AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE VACATION OF 'B' STREET SW
BETWEEN 1 ST STREET SW AND 2ND STREET SW AND THE ALLEY
CONNECTING THIS PORTION OF 'B' STREET SW TO 'A' STREET SW,
WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Petition No. V-04-99 has been filed by the owners of two-
thirds or more of the property abutting the portion of right of way requested to
be vacated; and
WHEREAS, the statute requires that the City Council schedule a public
hearing when a valid petition is filed with the City; and
WHEREAS, the public hearing was held on JUNE 5, 2000, before the
City Council.
NOW, THEREFORE, CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1- That the street right-of-way located on 'B' Street SW
between 1" Street SW and 2nd Street SW and the alley connecting this portion
of 'B' Street SW to 'A' Street SW, is legally described on attached Exhibit "A"
and incorporated by reference herein, be and the same is hereby vacated, and
the property lying in said portion of a certain street right of way described

hereinabove, shall be returned and belong to those persons entitled to receive
the property in accordance with the law.
Section 2. The petitioner at their expense shall relocate the existing utilities to
the satisfaction of the City. The City shall retain a utility easement for the
operation, repair and maintenance of all public utilities over, across, upon and
underneath that portion of the property described in Section 1 of this Ordinance
until such time as the relocation of the existing utilities by the petitioner is
completed. Said easement shall be released when the utilities have been
relocated to the City's satisfaction.
Section 3. Upon the passage, approval and publication of this
Ordinance, the City Clerk for the City of Auburn shall cause this Ordinance to
