AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY
LOCATED AT THE SOUTH SIDE OF 8T" STREET AT "K" STREET NE WITHIN
THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING
CLASSIFICATION FROM R-2 (SINGLE FAMILY) TO I (INSTITUTIONAL).
WHEREAS, Application No. REZ00-0006 dated July 3, 2000, has been
submitted to the City of Auburn, Washington, by the City of Auburn — Public
Works Department requesting the rezoning of the real property located at the
South side of 81 Street at "K" Street NE from R-2 (Single Family) to I
m (Institutional) and hereinafter described below and as identified on Exhibit "A"

attached hereto and incorporated in this Ordinance by this reference; and
cv WHEREAS, said request above referred to the Hearing Examiner for
study and public hearing thereon; and

WHEREAS, the Hearing Examiner, based upon staff review, held a
public hearing to consider the request in the Council Chambers of Auburn City
Hall on October 17, 2000, at the conclusion of which the Hearing Examiner
recommended the approval of the rezoning of said property; and
WHEREAS, the City Council, on November 6, 2000, considered said
request and affirmed the Hearing Examiner's recommendation for rezone

based upon the following Findings of Fact and Conclusions of Law and
Decision, to -wit:
FINDINGS OF FACT
1. The City of Auburn has requested to rezone property from an existing
zoning classification of R-2, Single Family to a proposed "I", Institutional
zone. The property is located on the south side of 8" Street NE just south
of the intersection of 81" and "K" Streets NE. The property is 2.14 acres in
size.
2. The property has been in the City's ownership for some time. The City
would like to have the property zoned Institutional which allows government
facilities as a permitted use. It is the intent of the City to use the property
for storm drainage and public water uses. The City's immediate plan is to
;v construct a corrosion control treatment facility to improve the quality of
o drinking water that is now being pumped from adjacent wells.
3. The City's Comprehensive Land Use plan map illustrates the parcel as
Public/Quasi Public. The Institutional zone is an appropriate zone to
implement this designation. The proposed rezone is adjacent to Fulmer
Field which is a recreational facility owned by the City. It too is zoned
o Institutional. Residential uses are to the west and to the east are
residential uses and a large church.
4. The contents of the case file, #REZ00-0006, and the environmental file,
#SEP00-0033, of this project are hereby incorporated by reference and
made part of the record of this hearing.
CONCLUSIONS OF LAW
The undersigned has concluded that the rezone may be approved in that the
proposal is consistent with the Comprehensive Plan Map designations, zoning
and existing uses in the area.

DECISION
The undersigned has concluded that the rezone may be approved in that the
proposal is consistent with the Comprehensive Plan Map designations, zoning
and existing uses in the area.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Purpose. The above-cited Hearing Examiner's Findings of
Fact, Conclusions of Law and Decision, are herewith incorporated in this
Ordinance.
Section 2. The following property located at the south side of 8'"
Street NE just south of the intersection of 8`" and "K" Streets NE and identified

reference, in the City of Auburn, County of King, State of Washington, be and

the same is hereby rezoned from R-1, (Single Family) to I, (Institutional).
NSection 3. Severability. The provisions of this ordinance are declared
to be separate and severable. The invalidity of any clause, sentence,
paragraph, subdivision, section or portion of this ordinance, or the invalidity of
the application thereof to any person or circumstance shall not affect the validity
of the remainder of this ordinance, or the validity of its application to other
persons or circumstances.

Section 4. Recording. Upon the passage, approval and publication
of this Ordinance as provided by law, the City Clerk of the City of Auburn shall
cause this Ordinance to be recorded in the office of the King County Auditor,
Division of Records and Elections.
Section 5. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out
the directions of this legislation.
Section 6. Effective date. This Ordinance shall take effect and be in
force five days from and after its passage, approval and publication as provided
by law.
