AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AMENDING ORDINANCE NO. 4300 ENTITLED "AN
ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
THE REZONING OF PROPERTY LOCATED SOUTHEASTERLY OF ORAVETZ
ROAD AND WESTERLY OF MILL POND DRIVE, WITHIN THE CITY OF
AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION
THEREOF FROM R-2 (SINGLE FAMILY) AND UNCLASSIFIED TO R-4 (MULTI-
FAMILY)", ADOPTED SEPTEMBER 6, 1988 TO PROVIDE CLARIFICATION
REGARDING THE REQUIREMENTS CONTAINED IN CONDITION 2 OF THE
REZONE APPROVAL.
WHEREAS, at a regular meeting of the Auburn City Council held
September 6, 1988 the Council adopted Ordinance No. 4300 approving the
rezoning of certain property southeasterly of Oravetz Road and westerly of Mill
Pond Drive from R-2 (single family) to R-4 (multi-family); and
WHEREAS, the City desires to amend and clarify Condition 2 of the Order
approving the rezone;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Purpose. The purpos~ of this Ordinance is to amend and
clarify Condition 2 of the Order approving the rezone of certain property located
southeasterly of Oravetz Road and westerly of Mill Pond Drive in Ordinance No.
4300 approved by the Auburn City Council September 6, 1988 as provided in
Exhibit "A" attached hereto and incorporated herein by this reference. All other

findings, conclusions, and conditions of Ordinance 4300 remain in full force and
effect except as provided and set forth in Exhibit "A".
Section 2. Constitutionality or Invalidity. If any section, subsection
clause or phase of this Ordinance is for any reason held to be invalid or
unconstitutional such invalidity unconstitutionality shall not affect the validity or
constitutionality of the remaining portions of this Ordinance, as it is being hereby
expressly declared that this Ordinance and each section, subsection, sentence,
clause and phrase hereof would have been prepared, proposed adopted and
approved and ratified irrespective of the fact that nay one or more section,
subsection, sentence, clause or phase be declared invalid or unconstitutional.
Section 3. Recordinu. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City of Auburn shall
cause this Ordinance to be recorded in the office of the King County Auditor.
Section4. Imolementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out the
directives of this legislation.
Section 5. Effective Date. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and publication, as
provided by law.

Condition No. 2: Nc For remaining undeveloped parcels subject to
this ordinance, some clearing or grading for construction of building
structures utilities, streets, and retaining walls ch:!! occur on slopes
exceeding 25% shall be allowed after review of the qeotechnical reports
required under Condition No. 1. Areas cleared to accommodate
construction but that are not built upon shall be re-vegetated. The slopes
are to be measured generally between each 25 foot contour. These slopes
shall be staked and identified as clearing limits to the satisfaction of the
Public Works Director prior to commencing on-site clearing or grading for
building construction activities.
