor Sewer line
under construction by W. J. Schade & Sons and that 18 sections of pipe have not been
constructed in accordance with fhe contract plans and specifications. The letter
stated recent attempts to repair the defective sections by United Concrete Pipe Corp.
have not been satisfactory. It was the recommendation of Hill and ingman that the
City of Auburn reject the 18 sections listed and instruct the contractor, W. J. Schade
& Sons to reconstruct the unacceptable portions of the sewer lines to comply with the
original contract plans and specifications.
COUNCIL COMMITTEE REPORTS
Councilman Hoyt reported on Fire Committee meeting in which the 1966 budget was
discussed. Fire Chief Calkins and Councilman Sonnemann were to leave August 3rd to
pick up the new fire truck at the plant and drive it to Auburn.

It was moved by Lee, seconded by Sonnemann, that Heisserman Construction be awarded the
bid for construction of the storm sewer, grading, ballasting and two course bituminous
surfacing on 8th St. NE at the contract bid of $13,733.66 and that bid bonds be returned
to the unsuccessful bidders upon execution of the Heisserman contract with the city.

Councilman Fitzsimmons chairman of the Water -Sewer Committee moved with a seconded
by Kline that the request of Peckenpaugh Drug Co. to make water -sewer -garbage
collections at their store on East Main & M St. NE be granted subject to the
requirements of city ordinances.

Fitzsimmons asked for discussion on the Lea Hill Sewer line contract.
E. L. Wright, vice president of United Concrete Pipe Corporation and Rex Walker,
Seattle attorney for the company, reviewed their position and requested the Council
defer their decision on the engineer's recommendation for a period of one or two
weeks in order they have further time to try and remedy the defects.
Joe Schade, representing the contractors, concurred with this request.
William J. Chase of Hill and Ingman outlined the necessity for rubber joints in
the line. He stated that attempts to correct the defect had resulted in a rigid pipe
at the joints. He further said several weeks have elapsed in which the contractor
has not been able to satisfactorily remedy the defects; that time is essential and
that it would require 60 days additional time to reconstruct the line.
It was moved by Kline, seconded by Fitzsimmons, that a 15 minute recess be called to
allow for council consultation.

MOTION LOST
It was moved by Fitzsimmons, seconded by Lea that further action on the recommendation
of Hill and Ingman be tabled until August 16 at which time the contractor be instructed
to immediately start the removal of existing line and installation of new pipe unless
repairs sufficient in the opinion of the consulting engineers of the city to bring the
affected line in conformity with the existing contract specifications are presented by
the contractor, the two week delay to be contingent upon receipt of a letter from the
contractor assuming liquidated damages and costs attendant to the delay.
A 10 minute recess was declared to give the contractor and United Concrete Pipe
officials an opportunity to confer on this arrangment.
Mayor Gaines reconvened the meeting at 10:45 p. m.
The representatives of United Concrete Pipe were asked if they would start manufacturing
the pipe immediately in order that work would start at the expiration of the two weeks
if corrections were not acceptable to the engineers. Mr. Wright stated they could not
do this.
He also said he did not feel his company could meet the requirements of the motion.
The motion and second were then withdraw by Fitzsimmons and Lea respectively.
It was moved by Fitzsimmons, seconded by Aaby that the Council approve the recommendation
of Hill and Ingman to instruct the contractor to reconstruct the unacceptable portions
of the sewer line.

AUDIENCE
Al Rossi, chairman of the Auburn Park Commission, recommended that the Council approve
the Comprehensive Park Plan.
It was moved by Sonnemann, seconded by Lea, that the Council adopt the Comprehensive
Park Plan for the City of Auburn as submitted by the Park Commission. 1�

Mr. Lang_ representing Flood Control District explained the obligations of the city in
adopting the East Side Watershed agreement.
It was moved by Kline, seconded by Fitzsimmons that the agreement be approved and the
Mayor and city clerk be authorized to sign on behalf of the city.

It was moved by Sonnemann, seconded by Lea that Ordinance No. 1800 be taken off the
table.

It was moved by Lea, seconded by Sonnemann, that Ordinance No. 1800 entitled "AN
ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE SALE OF CERTAIN
SURPLUS MERCURY VAPOR TYPE STREET LIGHTING FIXTURES TOGETHER WITH THE RELATED EQUIPMENT,
OWNED BY THE CITY" be adopted.
Roll Call Vote: Hoyt, Fitzsimmons, Kline, NO; Sonnemann, Lea, Calkins, Aaby, YES.

It was moved by Sonnemann, seconded by Hoyt, that Ordinance No. 1807 entitled "AN
ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF CERTAIN
PROPERTY IN THE CITY OF AUBURN, CHANGING THE ZONING CLASSIFICATION THEREOF FROM A-1
TO M-1" be introduced and adopted.
Roll Call Vote: All Councilmen voted YES.

"A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND ACCEPTING THE CONSTRUCTION
OF THE AUBURN Y. M. C. A. BUILDING AND AUTHORIZING THE DELIVERY OF THE DEED OF
CONVEYANCE FOR SAID PROPERTY, PURSUANT TO ORDINANCE NO. 1400 OF THE CITY OF AUBURN:
be introduced and adopted.
Roll Call Vote: All Councilmen voted YES.

It was moved by Sonnemann, seconded by Calkins that Resolution No. 194 entitled
"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, RATIFYING THE
ACTION OF THE CITY OFFICIALS IN ACCEPTING THE BID OF JOHN NUVEEN & CO. (INC.) FOR
THE ISSUE OF $665,000.00 PAR VALUE OF "WATER AND SEWER REVENUE BONDS, 1965" OF THE
CITY: FIXING THE INTEREST RATE ON THOSE BONDS: AND PROVIDING FOR THE IMMEDIATE
PRINTING, EXECUTION, DELIVERY AND SALE OF THOSE BONDS" be introduced and adopted.

forward the record of the Northern Pacific easement to the company for recording.
