AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, ADDING A NEW SECTION 12.56.046 ENTITLED
"AUTOMATIC GATE ELECTRONIC CARDS" TO AUBURN CITY CODE
CHAPTER 12.56 ENTITLED "AIRPORT" TO SET FORTH ELECTRONIC
CARD REQUIREMENTS.
WHEREAS, the Auburn Municipal Airport maintains perimeter fencing
for security and safety; and
WHEREAS, airport tenants are provided an electronic card which allows
the tenant to operate automatic gates to gain access to the tenant's aircraft;
and
WHEREAS, the electronic cards are costly to replace if lost or damaged;
and
WHEREAS, it is the responsibility of the tenant to replace any electronic
card which is lost or damaged;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. PURPOSE: The purpose of this ordinance is as follows:
To add a new section 12.56.046 entitled "Automatic Gate Electronic
Cards" to chapter 12.56 entitled "Airport" to provide for the requirements
regarding the electronic cards.

Section 2. ADOPTION: The City Council of the City of Auburn does
hereby adopt the following new section 12.56.046 entitled "Automatic Gate
Electronic Cards" to chapter 12.56 entitled "Airport":
12.56.046 Automatic Gate Electronic Cards.
One automatic gate electronic card will be issued to each tenant free of
charge. Any additional electronic cards requested by a tenant is subject to a
$25.00 refundable deposit charge A $25.00 replacement fee will be assessed
against the tenant for all lost or damaged electronic cards. All electronic cards
must be returned to the airport at the time of lease expiration.
Section 3. CONSTITUTIONALITY OR INVALIDITY: If any section,
subsection, clause, phrase, or sentence, of this Ordinance, is for any reason
held to be invalid or unconstitutional, such invalidity or unconstitutionality of the
remaining portions of this ordinance, as it is being hereby expressly declared
that this ordinance and each section, subsection, clause, phrase, or sentence,
hereof would have been prepared, proposed, adopted, and approved and
ratified irrespective of the fact that any one or more section, subsection, clause,
phrase, or sentence, be declared invalid or unconstitutional.
Section 4. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directions of
this legislation.

Section S. This ordinance shall take effect and be in force five (5) days
from and after its passage, approval, and publication, as provided by law.
