HomeMy WebLinkAbout5571 ORDINANCE NO. 5 5 7 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, EXTENDING THE EFFECTIVE PERIOD OF THE MORATORIUM ESTABLISHED BY ORDINANCE NO. 5518 ON THE FILING OF BUILDING AND GRADING PERMIT APPLICATIONS IN THE DRAINAGE AREA BOUNDED BY SR-18 TO THE SOUTH, 15TM ST. NW TO THE NORTH, UNION PACIFIC RAILROAD TO THE EAST, SR-167 TO THE WEST AS DEFINED WITHIN THIS ORDINANCE FOR A PERIOD OF SIX MONTHS. WHEREAS, Ordinance No. 5518, adopted by Auburn City Council on February 20, 20001, established a moratorium on the filing of building and grading permit applications in the drainage area bounded by SR-18 to the south, 15th Street NW to the north, Union Pacific Railroad to the east, SR-167 to the west within the City of Auburn; and WHEREAS, the term of the moratorium established by Ordinance No. 5518 is six months; and WHEREAS, studies are currently underway to determine the cause(s) of storm water drainage problems in the area and possible solutions; and WHEREAS, staff has determined that more time is needed to study the issue and determine the feasibility for permitting new development and the specific conditions necessary to address storm drainage issues; and WHEREAS, a public hearing was conducted before the Auburn City Council on August 6, 2001; and Ordinance No. 5571 August 3,2001 Page 1 WHEREAS, as the study continues, it is becoming apparent that a cost effective solution may not exist; and WHEREAS, after hearing public input, it was determined by Auburn City Council that extension of the moratorium is necessary to protect the public safety, health, and general welfare. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. EXTENSION OF EFFECTIVE PERIOD OF MORATORIUM. The moratorium established by Ordinance No. 5518 is hereby extended for a period of six months upon adoption of this Ordinance. Section 2. SEVERABILITY. Should any section, paragraph, sentence, clause or phrase of this Ordinance, or its application to any person or circumstance, be declared unconstitutional or invalid for any reason, or should any portion of this Ordinance be pre-empted by state or federal law or regulation, such decision or pre-emption shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or circumstances. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law. .
