AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AMENDING AUBURN CITY CODE CHAPTER 17.12
ENTITLED "SUBDIVISION IMPROVEMENTS" BY AMENDING SECTIONS
17.12.170 ENTITLED "PRIVATE STREETS AND ACCESS EASEMENTS"
AND SECTION 17.12.250 "LOT REQUIREMENTS" TO PROVIDE
CLARIFICATION REGARDING PRIVATE ACCESS TRACTS.
WHEREAS, the City desires to amend Auburn City Code Section
17.12.170 entitled "Private Streets and Access Easements" and Section
17.12.250 entitled "Lot Requirements" contained in Chapter 17.12 Entitled
"Subdivision Improvements" to provide clarification regarding private access
tracts.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. PURPOSE: The purpose of this ordinance is to amend
Auburn City Code Section 17.12.170 entitled "Private Streets and Access
Easements" and Section 17.12.250 entitled "Lot Requirements" contained in
Chapter 17.12 entitled "Subdivision Improvements", as set forth in Exhibit "A"
attached hereto and incorporated herein by this reference to provide
clarification regarding private access tracts.
Section 2. CONSTITUTIONALITY OR INVALIDITY: If any section,
subsection, clause, phrase, or senter~ce, of this Ordinance, is for any reason

held to be invalid or unconstitutional, such invalidity or unconstitutionality of the
remaining portions of this ordinance, as it is being hereby expressly declared
that this ordinance and each section, subsection, clause, phrase, or sentence,
hereof would have been prepared, proposed, adopted, and approved and
ratified irrespective of the fact that any one or more section, subsection, clause,
~hrase, or sentence, be declared invalid or unconstitutional.
Section 3. Implementation. The Mayor is hereby authorized to
~mplement such administrative procedures as may be necessary to carry out
the directions of this legislation.
Section 4. Effective date. This ordinance shall take effect and be in
force five (5) days from and after its passage, approval, and publication, as
provided by law.

17.12.170 Private streets and Laccess tracts or easements.
Private streets, and access tracts or easements may be used as a means of
providing add!tiona! or :ocondary access to a lot or lots. The construction of the
private streets shall be in conformance with section 2.05 of the city of Auburn
design and construction standards and lhe construction of the access tracts
shall be in conformance with section 18.48.130 of the Auburn Zonin.q Codn.
17.12.250 Lot requirements.
A. The area, width and depth of lots shall conform to the requirements of the
zoning ordinance. The area within a "panhandle" access to a lot shall not be
considered for the purpose of determining conformance with lot requirements.
B. The size, shape and orientation of lots shall be appropriate for the location,
topography and other natural features of the site and for the type of
development contemplated.
C. Every lot shall have a minimum of 20 feet of frontage on an improved public
street or private access tract, unless otherwise approved by this title.
D. Corner lots designated for residential uses shall be platted at least five feet
wider than required by the zoning ordinance.
E. Every lot shall border on an opened, improved and maintained public street
or private access tract.
F. For single-family residential lots fronting on arterials provisions shall be made for
service drives in front or access provided to a secondary street or private access
tract.
G. The side lot lines of each lot, which if extended would intersect with the curb,
shall be marked on the curb as per the city engineer's standard detail.
