MEETING MINUTES
July 21, 2008 7:30 PM
A. Flag Salute
Mayor Peter B. Lewis called the meeting to order at 7:30 p.m. and
led those in attendance in the Pledge of Allegiance.
B. Roll Call
Mayor Lewis and the following Councilmembers were present:
Rich Wagner, Sue Singer, Gene Cerino, Nancy Backus, Bill
Peloza, Lynn Norman and Virginia Haugen.
Staff members present included: Information Services Director
Lorrie Rempher; Chief of Police Jim Kelly; Storm Drainage
Engineer Tim Carlaw; Finance Director Shelley Coleman; Human
Resources and Property/Risk Management Director Brenda
Heineman; Public Works Director Dennis Dowdy; City Attorney
Daniel B. Heid; Parks, Arts and Recreation Director Daryl Faber;
Planning, Building and Community Director Cindy Baker; and City
Clerk Danielle Daskam.

II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearings
1. Extension of Moratorium - West Hill Drainage Area

Resolution No. 4300, adopted January 22, 2008, and
amended by Resolution No. 4321 on March 3, 2008,
established an initial six-month moratorium on the filing of
land use applications, building and grading permit
applications in the drainage area contributing surface flows
to Mill Creek tributaries 0045, 0047, 0048 and 0053 as
identified by King County and as defined by Resolution No.
4300. On July 7, 2008, the City Council set the date of July
21, 2008 for a public hearing on the proposed moratorium
extension.
Public Works Dowdy reported that on June 25, 2008, a
meeting was held with residents of the affected area to
discuss King County's detailed analysis known as the
"Mullen Slough Capital Improvement Project Study and
Action Plan".
Storm Drainage Engineer Carlaw presented the staff report
on the proposed extension of the moratorium. Since the
enactment of the moratorium, City staff members have been
engaged with King County to review the study findings and
the different proposed alternatives.
Engineer Carlaw explained that flows originate on the West
Hill flank and drain through some steep ravines until they
reach the valley floor and then into poorly defined sediment-
laden channels. Two problems occur: erosion on the
ravines from increased flows due to development and
drainage issues with the conveyance downstream.
Engineer Carlaw reported that two studies have been
performed to date: the Mill Creek Tributary 53 and King
County Tributaries 45, 47 and 48.
Several projects have been identified in the Action Plan to
alleviate the chronic flooding but have not yet been
implemented. While some of the projects are more complex
or situated on privately held property, there are several on

City property that could be advanced. The majority of the
downstream projects are in the County.
Staff members recommend the continuation of the
moratorium, as amended by Resolution No. 4321, for an
additional six months to allow time to complete additional
studies and incorporate them in the Comprehensive Storm
Drainage Plan.
Mayor Lewis opened the public hearing at 7:42 p.m.
Mara Heiman, 6430 South 287th Street, Auburn
Ms. Heiman spoke briefly regarding her efforts over the
years for relief from the chronic flooding of her
neighborhood. She thanked the Council for enactment of
the moratorium and spoke in favor of extending the
moratorium. Ms. Heiman proposed utilizing public rights of
way for drainage so that it can be publicly maintained.
Darlene Locken, 6610 South 287th Street, Auburn
Ms. Locken expressed agreement with Ms. Heiman's
comments.
There being no further public comment, Mayor Lewis closed
the hearing at 7:47 p.m.
There being no objection from the Council, Mayor Lewis
modified the agenda to bring Resolution No. 4383 before the
Council at this time.

seconded to adopt Resolution No. 4383.

B. Audience Participation
This is the place on the agenda where the public is invited to speak
to the City Council on any issue. Those wishing to speak are

Mr. Whale thanked the Police Department for their cooperation in
providing information on police calls for service that appear in the
"police blotter" in The Auburn Reporter.
C. Correspondence
There was no correspondence for Council review.
III. COUNCIL COMMITTEE REPORTS
A3.7.6
A. Municipal Services
Chair Cerino reported the Municipal Services Committee met June
14, 2008 at 3:30 p.m.. The Committee approved consent items
and reviewed Resolution No. 4378 relatingq to a Bureau of Justice
Grant. The Committee also discussed 4 of July police calls for
service, an update on the golf course restaurant, golf course
practice nets, a grant for a parallel taxiway at the Auburn Municipal
Airport, use of the Auburn gun range, and the City's addressing
system. The next regular meeting of the Municipal Services
Committee is scheduled for July 28, 2008 at 3:30 p.m.
B. Planning & Community Development
Vice Chair Backus reported the Planning and Community
Development Committee met July 14, 2008. The Committee
discussed infill residential development and issues related to short
plat, half street requirements and access tract standards;
Resolution No. 4376 authorizing an agreement with BHC
Consultants; Resolution No. 4374 authorizing an interlocal
agreement with Pierce County relating Vision 2040; and official
decisions and reports from Director Baker. The next regular
meeting of the Planning and Community Development Committee
is scheduled for July 28, 2008 at 5:00 p.m.
C. Public Works
Chair Wagner reported the Public Works Committee met this
afternoon at 3:30. The Committee approved an environmental
consultant agreement with AMEC Earth and Environmental,

Resolution Nos. 4377 and 4380 setting dates for public hearings on
right-of-way vacations, and Resolution No. 4384 approving a flood
control easement for dike repair. The Committee also discussed
the Six Year Transportation Improvement Plan, traffic control
methods to replace C-curbing, and street lighting in the annexation
areas. The next regular meeting of the Public Works Committee is
scheduled for August 4, 2008 at 3:30 p.m.
D. Finance
Councilmember Backus reported the Finance Committee met this
evening at 6:30. The Committee approved claims and payroll
vouchers and Ordinance No. 6192 regarding the authority of the
Mayor. The Committee discussed Resolution No. 4381 authorizing
an amendment to the current public defense services contract,
Resolution No. 4378 accepting a Bureau of Justice grant, a
contract with Microflex for utility tax audit services, and Resolution
No. 4384 authorizing a flood control easement for King County
Flood Control Zone District. The next regular meeting of the
Finance Committee is scheduled for August 4, 2008 at 6:30 p.m.
E. Community Center
Chair Wagner reported the Community Center Committee has not
met since the last City Council meeting.
F. Downtown Redevelopment
Chair Norman reported the Downtown Redevelopment Committee
will meet tomorrow, July 22, at 3:30 p.m.
IV. REPORTS
At this time the Mayor and City Council may report on significant items
associated with their appointed positions on state, regional and local
organizations.
A. From the Council
Councilmember Backus reported the Planning and Community
Development Committee and the Planning Commission held a joint
meeting on July 15 to discuss topics from the Council's February
2008 retreat. Councilmember Backus also reported that she
attended the exit conference for the 2007 audit conducted by the
Washington State Auditor's Office. Councilmember Backus noted
there were no audit findings and congratulated Director Coleman
and Finance staff for their work during the audit process.

Councilmember Peloza reported the Water Resource Inventory
Area (WRIA) 9 met recently where the major topics included the
Salmon Recovery Funding Board budget and the funding of the
Pautzke/Auburn levee setback and removal project.
Councilmember Peloza also reported on a recent meeting of the
Auburn Farmers Market steering committee. The Committee has
mailed approximately 20 introductory letters to farmers in the
region, hired a market manager, developed a Market logo, and is
applying for grants for operation expenses. The Market opening is
scheduled for spring of 2009.
B. From the Mayor
Mayor Lewis reported that he received a visit from 18 student
leaders from the countries of Bangladesh, India and Pakistan who
are studying at Green River Community College this summer as
part of a Federal grant sponsored by the Academy for Educational
Development.
Mayor Lewis announced the development of a new brochure titled
"Faces of Auburn" which highlights Auburn's indigenous people and
the waves of immigration that have occurred throughout Auburn's
history.
Mayor Lewis also commented on the efforts of the Valley Cities to
improve the trail systems throughout the region and encouraged
residents to take advantage of the extensive trail systems.

All matters listed on the Consent Agenda are considered by the City
Council to be routine and will be enacted by one motion in the form listed.

Deputy Mayor Singer moved and Councilmember Wagner seconded to
approve the Consent Agenda.

Washington, receiving a petition for vacation and setting a
public hearing to consider the vacation of right-of-way of a

Councilmember Wagner moved and Councilmember Cerino
seconded to adopt Resolution No. 4377.
MOTION CARRIED UNANIMOUSLY. 7-0.

Washington, initiating street vacation proceedings and
setting a public hearing to consider the vacation of a portion

Washington, authorizing the Mayor and City Clerk to execute
a Flood Control Easement for the King County Flood Control
Zone District
Councilmember Backus moved and Deputy Mayor Singer
seconded to adopt Resolution No. 4384 with the deletion of
the words "as a result of activity that is not permitted by the
easement" from page 2 of Exhibit A (easement).
MOTION CARRIED UNANIMOUSLY. 7-0.
At 8:16 p.m., Mayor Lewis recessed the meeting for a five minute
intermission and then to executive session for approximately fifteen
minutes in order to discuss pending/potential litigation pursuant to RCW
42.30.110(1)(i). Mayor Lewis extended the executive session twice for a
total of twenty additional minutes.
Mayor Lewis reconvened the regular meeting at 8:58 p.m.
IX. ADJOURNMENT
There being no further business to come before the Council, the meeting
adjourned at 8:58 p.m.
