AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, PROVIDING FOR THE REZONING OF APPROXIMATELY 60
ACRES OF CERTAIN PROPERTY LOCATED BETWEEN SR18 AND 15TH STREET
4 S.W. AND BETWEEN SR167 AND UNION PACIFIC RAILROAD, WITHIN THE
CITY OF AUBURN, WASHINGTON, BY CHANGING THE ZONING
5 CLASSIFICATION THEREOF FROM M-1 (LIGHT INDUSTRIAL) TO C-3
(HEAVY COMMERCIAL) AND REPEALING ORDINANCE NO. 2846 PASSED
6 OCTOBER 21, 1974 AND ANY ASSOCIATED AGREEMENTS EXECUTED
7 THERETO.

9 WHEREAS, Application No. REZ0009-90 has been submitted to
l0 the City Council of the City of Auburn, Washington, in
]! compliance with Auburn City Code Chapter 18.68, by Hapsmith
]2 Properties IV requesting that the City Council rezone certain
13 property located between SR18 and 15th Street S.W. and between
!4 SR167 and the Union Pacific Railroad, and hereinafter
15 described in Section 2 of this Ordinance, from M-1 (Light
]6 Industrial) to C-3 (Heavy Commercial);
17 WHEREAS, pursuant to Auburn City Code 18.68.030, said
18 rezone request was referred to the City of Auburn Planning
19 Commission for study and public hearing thereon;
20 WHEREAS, the Planning Commission, based on staff review,
21 conducted a public hearing to consider said application in the
22 Council Chambers of the Auburn City Hall on March 30, 1993 and
23 March 31, 1993, at the conclusion of which the Planning
24 Commission recommended to the City Council that the Council

2 approve the requested rezone application with certain
revisions to specific conditions of approval;
4 WHEREAS, on April 5, 1993 the Planning Commission's
5 Findings of Fact, Conclusions of Law and Conditions were
transmitted to the Mayor and to the City Council for
consideration;

8 WHEREAS, pursuant to Auburn City Code 18.68, on April 5,
1993 the City Council at a regular meeting scheduled a special
9
10 meeting for April 27, 1993 at 6:00 P.M. to conduct a public
hearing to consider the recommendation of the Planning
Commission to approve the rezone application;

13 WHEREAS, subsequent to the Planning Commission'~ hearing
and recommendation, the Planning Staff transmitted to the City
14
Council proposed changes to certain conditions of the
15
Commission's recommendation for Council consideration;
17 WHEREAS, the city Council of the City of Auburn conducted
18 a public hearing on the recommendation of the Planning
Commission on April 27, 1993 at 6:00 P.M. in the Council
20 Chambers of the City of Auburn City Hall at which time the
21 Council considered the entire record compiled on the rezone
22 request and heard and considered testimony and comments
presented at the public hearing;
24 WHEREAS, upon consideration of the Planning Commission's
25 Findings of Fact, Conclusions of Law and Conditions and the

public testimony presented at the public hearing, the City
Council of the City of Auburn at the conclusion of the public
hearing affirmed with certain modifications the recommendation

of the Planning Commission and approved the rezone
5
application.
WHEREAS, a rezone of the subject property pursuant to
7
Ordinance No. 2846 approved by the City Council on October 21,
8
1974, and an associated agreement implementing said rezone,
9
]0 provide potential conflicts with the rezone approved herein
and therefore the Council finds that said Ordinance and
12 agreement must be repealed in their entirety at this time.
14 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
15 WASHINGTON, DO ORDAIN AS FOLLOWS:
Bectlon 1. City of Auburn Ordinance No. 2846 passed
16
on October 21, 1974, and any agreements executed thereto, are
17
herewith repealed in their entirety.

Section 2. The City Council of the City of Auburn
19
20 hereby affirms the recommendation of the City of Auburn
21 Planning Commission to approve the rezone requested by
22 Hapsmith Properties IV in Application No. REZ0009-90 and
incorporates and adopts the Findings of Fact, Conclusions of
24 Law and Conditions of the Planning Commission, as modified by
25
Ordinan~ No. ~27

the City Council, which are designated as Exhibit "A",

attached hereto and incorporated herein.
Section 3. The property located between SR18 and 15th
4
Street S.W. and between SR167 and the Union Pacific Railroad,
5
situate in the City of Auburn, County of King, State of
6
Washington, be and the same is hereby rezoned from M-1 (Light
7
Industrial) to C-3 (Heavy Commercial) and is legally described
8
as provided for in Exhibit "B", which is attached hereto and
9
]0 incorporated herein.
Section 4. Upon the passage, approval and publication
11
of this Ordinance as provided by law, the City Clerk of the
12
13 City of Auburn shall cause this Ordinance to be recorded in
the office of the King County Auditor, Division of Records and
14
Elections.

Section 5. The Mayor is hereby authorized to
16
17 implement such administrative procedures as may be necessary
to carry out the directives of his legislation.

Seotion 6. This Ordinance shall take effect and be in
19
20 force five (5) days from and after its passage, approval and
21 publication, as provided by law.
