ORDINANCE NO. 5 41 2
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ANNEXING TO
THE CITY A 1.5 ACRE PARCEL OF LAND LOCATED ON 28418 85TH
AVENUE SOUTH IN KING COUNTY.
WHEREAS, the City of Auburn, Washington, has received Application
No. ANX0002-99 petitioning the City to annex 1.5 acres of land located on
28418 85th Avenue South; and
WHEREAS, the subject parcel is also part of an unincorporated area
which the City has been working on annexing; and
WHEREAS, the notice of intention to annex was filed with the King
County Review Board, and was approved by the Boundardy Review Board
attached as Exhibit "1 "; and
WHEREAS, on June 22, 1999, the petition was received by the City of
Auburn, which petition was signed by the property owners, representing 100%
of the valuation of the property lying within the limits of the proposed area to be
annexed, according to the assessed valuation for general taxation; and
WHEREAS, on May 1, 2000 the City Council held a public hearing at
7:30 p.m. in the Council Chambers of the Auburn City Hall, at which time the
City Council recommended approval of said annexation;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Purpose. That there shall be annexed to the City of Auburn,
Washington, the property situated in the County of King, State of Washington,
legally described in Exhibit "A' and incorporated herein.
Section 2. That the property hereby annexed shall be assessed and
taxed at the same rate and on the same basis as other property within the City
of Auburn is assessed and taxed to pay for any outstanding general
indebtedness of the City to which the area was annexed. .
Or) Section 3. Effective Date. This Ordinance shall take effect and be in

Section 4.. Within ten (10) days after the effective date of the

annexation referred to in this ordinance, the City Clerk of the City of Auburn
shall send to the Office of the Clerk of the County Council one (1) certified copy
of this Ordinance together with a copy of a letter from the Executive Secretary
of the King County Boundary Review Board, which letter contains a copy of the
decision of the Boundary Review Board relating to this annexation.
Section 5. The City Clerk of the City of Auburn shall record a certified

copy of this Ordinance with the King County Auditor's Office.
Section 6. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out
the directives of this legislation.
Section 7. Effective Date. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and publication as
provided by law.

RE: CLOSING LETTER FOR COMPLETED ACTION (WITH WAIVER)
File No. 2083 - City of Auburn - Elliott/Codiga Annexation
Dear Mr. Rued:
We are writing to advise you that the Boundary Review Board has now completed the required
preliminary evaluation, as specified in RCW 36.93, for the above -referenced proposed action
filed with the Board effective: May 23, 2000.
The Boundary Review Board has determined that the proposed action is consistent with RCW
36.93. The Board waives further review of the proposed action on the basis that further review
is not necessary for the protection of the public interest (RCW 36.93.100).
The Boundary Review Board, therefore, hereby deems this proposed action approved effective:
June 16, 2000. Final approval of the proposed action is also subject to the following actions,
► where applicable:
1. Sewer and Water District actions and some other actions are also subject to approval by the
Metropolitan King County Council. If the Council makes changes to the proposal, the Board
may then be required to hold a public hearing.
2. Filing with King County of franchise application(s), as required, accompanied by a copy of
this letter.
3. Filing with King County of permit application(s), as required, accompanied by a copy of this
letter.
4. Fulfillment of all other statutory requirements and/or procedures specified in your Notice of
Intention.

5. Notification to King County Office of Regional Policy and Planning, in writing, of your
intended effective date of annexation. This notification should be provided as early as
possible. Please send this information to Susan Thomas, Office of Regional Policy and
Planning, 516 Third Avenue, Room 402, Seattle, Washington 98104.
6. Filing with King County Council of : (1) one certified copy of your final resolution or
ordinance accomplishing this proposed action; and (2) a copy of this letter. This document
should be filed with the Clerk of the Council (Attn: Anne Noris), King County Courthouse,
Room 403, Seattle, Washington 98104.
