AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF AUBURN, WASHINGTON AMENDING CHAPTER 1.12
OF THE AUBURN CITY CODE, REGARDING THE CITY
SEAL AND LOGO
WHEREAS, current provisions of the Auburn City Code provide for the adoption
of a City Seal and City Logo; and,
WHEREAS, the City of Auburn also promulgated a New City Logo that the City
would like to use as an official hallmark of the City; and,
WHEREAS, it is appropriate to officially adopt said logo; and,
WHEREAS, in connection with the City's seal and logo, it is also appropriate that
the City provide protections for the City's interest in the new logo, and provide
limitations on its unofficial use by others.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON DO ORDAIN as follows:
Section 1. Code Amendment. Chapter 1.12 of the Auburn City Code is
amended to read as follows:

1.12.010 Form of City Seal.
The corporate seal of the city shall be as follows:
A metallic, circular device on which shall be engraved and embossed the words "The
City of Auburn" encircling the words "Corporate Seal," which device shall be capable of
making an impression of the words on paper. (1957 code § 1.02.010.)

1.12.020 Form of Prior City Logo.
The prior City Logo depicted above is a stylized portrayal of the City, depicting
the community, with a steam locomotive traveling through the Auburn Valley, and Mt.
Rainier in the background. The words "City of Auburn, Washington" and "1891," the
year of Auburn's incorporation, ara integrated into the design. This City Logo shall be
operational and continue to be valid as the City's Logo until the 31 day of December,
2004, after which this Logo shall no longer constitute a City Logo.
1.12.025 Form of New City Logo.
The City Council hereby adopts the symbol depicted below as the City Loqo for
the City of Auburn:

Auburn" or "City of Auburn, Washington", either separately or in conjunction with the
additional words "More than you Imaqined."
1.12.030 Policy on Use of City Seal and Logo.
The City Council finds that the Logo and Seal of the City, as set forth hereinabove,
are symbols of the authority and jurisdiction of the City, and as such, are valuable assets
of the City and its citizens. The City Council desires to insure that only appropriate uses
are made of the City's Logo and Seal.
1.12.040 Use for Official Purposes.
The City Logo and Seal shall be used for official purposes only, or as authorized by
the City Council or the Mayor.

1.12.050 Restrictions on Use.
Use of the City Logo and Seal shall be restricted as follows:
A. Except as authorized by the City or as otherwise provided by law, the City
Logo and Seal shall not be used on or in connection with any advertisement or promotion
for any product, business, organization, service or article, whether offered for sale, for profit
or offered without charge.
B. No persons shall use a symbol that imitates the City Logo or Seal or that is
deceptively similar in appearance to the City Logo or Seal.
1.12.060 Violation.
Any person who willfully violates this Ordinance is guilty of a misdemeanor and is
subject to punishment as set forth in the City's penalty provisions for such violations. The
City's right to prosecute under this section shall not affect its rights to pursue civil or
injunctive relief under federal or state laws, or any other relief available under the law.
Section 2. Constitutionality or Invalidity. If any section, subsection, clause,
phrase, or sentence, of this Ordinance, is for any reason held to be invalid or
unconstitutional, such invalidity or unconstitutionality of the remaining portions of this
ordinance, as it is being hereby expressly declared that this ordinance and each
section, subsections, clause, phrase, or sentence, hereof would have been prepared,
proposed, adopted, and approved and ratified irrespective of the fact that any one or
more section, subsection, clause, phase, or sentence, be declared invalid or
unconstitutional.
Section 3. Implementation. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of this
legislation.
Section 4. Effective Date. This Ordinance shall take effect and be in force
five (5) days from and after its passage, approval and publication, as provided by law.
