AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE ACCEPTANCE AND APPROPRIATION
OF GRANT FUNDS IN THE AMOUNT OF TWELVE THOUSAND FIVE
HUNDRED DOLLARS ($12,500), AND AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN KING
COUNTY AND THE CITY OF AUBURN TO ACCEPT SAID FUNDS FOR
IMPLEMENTATION OF THE 2001 CITY OPTIONAL PROGRAM AND WASTE
REDUCTION AND RECYCLING GRANT PROGRAM.
WHEREAS, King County and the City of Auburn have adopted the King
County Solid Waste Management Plan, which includes recycling and waste
reduction goals; and
WHEREAS, in order to help meet these goals, the King County Solid
Waste Division has established a multi-phased waste reduction and recycling
grant program for the suburban cities; and
WHEREAS, this program provides funding to further the development of
local waste reduction and recycling for Auburn businesses; and
WHEREAS, the Auburn City Council of the City of Auburn must adopt
and approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW;
and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. Pursuant to Chapter 35A.33 RCW, the City hereby approves
the expenditure and appropriation of a total amount of TWELVE THOUSAND
FIVE HUNDRED DOLLARS ($12,500) which constitutes reimbursement of
funds for implementing the 2001 City Optional Program and Waste Reduction
and Recycling Grant Program.
Section 2. The Mayor and City Clerk of the City of Auburn are
authorized to execute an Interlocal Agreement with King County for the
reimbursement of said funds. A copy of said Agreement is attached hereto and
designated Exhibit "A" and is incorporated by reference herein.
Section 3. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out directions of the
legislation.
Section 4. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.

INTERLOCAL AGREEMENT
Between
KING COUNTY and the CITY OF AUBURN
This Interlocal Agreement (hereinafter referred to as the Agreement) is executed between King County, a
political subdivision of the State of Washington, and the City of Auburn, a municipal corporation of the
State of Washington, hereinafter referred to as "County" and "City" respectively.
This Agreement has been authorized by the legislative body of each party as designated below:

PREAMBLE
King County and the City of Auburn adopted the King County Comprehensive Solid Waste Management
Plan, which includes recycling and waste reduction goals. In order to help meet these goals, the King
County Solid Waste Division has established the City Optional Program and a waste reduction and
recycling grant program for the cities in King County.
The City Optional Program funds projects that enable citizens to recycle materials which are not included in
curbside collection programs and provides funds for cities to establish and maintain Business Waste
Reduction and Recycling Programs and services. The City will spend its grant funds to fulfill the terms and
conditions set forth in the scope of work that is attached hereto as Exhibit A, and incorporated herein by
reference.
The waste reduction and recycling grant program provides funding to further the development and/or
enhancement of local waste reduction and recycling projects. Funding is available to all King County cities
that operate under the King County Comprehensive Solid Waste Management Plan. The City will also
spend its grant funds from this program to fulfill aspects of the scope of work that is attached hereto as
Exhibit A.
I. PURPOSE
The purpose of this Agreement is to define the terms and conditions for funding to be provided to the City
of Auburn from the County for the operation of a Business Waste Reduction and Recycling Program and
for the implementation of other waste reduction and recycling programs/projects as outlined in the scope of
work and budget attached as Exhibit A.

II. RESPONSIBILITIES OF THE PARTIES
The responsibilities of the parties to this Agreement shall be as follows:
A. The Ci
General Provisions
1. Funds provided to the City by the County pursuant to this Agreement shall be used to provide waste
reduction and recycling programs and/or services as outlined in the scope of work and budget
attached hereto as Exhibit A.
2. The City will submit written reports to the County in a format specified by the County. These
reports will include: a) a description of each activity accomplished as pertains to the scope of work;
and b) reimbursement requests with copies of invoices and statements for each expenditure for
which reimbursement is requested.
At a minimum, such reports shall be submitted to the County semiannually for the six-month
periods from January through June and July through December. The reports will be due by
August 1 and January 15 respectively. If the City is still undertaking aspects of its scope of work
and there has been no grant activity during any given six-month period, the City will notify the
County, in writing, to that effect by the applicable due date.
The City may, at its discretion, submit up to two additional reimbursement requests annually. Any
such reimbursement requests submitted to the County will be accompanied by written reports as
specified above.
3. The City will submit a final report to the County that summarizes the work completed under the
grant program and evaluates the effectiveness of the projects for which grant funds were utilized,
according to the evaluation methods specified in the scope of work. The final report is due within
six months of completion of the project(s) outlined in the scope of work, but no later than
June 30, 2002.
4. The City shall be responsible for following all applicable Federal, State and King County laws, rules
and regulations in the performance of work described herein. The City assures that its procedures
are consistent with laws relating to public contract bidding procedures, and the County neither
incurs nor assumes any responsibility for the City's bid, award or contracting process.
5. During the performance of this Agreement, neither the City nor any party subcontracting under the
authority of this Agreement shall discriminate on the basis of race, color, sex, religion, nationality,
creed, marital status, sexual orientation, age, or presence of any sensory, mental, or physical
handicap in the employment or application for employment or in the administration or delivery of or
access to services or any other benefits under this Agreement as defined by King County Code,
Chapter 12.16.

6. During the performance of this Agreement, neither the City nor any party subcontracting under the
authority of this Agreement shall engage in unfair employment practices as defined by King County
Code, Chapter 12.18. The City shall comply fully with all applicable federal, state and local laws,
ordinances, executive orders and regulations that prohibit such discrimination. These laws include,
but are not limited to, RCW Chapter 49.60 and Titles VI and VII of the Civil Rights Act of 1964.
7. The City shall use recycled paper for the production of all printed and photocopied documents
related to the fulfillment of this Agreement. The City shall use both sides of paper sheets for
copying and printing and shall use recycled/recyclable products wherever practical.
8. The City shall maintain accounts of the direct and indirect costs of the programs covered in this
Agreement for a period of at least six years. These accounts shall be subject to inspection, review or
audit by the County and/or by federal or state officials so authorized by law.
9. The City agrees to credit King County on all printed materials provided by the County which the
City is duplicating for distribution. Either King County's name and logo must appear on King
County materials (including fact sheets, case studies, etc.), or, at a minimum, the City will credit
King County for artwork or text provided by the County as follows: "artwork provided courtesy of
King County Solid Waste Division" and/or "text provided courtesy of King County Solid Waste
Division".
10. The City agrees to submit to the County copies of all written materials which it produces and/or
duplicates for its waste reduction and recycling programs/projects which have been funded through
the City Optional Program and the County's waste reduction and recycling grant program. Upon
request, the City agrees to provide the County with a reproducible copy of any such written
materials and authorizes the County to duplicate and distribute any written materials so produced,
provided that the County credits the City for the piece(s).
11. This project shall be administered by Sharon Conroy, Solid Waste Supervisor, and Jennifer Gregg,
Recycling Coordinator, at City of Auburn, 1305 C Street Southeast, Auburn, Washington, 98001, or
designee.
Business Waste Reduction and Recycling Program Provisions
12. For aspects of the scope of work that will be funded by the City Optional Program, the City agrees
to the following: a) to promote business recycling services; b) to provide assistance to businesses
within City limits to establish and expand their recycling, waste prevention, and buy recycled
programs as described in Exhibit A; and c) to work towards minimum service levels for urban areas
as defined in the 1992 King County Comprehensive Solid Waste Management Plan on pages III-41
and 42.
13. The City will cooperate with the County to coordinate its efforts with County programs. To
facilitate cooperation, meetings may be scheduled between the County, the City, and other cities that
are participating in the Business Recycling City Optional Program. The County will coordinate any
such meetings and cities participating in the Business Recycling City Optional Program will be
given an opportunity to assist in the coordination of such meetings. Any such meetings will be held
to share information about Business Waste Reduction and Recycling Programs, to coordinate
assistance and programs, and to plan for 2002.

B. County: The responsibilities of the County pursuant to this Agreement are as follows:
General Provisions
1. The County shall administer funding for the grant programs. The amount of King County funds to
be distributed to the City is $12,500.00. King County funding is based on the following:
a. The total amount of King County funds budgeted for Business Waste Reduction and Recycling
Programs through the City Optional Program, which is allocated on the basis of the number of
employees within each city. The City of Auburn will be utilizing $5,500.00 of its budgeted
allocation for business recycling through this grant program in 2001.
b. The current amount of King County funds budgeted for the waste reduction and recycling grant
program, which is designated by city and is distributed on a per capita basis. The City of
Auburn will be utilizing $7,000.00 of its budgeted grant funds through this grant program.
2. Within forty-five (45) days of receiving a request for reimbursement from the City, the County shall
either notify the City of any exceptions to the request that have been identified or shall process the
request for payment. If any exceptions to the request are made, this shall be done by written
notification to the City providing the reason for such exception. The County will not authorize
payment(s) for activities and/or expenditures which were not included in the scope of work and
budget attached as Exhibit A, unless the scopes have been amended according to Section V of this
Agreement. King County retains the right to withhold all or partial payment if the City's report(s)
and reimbursement request(s) are incomplete (i.e., do not include proper documentation of
expenditures and/or adequate description of each activity described in the scope of work for which
reimbursement is being requested), and/or are not consistent with the scope of work and budget
attached as Exhibit A.
3. The County agrees to credit the City on all printed materials provided by the City to the County
which the County duplicates for distribution. Either the City's name and logo will appear on such
materials (including fact sheets, case studies, etc.), or, at a minimum, the County will credit the City
for artwork or text provided by the City as follows: "artwork provided courtesy of the City of
Auburn" and/or "text provided courtesy of the City of Auburn."
4. The County retains the right to share the written materials produced by the City, which have been
funded through this program, with other King County cities for duplication and distribution. The
County will encourage other cities to credit the City on any pieces that were originally produced by
the City.
5. The waste reduction and recycling grant program shall be administered by Lyne Morris, Project
Manager, or designee, specified by the King County Solid Waste Division. The Business Waste
Reduction and Recycling Program shall be administered by Dale Alekel, Project Manager, or
designee, specified by the King County Solid Waste Division.

Business Waste Reduction and Recycling Program Provisions
6. The County will not provide technical assistance services to individual businesses within the
corporate limits of the City unless such assistance is an integral part of a County targeted
commodity or targeted industry program and unless such assistance is undertaken in cooperation
with the City. The City shall be eligible for any regional business services offered by the County that
are outside the category of technical assistance.
7. The County will share the results of previous business audits and/or follow up surveys conducted
within the City limits (and any printed materials such as case studies that the City wishes to use in
its own programs). The County will provide information about existing Green Works members
located within the City limits. The County will also provide its quarterly newsletter production
schedule to the City in the event that the City wishes to publish a quarterly insert for distribution to
the businesses in the City.
III. DURATION OF AGREEMENT
This Agreement shall become effective on January 1, 2001 and shall terminate on December 31, 2001.
IV. TERMINATION
A. This Agreement may be terminated by King County, in whole or in part, for convenience without cause
prior to the termination date specified in Section III upon thirty (30) days advance written notice.
B. This Agreement may be terminated by either party, in whole or in part, for cause prior to the
termination date specified in Section III, upon thirty (30) days advance written notice. Reasons for
termination for cause may include but not be limited to: nonperformance, misuse of funds, failure to
provide grant related reports/invoices as specified in Section II. A. 10 and Section II. A. 14.
C. If the Agreement is terminated as provided in this section: (1) the County will be liable only for
payment in accordance with the terms of this Agreement for services rendered prior to the effective
date of termination; and (2) the City shall be released from any obligation to provide further services
pursuant to this Agreement.
D. Nothing herein shall limit, waive, or extinguish any right or remedy provided by this Agreement or law
that either party may have in the event that the obligations, terms and conditions set forth in this
Agreement are breached by the other party.
V. AMENDMENTS
This Agreement may be amended only by written Agreement of both parties. Funds may be moved
between tasks in the scope of work, attached as Exhibit A, only upon written or verbal request by the City
and written or verbal approval by King County. Such requests will only be approved if the proposed
change(s) is (are) consistent with and/or achieves the goals stated in the scope and falls within the activities
described in the scope.

VI. HOLD HARMLESS AND INDEMNIFICATION
The City shall protect, indemnify, and hold harmless the County, its officers, agents, and employees from
and against any and all claims, costs, and/or issues whatsoever occurring from actions by the City and/or its
subcontractors pursuant to this Agreement. The City shall defend at its own expense any and all claims,
demands, suits, penalties, losses, damages, or costs of any kind whatsoever (hereinafter "claims") brought
against the County arising out of or incident to the City's execution of, performance of or failure to perform
this Agreement. Claims shall include but not be limited to assertions that the use or transfer of any
software, book, document, report, film, tape, or sound reproduction or material of any kind, delivered
hereunder, constitutes an infringement of any copyright, patent, trademark, trade name, and/or otherwise
results in unfair trade practice.
VII. INSURANCE
A. The City, at its own cost, shall procure by the date of execution of this Agreement and maintain for the
duration of the Agreement, insurance against claims for injuries to persons or damages to property
which may arise from or in connection with performance of work pursuant to this Agreement by the
City, its agents, representatives, employees, and/or subcontractors. The minimum limits of this
insurance shall be $1,000,000 general liability insurance combined single limit per occurrence for
bodily injury, personal injury, and property damage. Any deductible or self-insured retentions shall be
the sole responsibility of the City. Such insurance shall cover the County, its officers, officials,
employees, and agents as additional insureds against liability arising out of activities performed by or
on behalf of the City pursuant to this Agreement. A valid Certificate of Insurance is attached to this
Agreement as Exhibit B, unless Section VII. B. applies.
B. If the Agency is a Municipal Corporation or an agency of the State of Washington and is self-insured for
any of the above insurance requirements, a written acknowledgement of self-insurance is attached to this
Agreement as Exhibit B.
VIII. ENTIRE CONTRACT/WAIVER OF DEFAULT
This Agreement is the complete expression of the agreement of the County and City hereto, and any oral or
written representations or understandings not incorporated herein are excluded. Waiver of any default shall
not be deemed to be a waiver of any subsequent default. Waiver of breach of any provision of this
Agreement shall not be deemed to be waiver of any other or subsequent breach and shall not be construed
to be a modification of the terms of this Agreement unless stated to be such through written approval by the
County, which shall be attached to the original Agreement.
IX. TIME IS OF THE ESSENCE
The County and the City recognize that time is of the essence in the performance of this Agreement.

X. SEVERABILITY
If any section, subsection, sentence, clause or phase of this Agreement is, for any reason, found to be
unconstitutional or otherwise invalid by a court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions.
XI. NOTICE
IN WITNESS WHEREOF this Agreement has been executed by each party on the date set forth below:

B. SCOPE OF WORK
1. Task One:Commercial Waste Prevention and Recycling Project: Non-Residential
Recycling Program
a. Project manager: Auburn's Recycling Program Specialist, under the supervision of the
Solid Waste Supervisor will implement these activities. The Recycling Specialist and
Solid Waste Supervisor positions are both fully funded by the City of Auburn.
b. Schedule: January 1", 2001 - December 31, 2001.
c. Goals: The City of Auburn Business Recycling Program has set several ambitious
goals for 2001.
• Provide technical assistance to businesses.
• Increase awareness of Auburn's Business Recycling Program through delivery of a
quarterly newsletter.
Utilize year 2000 survey results to accurately serve the business population.
Advertise quarterly in the Auburn Chamber of Commerce newsletter and become
more involved with meetings and luncheons held by the Chamber. Advertise twice
yearly in the Auburn Reporter and South County Journal businesses that are using
waste reduction and recycling methods.
d. Program Specifics
1. Background - Auburn's business sector, which generates 70 percent of Auburn's
total solid waste stream, has been participating in Auburn's Business Recycling
Program at an increasing rate. With the help of 1995 and 1996 COP Grant funds, the
City of Auburn Business Recycling Program has made significant progress. In the first
eight months of 1995, nearly 300 Auburn businesses implemented new recycling
programs. Auburn did not apply for the 1997 - 1999 City Optional Grants due to staff
changes. Yet the City sees the strong need to address the businesses in Auburn, as they
produce the greatest percentage of waste. 2000 Grant funds were used to assess the
business community's needs and to re-familiarize Auburn businesses with The City of
Auburn Solid Waste Division services.
2. Program Description: The activities fall into three groups:
a) Providing technical assistance.
b) Delivery of quarterly newsletters to the business community.
c) Advertising in the South County Journal, Auburn Reporter, and Chamber of
Commerce Newsletter.
Providing technical assistance to businesses
The City of Auburn will provide information and technical assistance to any Aubum
business that requests help with waste reduction and recycling. The City will also target
companies with utility bill inserts and direct mailers. To do this, Auburn's Recycling
Specialist will conduct the following tasks:
Subtask One: Conduct waste audits and/or site visits to approximately 40 businesses.
Provide each business visited with resource materials developed by the City and
information about the County Green Works Recognition Program. Assist businesses in
reducing waste, downsizing garbage and adding recycling service.
Subtask Two: Businesses will be called two weeks after a site-visit to provide
recommendations on how to set up or improve their recycling and/or waste reduction
program(s).
This program is in keeping with the 1992 King County Comprehensive
Plan goal of `promoting services to all targeted businesses'.
Deliver quarterly newsletter to the Business Community
The City of Auburn will produce the "4 R Business" quarterly newsletter and insert this
into the County's `Recycling Works' newsletter. The business newsletter is intended to
generate interest in Auburn's Business Recycling Program, available educational
materials and free recycling technical assistance. In addition, the newsletter will
educate Auburn businesses about the benefits of participating in waste prevention and
recycling.
This fits with 1992 King County Comprehensive Plan goals of
providing information to the business community, promoting services,
and encouraging buy-back center use.
Advertising in the South County Journal, Auburn Reporter, and
Chamber of Commerce Newsletter.
Auburn businesses will be selected for their progressive waste
reduction and recycling methods, then advertised in the
Auburn Reporter, South County Journal, and Auburn Chamber of
Commerce Newsletter. Auburn businesses that have qualified as
Green Works, EnviroStars or Construction Works members are good
candidates for this advertising effort. This fits with the goal of
promoting business community members who recycle and reduce and
advertising services to businesses, as mentioned in the 1992 King
County Comprehensive Plan.
3. Deliverables - The deliverables for each project are listed below:
Providing technical assistance to businesses: The deliverable of this activity will be
listings of the businesses contacted, number contacted, number needing additional
recycling information, and number of businesses who add waste reduction and recycling
programs and/or apply for the Green Works program. The printed outreach brochures
mailed to businesses will also be provided.
Delivery of quarterly newsletter: The printed and delivered newsletters
will be the deliverable.
Advertising in the South County Journal Auburn Reporter, and Chamber of Commerce
Newsletter: The advertisements created and put in the papers will be the deliverable.
4. Expected Outcomes/ Impacts
Technical assistance to businesses: By offering additional assistance, the City expects to
have more businesses signed up for recycling service and to increase the commercial
recycling rate in the City.
Quarterly newsletter delivery: The business newsletter is intended to generate interest in
Auburn's Business Recycling Program, available educational materials and free
recycling technical assistance. In addition, the newsletter will aim to educate Auburn
businesses about the benefits of participating in waste prevention and recycling
activities. The City will expect increased volumes of calls for business assistance.
Advertising in the South County Journal Auburn Reporter and Chamber of Commerce
Newsletter: The expected outcome is increased awareness of business recycling services
and award recognition programs available to King County/Auburn businesses.
e. Evaluation
1. Providing technical assistance to businesses
Measurement will be assessed by counting the number of businesses contacted, the
number needing additional recycling information or resources, and the amount who add
waste reduction and recycling programs to their businesses. This will most likely be
provided in a spreadsheet format.
2. Delivery of a quarterly newsletter
Evaluation on this activity will be conducted by running periodic fax-back/mail-in
surveys in the newsletter. These survey responses will be provided within the annual
report to the County.
3. Advertising in the South County Journal, Auburn Reporter, and Chamber of
Commerce Newsletter:
Calls received will be monitored. Businesses will be asked where they heard about the
services to assess if advertising is effective.

a. Project manager: These activities will be implemented by Auburn's Recycling Program

Inform Auburn residents about residential recycling options through utilization of
displays.
Provide increased environmental education to schools in the Auburn School District.
Enhance resident's knowledge of grasscycling through the Regional Grasscycling
Campaign.
d. Program Specifics
1. Background - The City of Auburn recognizes the importance of educating residents
about different methods of waste reduction and recycling. The City's school programs
have been in effect since the early 1980's. Teachers in the Auburn School District value
the presentations and the information provided to the students. Students at many
different schools have now come to be acquainted with the "Recycle Bug" and the
"Recycling People from the City of Auburn".
2. Program/ Project Description
To inform residents about residential recycling` options.
The City will purchase or produce displays to place in common City areas that will
show different methods for recycling household items. City staff will also prepare
materials and coordinate efforts to have a presence at major events, such as fairs in
Auburn.
To provide increased environmental education to the Auburn School
District.
City Staff will continue to present material to both elementary and middle school
classrooms. The City will provide a brochure on all available programs to the teachers
at each school as well as District Administrators. Staff will also promote school
programs provided by the King County Solid Waste Division. City Staff will have
increased presence at all major elementary schools during the City's Annual Spring
Clean-up Campaign. As part of this campaign, the City will hire performers to conduct
assemblies or classroom presentations at 3 elementary schools in the Auburn city limits
to kick-off this campaign and gather interest in recycling presentations.
Participation in region-wide Grasscycling Campaign.
City staff will allocate a portion of the City's grant funding to the Regional Grasscycling
Campaign.
3. Deliverables
• Design information and pictures of display exhibits built or purchased.
• A brochure explaining the City of Auburn's school presentations sent to all teachers
in the Auburn School District.

4. Expected Outcomes/ Impacts
To inform Auburn residents about residential recycling options.
By purchasing or producing displays to place in common City areas, the City expects
increased participation in the City's recycling program and an increased volume of calls
related to the program.
With the presence of City staff and prepared materials at major City events, the City
hopes to promote an increase in the residential recycling rate and expects an influx of
calls from the public regarding the program.
To provide increased environmental education to the Auburn School District
Participation with the Auburn School District on recycling education will increase the
waste diverted to the Annual Spring Clean-up campaign. In addition, educated children
will be expected to have an influence on their parents' decisions and behaviors.
Participation in region-wide Grasscyclin Campaign
Auburn citizens will be able to participate in the regional grasscycling program and
learn how to reduce this type of yard waste.
e. Evaluation
Displays and Major Events in Auburn
To evaluate the displays, the City will monitor calls from residents to find out where
they heard of the city services. To evaluate presence at local events, the City will simply
count the number of people who were exposed to the information (how many show up).
Increased environmental education to the schools
Evaluation of this task will be accomplished by comparing the number of students
participating in Spring Clean-up activities in 2001 as compared to 2000, as well as
counting the number of teachers requesting presentations in their classrooms (Teachers
will be given brochures so that they may choose presentations).

The above captioned entity is a member of the Washington Cities Insurance Authority
(WCIA), which is a self insured pool of over 99 municipal corporations in the State of
Washington.
WCIA has at least $1 million per occurrence combined single limit of liability coverage
in its self insured layer that may be applicable in the event an incident occurs that is
deemed to be attributed to the negligence of the member.
WCIA is an Interlocal Agreement among municipalities and liability is completely self
funded by the membership. As there is no insurance policy involved and WCIA is not
an insurance company, your organization cannot be named as an "additional insured'.
