AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, REPEALING AUBURN CITY CODE CHAPTER 3.64
ENTITLED "PURCHASING POLICY" AND CREATING AUBURN CITY CODE
CHAPTER 3.10 ENTITLED "PURCHASING POLICY."
WHEREAS, the current "Purchasing Policy" found in Auburn City Code
3.64 does not meet the needs of our City; and
WHEREAS, the City Council desires to repeal Auburn City Code Chapter
3.64 entitled "Purchasing Policy" located in Auburn City Code Chapter 3 entitled
"Revenue and Finance"; and
WHEREAS, the City Council desires to create Auburn City Code Chapter
3.10 for the purpose of creating a new "Purchasing Policy" for the City of
Auburn.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON DO ORDAIN AS FOLLOWS:
Section i. Purpose: The purpose of this Ordinance is to repeal
Auburn City Code Section 3.64 entitled "Purchasing Policy" as set forth in
Exhibit "A" attached hereto and incorporated herein and to create Auburn City
Code Section 3.10 entitled "Purchasing Policy" as set forth in Exhibit "B"
attached hereto and incorporated herin.

Section 2. Constitutionality or Invalidity: If any section, subsection,
clause, phrase, or sentence, of this Ordinance, is for any reason held to be
invalid or unconstitutional, such invalidity or unconstitutionality of the remaining
portions of this ordinance, as it is being hereby expressly declared that this
ordinance and each section, subsection, clause, phrase, or sentence, hereof
would have 'been prepared, proposed, adopted, and approved and ratified
irrespective of the fact that any one or more section, subsection, clause,
phrase, or sentence, be declared invalid or unconstitutional.
Section 3. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out
the directives of this legislation.
Section 4. Effective Date. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and publication, as
provided by law.

3.64.010 Purchase order.
All purchases of city goods and ~crviccs in excess of $:~00.00 shall bc made only
after a purcha~ order has been duly authorized and approvcd, and any ordering
of goods or services in cxccss of $100.00 shall bc placed only after a validated
purchasc order has bccn received by the department. (Ord. 3981 § 1, 1984.)
3.64.020 Expenditure limits.
The following expenditure limits and authorization approvals shall apply for all
cxpcnditurcs of municipal goods and scrviccs. For purchascs up to
authority rests at the department or division Icvcl. All purcha~cs over $1,000
require mayoral approval prior to purcha~ order i~uancc, or placement of an
ordcr with vcndors. For all unbudgcted items not individually and scparatcly
listed in thc city's annual budget in cxccss of $7,500, approval shall bc obtained
from the mayor, the appropriatc council committee and the city council. Such
committee approval shall bc rcfiected in the committee minutes. (Ord. 3981 § 2,

All purchaser of city goods and services in excess of $:[00.00 shall be made only
after a purchase order has been duly authorized and approved, and any ordering
of goods or services in excess of $:[00.00 shall be placed only after a validated
purchase order has been received by the department. (Ord. 398:[ § :[, :[984.)
3.10.020 Expenditure limits.
The following expenditure limits and authorization approvals shall apply for all
expenditures of municipal goods and services. For purchases up to $5,000,
authority rests at the department director level. All purchases over $5,000
require mayoral approval prior to purchase order issuance, or placement of an
order with vendors. For all unbudgeted items not individually and separately
listed in the city's annual budget in excess of $25,000, approval shall be obtained
from the mayor, the appropriate council committee and the city council. Such
committee approval shall be reflected in the committee minutes. (Ord. 3981 § 2,

3.:[0.025 Professional and Personal Services.
Professional and personal services are those services involving specialized skill,
education, and special knowledge. These services include, but are not limited to,
architectural, engineering, design services, accounting art, real estate appraisal,
relocation assistance, title abstracts, surveying, soils analysis, and core testing.
A competitive process is not required for professional or personal services, other
than professional engineering or architectural services for the design of City
improvements as required by Auburn City Code 3.:[4.
Procurement and administration of such contracts are the responsibility of the
Mayor or the department director. The Ivlayor/designees may sign professional
or personal service contracts where sufficient funding exists in the annual budget
for an amount up to $25,000. Contracts over $25,000 require Council action.

3.10.028 Approval by Council Committee of asset and/or system expansions,
additions, and betterments
Asset and/or system expansions, additions, and betterments that have been
recognized as authorized capital projects in the annual budget shall be reviewed
by the appropriate council committee when the project is either formally initiated
or expenses in the aggregate have exceeded $200,000.
3.10.029 Competitive Negotiations
Competitive negotiations can be used as an alternative to the competitive
bidding procedures for the acquisition of electronic data processing and
telecommunications systems; energy saving or energy related equipment or
services; or when it is determined in writing that the use of competitive bidding
is neither practicable nor advantageous to the City of Auburn
"Electronic data processing" includes, but is not limited to, systems which
comprise a combination of equipment or units to provide input of source data,
and storage and processing of data and output in predetermined form, including
a central processing unit(CPU) or main frame.
3.10.030 Administrative procedures authority.
The mayor is authorized to implement such administrative procedures as may be
necessary to carry out the directions of this legislation. (Ord. 3981 § 3, 1984.)
