AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AN AGREEMENT WITH HIGHLINE COMMUNITY COLLEGE'S
DISABILITY GRANTS AND COMMUNITY PLANNING DEPARTMENT TO
PROVIDE A FULL-TIME INSTRUCTOR ON A QUARTER-TO-QUARTER
BASIS TO SUPPORT AND ENRICH THE CITY OF AUBURN SPECIALIZED
RECREATION PROGRAM.
WHEREAS, the Auburn Parks and Recreation Department solicited
participation in the Highline Community College Disability Grants and
Community Planning Department's program to provide an instructor for our
Specialized Recreation Program; and
WHEREAS, acceptance of the Agreement will benefit the Auburn
participants in our Specialized Recreation Program; and
WHEREAS, the City Council of the City of Auburn must adopt and
approve all funding Agreements; and
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON DOES ORDAIN AS FOLLOWS:
Section 1, The City Council hereby approves acceptance of the
Agreement with Highline Community College's Disability Grants and
Community Planning Department to provide an instructor for our Specialized
Recreation Program.

~ The instructor will be an employee of Highline Community
College and will be directly supervised by the City of Auburn Parks and
Recreation Specialized Recreation Coordinator.'
Section 3, The instructor will support existing Specialized Recreation
programs and will create new opportunities for quality social, recreational, and
educational experiences for disabled individuals in the Auburn community.
Section 4, The Mayor and City Clerk of the City of Auburn are hereby
authorized to execute the Agreement, which is attached and designated Exhibit
A and which is incorporated herein by this reference.

AGREEMENT
THIS AGREEMENT is made between Highline Community College (~Highline"),
an entity of the State of Washington and Auburn Parks and Recreation, City of
Auburn of the State of Washington for the contract period July 2, 2001 to June 3,
2002.
WHEREAS, Highline Community College and the City of Auburn desire to form a
collaborative relationship whereby, educational, vocational and inclusionary
community services are provided to all individuals.
Program Needs Statement:
All individuals, regardless of disability, should have equal opportunities to access
resources available in their community. In order to better serve the citizens of
Auburn, we need to provide quality social, recreational, and educational
experiences to the entire community. Only by implementing and facilitating
inclusion of individuals with special needs into existing and new community
recreation programs, can we gain the support for a more inclusive environment in
the future. Individuals are as diverse as their individual disabilities, and by being
aware of these differences, we can better serve and provide for their individual
needs.
Highline Community College agrees to:
1. Provide one (1) instructor resource on a quarter- to -quarter basis to
support and enrich existing Specialized Recreation Programs and
opportunities.
2. Expand and create new programs in partnership with the City of Auburn.
3. Explore opportunities for individuals with developmental disabilities to
volunteer or otherwise contribute through volunteer or paid employment
within the Auburn Community.
4. Enhance cultural arts experiences in music, art, dance and theatre.
5. Provide exposure to educational and daily living activities and trainings
available to the general community.
6. Aid in smooth transitions from specialized programs to community
inclusion programs by creating more independence (transportation,
cooking, purchasing, etc.)

7. Introduce environmental education, nature, and outdoor recreation
opportunities to individuals with disabilities.
8. Promote physical fitness and health awareness through individualized
program.
9. Create opportunities for people with physical disabilities to be active in the
community through insuring access to existing programs.
10. Become a resource for disability awareness and outreach in the
community.
11. Establish comparable support services from one community to another
(regional uniformity).
12. Assist individuals to discover options available to them, and their power of
choice to decide which programs they want to participate in (specialized
vs. inclusive/new programs, etc.)
13. Provide exposure to social program opportunities and options.
City of Auburn will provide:
1. Office space, phone service, and equipment
2. Classroom or facility space for various program offerings
3. Use of City of Auburn vehicles to provide transportation for participants to
and from planned activities
4. Office supplies as needed
5. City of Auburn agrees to pay Highiine Community College on a quarter-to-
quarter basis at the rate of 8% of all revenue generated through the
enrollment in the Special Populations Programs and other programs that
are offered as a result of the partnership. This amount maybe
renegotiated at the end of the contract period.
Highline Community College and City of Auburn agree to:
1. Highline and City of Auburn agree that this contract is silent on issues of
negligence, indemnification, and contribution.

2. Highline and City of Auburn agree that each entity shall comply with all
federal, state, and local nondiscrimination laws, regulations, and policies
in carrying out the terms of this Agreement.
3. Highline and City of Auburn agree that this Agreement may be terminated
by any party, prior to the expiration of the contract, upon thirty-days (30)
written notice to all parties.
4. Highline and City of Auburn agree that this Agreement is for services
provided during the summer, 2001 quarter.
5. Highline and City of Auburn agree that no alteration, amendment,
modification, or waiver of any clause or condition of this Agreement is
effective or binding unless made in writing and signed by all parties to this
Agreement.
6. Highline and City of Aubum agree that no party shall assign, transfer, or
sell its rights under this Agreement or delegate its duties hereunder
without the prior written consent of the other party.
7. Highiine and City of Auburn agree that they shall abide by all local, state,
and federal laws and regulations concerning the confidentiality of any
identifying participant information or other participant record obtained
under this Agreement, including compliance with the Family Education
and Right to Privacy Act.
8. Highline and City of Auburn agree to not disclose any confidential or
proprietary information received under this Agreement, unless required by
state or federal law, except by written consent of the appropriate party.
9. Highline and City of Auburn agree that if any term or condition of the
Agreement or application thereof to any person or circumstances is held
invalid, such invalidity shall not affect other terms, conditions, or
applications.
10. Highline and City of Auburn agree that this Agreement constitutes the
entire contract between the parties pertaining to the subject matter of this
Agreement. The parties acknowledge that they are not entering into this
agreement on the basis of any representations not expressly contained
herein.
IN WITNESS WHEREOF, Highline Community College and City of Auburn
execute this four-page Agreement.
