AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE FINAL PLAT OF LAKELAND DIVISION 1, PHASE
2 SUBDIVISION LOCATED EAST OF LAKELAND HILLS WAY AND SOUTH OF
EVERGREEN WAY SE WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, at the regular meeting of the Auburn City Council held on February
7, 2000, the Auburn City Council approved the Final Plat of Lakeland Division 1, Phase
2 subdivision, Application No. PLT0001-99, based on the following:
FINDINGS OF FACT
1. Lakeland Communities has requested final plat approval of the
Lakeland Division 1, Phase 2 subdivision and all applicable
conditions have been met. Lakeland Division 1, Phase 2
subdivision, is a 57 lot single-family subdivision located in Pierce
County, within the City of Auburn.
2. The Final Plat is in compliance with the Zoning and Land Division
Ordinance and is consistent with the City's engineering standards.
The applicant has posted a bond in the amount of $1,200,000 to
cover the construction costs of the water system, the sewer
system, storm drainage and streets. A performance bond of
$330,000 has also been posted to cover the costs of the linear
park.
3.The City Engineer has reviewed and approved said bond and
has issued a certificate of improvements for the final plat.
CONCLUSIONS OF LAW
1. The Final Plat is in compliance and in conformity with applicable
Zoning and Land Division Ordinances and other applicable land
use controls.

2. The Plat is consistent with the Comprehensive Plan.
3. The Plat meets the requirements of Chapter 58.17 RCW.
Based on the foregoing Findings of Fact and Conclusions, the final plat is hereby
approved.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Purpose. The Lakeland Division 1, Phase 2 subdivision, is a 57 lot
single-family subdivision located East Of Lakeland Hills Way and South Of Evergreen
Way SE, within the City of Auburn, Pierce County, Washington, which Plat is on file with
the City Clerk of the City of Auburn, and which plat is legally described on the face of
the Final Plat and setforth in Exhibit "A", is attached hereto and incorporated herein by
this reference.
Section 2. Pursuant to RCW 58.17.170, the final plat conforms to all terms of
the preliminary plat approval and complies with all requirements of Chapter 58.17 RCW
and applicable state and local laws.
Section 3. Constitutionality or Invaliditv. If any section, subsection clause
or phase of this Ordinance is for any reason held to be invalid or unconstitutional such
invalidity unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this Ordinance, as it is being hereby expressly declared that this

Ordinance and each section, subsection, sentence, clause and phrase hereof would
have been prepared, proposed adopted and approved and ratified irrespective of the
fact that nay one or more section, subsection, sentence, clause or phase be declared
invalid or unconstitutional.
Section 4. Upon the passage, approval and publication of this Ordinance as
provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be
recorded in the office of the Pierce County Auditor.
Section 5. Implementation. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry out the directions of this
legislation.
Section 6. Effective Date. This Ordinance shall take effect and be in force five
(5) days from and after its passage, approval and publication, as provided by law.
