Assessor Tax # not yet assigned \1 ORDINANCE NO.5 5 0 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, AMENDING ORDINANCE NO. 5487 ENTITLED "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN ANNEXING TO THE CITY A 40 ACRE PARCEL OF LAND KNOWN AS THE "P-4" PARK PROPERTY FOR MUNICIPAL PURPOSES", ADOPTED DECEMBER 18, 2000 TO PROVIDE THE CORRECT LEGAL DESCRIPTION. WHEREAS, at a regular meeting of the Auburn City Council held December 18, 2000, the Council adopted Ordinance 5487 approving the annexing of a 40 Acre parcel of land known as the "P-4" Park Property to the City or Municipal Purposes; and WHEREAS, THE City desires to correct the property legal description. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Purpose. To amend Ordinance 5487 to correct the legal description of the property annexed. The corrected legal description is set forth in Exhibit "A" which is attached hereto and incorporated herein by this reference. Section 2. Constitutionality or Invalidity. If any section, subsection clause or phase of this Ordinance is for any reason held to be invalid or unconstitutional such invalidity unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it is being Ordinance No. 5501 January 10, 2001 Page 1 hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed adopted and approved and ratified irrespective of the fact that nay one or more section, subsection, sentence, clause or phase be declared invalid or unconstitutional. Section 3. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the direction of this legislation. Section 4. Within ten (10) days after the effective date of the annexation referred to in this ordinance, the City Clerk of the City of Auburn shall send to the Office of the Clerk of the County Council one (1) certified copy of this Ordinance together with a copy of a letter from the Executive Secretary of the Pierce County Boundary Review Board, which letter contains a copy of the decision of the Boundary Review Board relating to this annexation. Section 5. Recording. The City Clerk of the City of Auburn shall record a certified copy of this Ordinance with the Pierce County Auditor's Office. Section 6. Effective Date. This Ordinance shall take effect and be in force five (5) days from and after passage, approval, and publication as provided by law.
