AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ANNEXING TO
THE CITY A 415 ACRE PARCEL OF LAND LOCATED IN PIERCE COUNTY
AND KNOWN AS THE LAKELAND PHASE II ANNEXATION WHICH IS
LOCATED GENERALLY SOUTH OF THE KING/PIERCE COUNTY LINE AND
EASTERLY OF THE EAST VALLEY HIGHWAY.
WHEREAS, in accordance with Chapter 35A.14 RCW, the owners of
more than 60% percent of value according to the assessed valuation for
general taxation of certain lands in Pierce County, Washington, and more
particularly described in Section 1 of this Ordinance, filed their petition with the
City Council of the City of Auburn, Washington, petitioning to have annexed to
the City of Auburn the said described land; and
WHEREAS, in accordance with Chapter 35A.14 RCW various
proceedings were held; and
WHEREAS, the Pierce County Assessor's Office on November 6, 2000
certified that aforesaid petition contained the signatures of those property
owners having an assessed valuation of more than sixty (60) percent of the
assessed valuation of the annexation area; and
WHEREAS, the notice of intention to annex was officially filed with the
Pierce County Boundary Review Board on December 20, 2000; and

WHEREAS, the Pierce County Boundary Review Board did not receive a
request to invoke jurisdiction and therefor the annexation became effective
February 6, 2001; and
WHEREAS, it appears to the City of Auburn, that said annexation meets
the requirements specified by law; the procedure for the filing with the City of
Auburn by the requisite number of property owners of their notice of intention to
commence annexation proceedings, to and including the consideration of the
passage of this ordinance also meets the requirements, specified by law; and
the lands proposed to be annexed are contiguous to the City of Auburn and
have not heretofore been incorporated in as a City or Town;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Purpose. That there shall be annexed to the City of Auburn,

Washington, the property situated in the County of Pierce, State of
Washington, legally described as attached as Exhibit "A".
Section 2. That the property hereby annexed shall be assessed and
taxed at the same rate and on the same basis as other property within the City
of Auburn is assessed and taxed to pay for any outstanding general
indebtedness of the City to which the area was annexed.

Section 3. Constitutionality or Invalidity. If any section, subsection
clause or phase of this Ordinance is for any reason held to be invalid or
unconstitutional such invalidity unconstitutionality shall not affect the validity or
constitutionality of the remaining portions of this Ordinance, as it is being
hereby expressly declared that this Ordinance and each section, subsection,
sentence, clause and phrase hereof would have been prepared, proposed
adopted and approved and ratified irrespective of the fact that nay one or more
section, subsection, sentence, clause or phase be declared invalid or
unconstitutional.
Section 4. Within ten (10) days after the effective date of the
annexation referred to in this ordinance, the City Clerk of the City of Auburn
shall send to the Office of the Clerk of the County Council one (1) certified copy
of this Ordinance together with a copy of a letter from the Executive Secretary
of the Pierce County Boundary Review Board, which letter contains a copy of
the decision of the Boundary Review Board relating to this annexation.
Section 5. Recording. The City Clerk of the City of Auburn shall record
a certified copy of this Ordinance with the Pierce County Auditor's Office.
Section 6. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out
the directions of this legislation.

Section 7. Effective Date. This Ordinance shall take effect and be in
force five days from and after its passage, approval and publication as provided
by law.
