Flag Salute The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 8:00 p.m. in the City of Auburn Council Chambers. Mayor Roegner led those in atten- dance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner; Council - members Colburn, Craig, Hitchcock, Kurle, Larson, Lea and Wisner; and staff members Jack Bereiter, City Attorney; Len Chapman, Parks & Recreation Director; Dan Clements, Finance Director; Pat Dugan, Planning Director; Jim Gibson, Police Chief; Bob Johnson, Fire Chief; Coralee McConnehey, City Clerk; Pat Nevins, Public Works Director. Also in atten- dance was staff members Steve Lancaster and Gretel Sloan. C. Mayor's Announcements and Appointments Mayor Roegner introduced Gretel Sloan, the City's new Personnel Director. D. 41enda Modifications - Modifications included additional information on the Seafirst Mortgage Corp. Rezone, a request from Robert Stidham to appeal the Utility Committee's deci- sion on his water meter hookups, and two bid awards. CITIZEN INPUT PUBLIC HEARINGS & CORRESPONDENCE II. A. Public Hearings 1. Final Assessment Roll for L.I.D. 331 - Construction of street, storm, curb and gutter, sidewalk, sanitary sewer and water mains on 42nd Street N.W. from B Street N.W. to approximately 969 feet east. No one spoke for or against the assessment roll. MOTION by Hitchcock, SECOND by Colburn, to close the public hearing. MOTION CARRIED UNANIMOUSLY. MOTION by Craig, SECOND by Wisner, to instruct the City Attorney to draft an ordinance to approve the final assessment roll for L.I.D. 331. MOTION CARRIED UNANIMOUSLY. 2. Washington State Harness Club Conditional Use Permit for a harness race track and facilities on property zoned M-1 (Light Industrial) and M-2 (Heavy Industrial) located on the south side of 30th Street N.W. west of and adjacent to the Auburn Municipal Airport consisting of approximately 96 acres. (35-81) Steve Lancaster, Environmental Planner, reviewed the process which had preceded this hearing. He recommended continuing the public hearing to allow time for citizens to review the Environmental Impact Statement. J. A. Washington State Harness Club Conitional I t made statements opposing the Conditional Use Permit because of concerns over the element gambling might bring to Auburn, the noise and traffic problems. Frank Shaughnessy, owner of adjacent property, had questions on the impact of the development and wondered if the potential problems had been addressed in the EIS. Ron Thompson, attorney representing United Theaters, expressed concern over the lighting for the track and if the environmental impact statement had addressed the potential problem. Jim Going, President of Auburn Downs, introduced George Kresovich, attorney, who could answer questions. George Kresovich indicated they would be meeting with Mr. Thompson to work at alleviating their concerns. No one else spoke. MOTION by Hitchcock, SECOND by Colburn to continue the public until the next regular Council meeting of October 3, 1983. MOTION CARRIED UNANIMOUSLY. 3. R. Little, W. Donais and P. Burns Conditional Use Permit for a law office on property zoned R-2 (Single Family) and located on the northwest corner of "K" and loth Street N.E. (9-83) Richard Hagadorn, a local resident, expressed concern because this was the first intrusion into a single I family area. He also expressed concern over the traffic problem. Bill Donais, co -petitioner, noted the traffic revision would be made. He stated he felt the use as a law office would be an appropriate buffer. He noted they did object to the requirement of the half street on "K" Street N.E. but would have no objection to the 10 foot dedication. MOTION by Hitchcock, SECOND by Wisner, to close the public hearing. MOTION CARRIED UNANIMOUSLY. Members of the Council discussed their concerns over the intersection on loth and the possible need to block loth off. Lea suggested if the petioner signed an agreement to run with the land to participate in an L.I.D. on "K" it would in effect grant a delay. Craig also expressed concern this might be a beginning to eroding of the residential area since this was exactly on Harvey Road. He also felt this permit was not providing a solution to the intersection problem. Dugan indicated the area was zoned residential, however, they recognized the need for a buffer and each request was considered on its own merits. MOTION by Hitchcock, SECOND by Colbuurn, to approve the Conditional Use Permit and to instruct the City Attorney to prepare the necessary ordinance outlining the appli- cable Findings of Fact and the eight conditions of -2- AUBURN COUNCIL MINUTES PAGE THREE SEPTEMBER 19 1983 II. (Cont.) approval with an adjustment to Condition 7 requiring the petitioner to sign a statement of support related to a future L.I.D. Kurle and Craig voted NO. MOTION CARRIED. 4. Wayne Whitney Rezone from R-2 (Single Family) to M-1 (Light Industrial) property located on the west side of Western Street N.W. (22-83) The City Clerk read a letter into the record from Pauline Muttart opposing the rezone because of drainage problems. Rodger Campbell, Ken Balduff, Barbara Campbell, and Sandy Bruce spoke in opposition to the request because of the drainage problems in the area. Ronald Olson, representing Mr. Whitney, indicated it was their intention to engineer a design to address the drainage problem. MOTION by Colburn, SECOND by Hitchcock, to close the public hearing. MOTION CARRIED UNANIMOUSLY. The Council expressed concerns over the drainage problems in this area. Colburn suggested denial until a recommendation could be obtained from the Storm Water Committee. Dugan noted approving the rezone did not grant the development of the property since they would have to provide a method to deal with the drainage problem. Nevins indicated what was needed was an overall solution which would require resolving the problem all the way to the Green River. Kurle wondered what would be required to prevent runoff. Nevins stated there were ways to create a ponding area on the site, however, there was the problem of what they would do with it then. The Council discussed the possiblity of denying the request and waiving the six month waiting period for resubmission. MOTION by Colburn, SECOND by Craig, to deny application 22-83 and return the application permit fee. Kurle stated he did not see a solution coming in the near future and suggested denial would keep it from getting worse. Wisner and Lea voted NO. MOTION CARRIED. 5. Seafirst Mortgage Corp. Rezone from R-2 (Multi -Family) with a Conditional Use Permit to R-TP (Mobile Home Park) on property 12.4 acres in size and located on the south side of 29th Street S.E. in the 600-700 block. (23-83) Pat Dugan noted two additional conditions provided in the agenda modifications and a correction in 6 (b) should be Lot 30 instead of 38. No one in the audience spoke for or against the rezone. MOTION by Wisner, SECOND by Kurle, to approve the rezone from R-4 to R-TP and to approve the vacation of the final plat of Skylark and, further, to instruct the City Attorney to prepare the necessary ordinance vacating the plat and an ordi- nance approving the rezone outlining the findings of fact and conditions of approval. Washington Logging Equipment, Inc Preliminary Plat - To be known as Washington Logging Division No. I consisting of 5.34 acres zoned heavy industrial and located on the west side of West Valley Highway in the 2100 block. (P-2-83) Jack Ewing, engineer for Washington Logging Equipment, was in the audience to answer questions. No one else spoke for or against the request. MOTION by Hitchcock, SECOND by Colburn, to close the public hearing. MOTION CARRIED UNANIMOUSLY. MOTION by Wisner, SECOND by Craig, to approve the preli- minary plat based upon the applicable findings of fact and subject to the conditions as outlined. MOTION CARRIED UNANIMOUSLY. Audience Participation Auburn Court Apartments Utility Adjustment - Winston Jones, representating Auburn Court Apartments, asked the Council to grant their request for a higher uti- lity adjustment than the Utility Committee recom- mended. L.I.D. 311 and 312 Segregation of Assessments - Everett Smith, 1201 37th Street S.E., spoke in favor of the L.I.D. segregations. C. Correspondence - City Clerk McConnehey noted a letter had been received from Robert Stidham appealing the Utility Committee's denial of the utility hook-up charge waiver request. (See Utility Committee Report for action.) COUNCIL COMMITTEE REPORTS III. A. Utility - Chairman Ron Craig Stidham Appeal - MOTION by Craig, SECOND by Larson, to notify Stidham his appeal would be heard at the October 3 Council meeting and he must appear in person. MOTION CARRIED UNANIMOUSLY. Auburn Court Apts. - Craig noted they had been notified of the leak and had chosen not to repair it. He stated it was the City's policy to not make any further adjustments after a utility user had keen notified. B. Storm Sewer - Chairman Don Kurle - No report. C. Planning & Zoning - Chairman Wisner - Minutes are of public record. D. Finance - Chairman Bud Larson - Larson reported on the meeting which was held before the Council meeting. He noted items for action were already on the agenda. E. Public Safety - Chairman Lewis Hitchcock - No report. F. Municipal Services - Chairman Colburn - Minutes are of public record. G. Street Imp. 252-A to Valley Cement Construction on their low bid of #37,202.23. MOTION by Craig, SECOND by Larson, to approve Consent Agenda Items B through E. Colburn voted NO. MOTION CARRIED. MOTION by Larson, SECOND by Craig, to approve Consent Agenda Item A with the correction to the September 6, 1983, Council Minutes, Item 3, Page 2, to read, "refer back to the respective committess for a couple of months or so." MOTION CARRIED UNANIMOUSLY. OLD BUSINESS ' V. Old Business - Street Vacation - Right -of -Way on Knickerbocker Drive lying easterly of the intersection of Knickerbocker Drive and HiCrest Drive. This item was still in the Street Committee. NEW BUSINESS VI. Ordinances and Resolutions A. Ordinance 3906 - Approves and confirms Final Assessments for Local Improvement District 323. MOTION by Lea, SECOND by Hitchcock, to introduce and adopt Ordinance 3906. MOTION CARRIED UNANIMOUSLY. B. Ordinance 3907 - Related to David Thoday Rezone at 2623 West Valley Highway from Unclassified to M-1. MOTION by Wisner, SECOND by Larson, to introduce and adopt Ordinance 3907. MOTION CARRIED UNANIMOUSLY. C. Ordinance 3908 - Compact Car Amendment to Off -Street Parking Ordinance Chapter 18.58.070. MOTION by Wisner, SECOND by Craig, to introduce and adopt Ordinance 3908. MOTION CARRIED UNANIMOUSLY. D. Resolution 1449 - Segregation of Assessment Roll of Local Improvement District 311, Assessment 19. MOTION by Craig, SECOND by Wisner, to adopt Resolution 1449. MOTION CARRIED UNANIMOUSLY. E. Resolution 1450 - Segregation of Assessment Roll of Local Improvement District 312, Assessment 17. MOTION by Craig, SECOND by 1450, to adopt Resolution 1450. MOTION CARRIED UNANIMOUSLY. F. Resolution 1451 - Authorizes Contract with Jongejan/Gerrard/ McNeal for Master Site Plan of the Game Farm. MOTION by Wisner, SECOND by Craig, to adopt Resolution 1451. Mayor's Report - Mayor Roegner noted City Hall would be open for primary results tomorrow evening. He also announced a Council/Mayor workshop on October 4th on Goal Setting.
