HomeMy WebLinkAbout4710 1 2 3 4 5 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 7 i 0 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ANNEXING TO THE CITY FOR MUNICIPAL PURPOSES CERTAIN LAND CONTIGUOUS THERETO, KNOWN AS THE OLSON CANYON PROPERTY ADJACENT TO THE CITY OF AUBURN GOLF COURSE. WHEREAS, the City of Auburn has acquired the Olson Canyon property, an approximate 60 acre parcel of property located approximately on the north side of the City of Auburn golf course contiguous to the City of Auburn; and WHEREAS, the property purchased is to be used for municipal park purposes and therefore is for a municipal purpose; and WHEREAS, in accordance with RCW 35A.14.300 the City Council may by majority vote annex such property for a municipal purpose when owned by the City; and WHEREAS, the subject property was acquired by the City on March 15, 1994; and WHEREAS, the City Council on August 15, 1994 by majority vote instructed the Planning Department to forward the Notice of Intention to the King County Boundary Review Board; and WHEREAS, notice of intention to annex was filed with the King County Boundary Review Board; and WHEREAS, the King County Boundary Review Board has waived review and, no request for jurisdiction having been filed, the proposed annexation, is deemed approved as a matter of law. Ordinance No. 4710 November 2, 1994 Page I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Seotion ~. That there shall be annexed to the City of Auburn, Washington, the property situated in the County of King, State of Washington, which legal description is described in Exhibit "i" attached hereto and incorporated by reference as if set out in full. Section Z. That the annexation of the property will become effective on the effective date of this Ordinance and the property shall become part of the City of Auburn, subject to all of the laws and ordinances of the City then otherwise provided by law. Seotion 3. Within ten (10) days after the effective date of the annexation referred to in this ordinance, the City Clerk of the City of Auburn shall send to the Office of the Clerk of the County Council one (1) certified copy of this Ordinance together with a copy of a letter from the Executive Secretary of the King County Boundary Review Board, which letter contains a copy of the decision of the Boundary Review Board relating to this annexation. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation.
