HomeMy WebLinkAbout3506 ORDINANCE N0. 3 5 0 6 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION AND INSTALLATION OF SANITARY SEWER IN 37TH STREET S.E., 600 FEET EAST OF "D" STREET TO "M" STREET, ON "M" TO 300 FEET NORTH, WITHIN THE CITY OF AUBURN, WASHINGTON; CREATING AND ESTABLISHING LOCAL IMPROVEMENT DISTRICT NO. 312; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT AND THE MODE OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT FUND THEREFOR. WHEREAS, a petition has been filed with the City Council of the City of Auburn, signed by the owners of the ,property aggregating a majority (1) of the lineal frontage upon the improvement and (2) of the area within the proposed district, setting forth the nature and territorial extent of the proposed im- provement, th.e mode of payment and what proportion of the lineal frontage upon the improvement and of the area within the proposed district is owned by the petitioners as shown by the records in the office of the County Auditor for King County, Washington, petitioning for the construction and installation of sanitary sewer in 37th Street S.E., 600 feet east of "D" Street to "M" Street, on "M" to 300 feet north, within the city of Auburn, Washington; and WHEREAS, the City Engineer has caused an estimate to be made on the cost and expense of the proposed improvement and has certified said estimates to the City Council, together with all papers and information in his possession touching the proposed improvements, a description of the boundaries of the district, a statement of what portion of the costs and expense of the improvements should be borne by the property within the proposed district, a statement in detail of any local improvement assessments outstanding and unpaid against the property in the proposed district, and a statement of the aggregate actual valuation of the real estate and the actual valuation of the improvements in the proposed district according to the valuation last placed upon it for the purpose of general taxation; and WHEREAS, said estimates are accompanied by a diagram of the proposed improvements showing thereon the lots, tracts and parcels of land and other property which will be especially benefitted by the proposed improvements and the estimated amount of the cost and expense thereof to be borne by each lot, tract and parcel of land or other property. ---------------------- Ordinance No. 3506 Page One 4-17-80 .V NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That 37th. Street S.E., 600 feet east of "D" Street to "M" Street, on "M" to 300 feet north, inside the corporate limits of the City of Auburn, be improved by the construction and installation of sanitary sewer, all in accordance with plans and specifications prepared by the City Engineer and filed with the City Clerk. Section 2. That there is hereby created and established a Local Improvement District to be designated Local Improvement District No. 312, which said district is described as follows: That por of Sec 30, TWP 21 N, R 5 EWM, more particularly desc as follows: The E 75' of the S 210' of the SW 1/4 of NE 1/4 of SW 1/4 said Sec 30, Less Street. The S 150' of the E 1/2 of the NE 1/4 of the SW 1/4 said Sec 30 Less Street. The E 75' of the N 150' of the NW 1/4 of SE 1/4 of SW 1/4 said Sec 30 Less Street. King County, State of WA. Section 3. That the estimated costs in carrying out the foregoing improve- ment is hereby declared to be as near as may be, the sum of $160,396.97. Section 4. Applicable costs and expenses of all engineering, legal, inspection, advertising, publication and notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and ---------------------- Ordinance No. 3506 Page Two 4-17-80 properly assessable therefor, as provided by the laws of the State of Washington and the Ordinances. of the City of Auburn. Section 5. That said improvements shall be made by the City of Auburn under the supervision of the City Council thereof of such committee or person as the City Council may designate. Section 6. Assessments or any portion thereof, may be paid at any time within thirty (30) days from the date of the first publication of the Notice of Collection of such assessments without penalty, interest, or costs, and thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal annual install- ments, with interest on the whole unpaid sum at the rate of nine and three-quarters percent (g.75%) per annum. Commencing with the first year after the last day, such assessments, or any portion thereof, may be paid without penalty, interest or cost (thirty (30) days from the date. of the first publication of the Treasurer's Notice of Collection of Assessments) and each year thereafter one of said install- ments, together with. the interest due, shall be collected as provided by law and the Ordinances of the City of Auburn; assessments or installments of assessments not paid when due shall be delinquent and there shall be added to the same a penalty of eight and one-half percent (8.5%) of the amount of the overdue installments and interest, and such penalty shall become a part of the lien upon the property assessed. y Section 7. That there is hereby created in the office of the Finance Director for the City of Auburn „lashington, a fund of the City to be known as "Local Improvement District No. 312 Fund": Warrants shall be drawn on said fund based on estimates made by the City Engineer and approved by the City Council in payment of the costs of construction and installation of said improvements. ------------------ Ordinance No. 3506 Page Three 4-17-80 4 Section 8. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
