WHEREAS, in accordance with Chapter 35A. 14 RCW, the owners of property valued at more than 60% percent of the total assessed valuation of the Holt/Cobble Creek Annexation Area according to the assessed valuation for general taxation of those certain lands in King County, Washington, and more particularly described in Section 1 of this Ordinance, filed their petitions with the City Council of the City of Auburn, Washington, petitioning to have annexed to the City of Auburn the said described land; and WHEREAS, the King County Assessor's Office on October 5, 2000 certified that the aforesaid petitions contained the signatures of property owners having an assessed valuation of more than sixty (60) percent of the assessed valuation of the annexation area; and WHEREAS, in accordance with requirements contained in Chapter 35A.14 RCW, following the filing of the petition with the Auburn City Council, a public hearing was scheduled, and Ordinance No. 5516 Janua~ 28,2002 Page 1 WHEREAS, a public hearing was held November 6, 2000; and WHEREAS, the Auburn City Council approved Resolution 3273 accepting the sixty percent petition for annexation and directing staff to file a Notice of Intent to Annex with the King County Review Board; and WHEREAS, the 45-day review period before the King County Boundary Review Board Expired February 23, 2001, during which time jurisdiction was not invoked and the annexation, therefore, deemed closed and completed; and WHEREAS, said annexation meets the requirements specified by law, to wit: the lands proposed to be annexed being contiguous to the City of Auburn and having not heretofore been incorporated as a City or Town, a petition for annexation having been filed with the City of Auburn by property owners whose property valuation exceeds sixty percent of the proposed annexation area; a public hearing having been held with proper notice and posting, a Notice of Intent to Annex having been filed with the Boundary Review Board, the Board's jurisdiction having not been involked, and this Ordinance having been considered by the Council at a regularly scheduled meeting; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Ordinance No. 5516 January28,2002 Page 2 Section 1. Purpose. That there shall be annexed to the City of Auburn, Washington, the property situated in the County of King, State of Washington, legally described as follows: THAT PORTION OF THE SOUTH HALF OF SECTION 5, TOWNSHIP 21 NORTH, RANGE 5 EAST, W. M. AND THE NORTH HALF OF SECTION 8, TOWNSHIP 21 NORTH, RANGE 5 EAST, W. M. DESCRIBED AS FOLLOWS: BEGINNING AT THE INTERSECTION OF TIlE AUBURN CITY LIMITS ESTABLISHED BY CITY OF AUBURN ANNEXATION ORDINANCE NUMBER 3266 AND THE AUBURN CITY L1MITS ESTABLISHED BY CITY OF AUBURN ANNEXATION ORDINANCE NUMBER 5370; THENCE SOUTHERLY AND WESTERLY AND SOUTHERLY ALONG SAID AUBURN CITY LIMITS ESTABLISHED BY CITY OF AUBURN ANNEXATION ORDINANCE NUMBER 5370 TO AUBURN CITY LIMITS ESTABLISHED BY CITY OF AUBURN ANNEXATION ORDINANCE NUMBER 1758; THENCE SOUTHEASTERLY ALONG SAID AUBURN CITY LIMITS ESTABLISHED BY CITY OF AUBURN ANNEXATION ORDINANCE NUMBER 1758 TO THE SOUTH BOUNDARY OF THE NORTHWEST QUARTER OF SAID SECTION 8; THENCE EASTERLY ALONG SAID SOUTH BOUNDARY OF THE NORTHWEST QUARTER OF SECTION 8 TO THE EXTENDED EAST MARGIN OF 104TM AVENUE SOUTHEAST; THENCE NORTHERLY ALONG SAID EXTENDED EAST MARGIN OF 104TM AVENUE SOUTHEAST TO THE NORTHWEST CORNER OF LOT 15, BLOCK 4 OF C. HILLMAN'S AUBURNDALE ADDITION TO THE CITY OF SEATTLE, DIVISION NUMBER 1, AS RECORDED IN VOLUME 13 OF PLATS, PAGES 13 THROUGH 62, RECORDS OF KING COUNTY, WASHINGTON; THENCE EASTERLY ALONG THE NORTH BOUNDARY OF SAID LOT 15 AND THE NORTH BOUNDARY OF LOT 5 OF SAID BLOCK 4 OF C. D. SITUATE IN THE COUNTY OF KING, STATE OF WASHINGTON. Section 2. That the property hereby annexed shall be assessed and taxed at the same rate and on the same basis as other property within the City of Auburn is assessed and taxed to pay for any outstanding general indebtedness of the City to which said area is annexed. Section 3. That the annexation of the property will become effective at 12:01 AM on February 28, 2002 and the property shall become part of the City of Auburn, subject to all of the laws and ordinances of the City. Section 4. Within ten (10) days after the effective date of the annexation referred to in this ordinance, the City Clerk of the City of Auburn shall send to the Office of the Clerk of the County Council one (1) certified copy Ordinance No. 5516 Janua~ 28,2002 Page 4 I I of this Ordinance together with a copy of the letter dated February 26, 2001 from the Executive Secretary of the King County Boundary Review Board, that deemed the action closed and completed. Section 5. Recording. The City Clerk of the City of Auburn shall record a certified copy of this Ordinance with the King County Auditor's Office. Section 6. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 7, Effective Date. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
