HomeMy WebLinkAbout43731 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17! 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 3 7 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 3 TO THE INTERAGENCY AGREEMENT WITH THE WASHINGTON STATE PARKS AND RECREATION COMMISSION FOR FUNDS TO COMPLETE AUBURN GAME FARM WILDERNESS PARK (ORIGINAL AGREEMENT AUTHORIZED BY CITY OF AUBURN RESOLUTION NO. 1545, PASSED NOVEMBER 19, 1984) AND APPROVING AN APPROPRIATION OF FUNDS IN THE AMOUNT NOT TO EXCEED $850,000 FROM THE STATE PARKS AND RECREATION COMMISSION. WHEREAS, the Auburn City Council of the City of Auburn must adopt and approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Pursuant to Chapter 35A.33 RCW the City hereby approves the expenditure and appropriation not to exceed a total amount of EIGHT HUNDRED FIFTY THOUSAND DOLLARS ($850,000), which constitutes a Grant pursuant to the Agreement between the City of Auburn and the Washington State Parks and Recreation Commission. Section 2. The Mayor and City Clerk of the City of Auburn are authorized to execute Amendment No. 3 to the Interagency Agreement with the Washington State Parks and Recreation Commission which will provide grant funding to the City of Auburn to complete the Auburn Game Farm Wilderness Park. (The original Agreement was authorized by City of Auburn Resolution No. 1545, passed November 19, 1984). Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 4. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. c� INTRODUCED: PASSED: APPROVED: MAYOR ATTEST: Gayle Biftcher, Deputy City Clerk APPROVED AS TO FORM: Marguerite Schellentrager, City Attorney Published: --------------------- Ordinance No. 4373 Page 2 September 6, 1989 CITY OF AUBURN - AUBURN GAME FARM WASHINGTON STATE PARKS AND RECREATION COMMISSION INTERAGENCY AGREEMENT NIZIN?111'� XaIL OW] WHEREAS, on November 20, 1984 the Washington State Parks and Recreation Commission, hereinafter referred to as the Commission, and the City of Auburn, hereinafter referred to as the City, entered into an agreement for development, operation and maintenance for urban recreational park purposes certain recreational lands in the City of Auburn; and, WHEREAS, the City has completed the public planning process, master plan for the entire property and construction of facilities north of the White River; and, WHEREAS, the 1987 Legislature approved funds in the amount of $500,000 to construct a group campsite for recreation vehicles (RV's) and related facilities south of the White River to complete Commission responsibility for development, operation and maintenance as outlined in Provision 5 of the original agreement; and, WHEREAS, the City, in designing and constructing facilities south of the White River in accordance with Provisions 19 and 20 of the amended agreement, encountered unavoidable cost increases that caused said development to be split into two phases; and, WHEREAS, the City has completed construction of Phase I facilities south of the White River; and, WHEREAS, the 1989 Legislature provided the Commission with additional funding to complete the project, ------------------ Ordinance No. 4373 Exhibit A -2- NOW THEREFORE, in accordance with Provision 17, the amended agreement is further amended by adding the following provision: 21. The City and/or its agent shall complete the design and construction of youth group camping and day use area and other river related facilities located south of the White River (Phase 2 development) consistent with the revised master plan and as approved by Commission staff. Required permits, archaeological clearance and environmental analysis will be the responsibility of the City. All costs to the Commission for Phase 1 and 2 facility completion shall not exceed $850,000 and all future operating and maintenance costs will be the City's responsibility. Payment to the City by the Commission will be according to terms established in Provision 20 of the first amendment to this agreement. All other terms and conditions of the existing amended agreement remain in force. DATED this day of _� 1989. CITY OF AUBURN By ��.
