AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, ESTABLISHING NEW SECTIONS
3.04.570 AND 3.04.571 OF THE AUBURN CITY CODE
CREATING A NEW FUND TO ACCOUNT FOR REVENUES AND
EXPENSES ASSOCIATED WITH THE COMMERCIAL TENANT
AREA OF THE SOUND TRANSIT PARKING GARAGE
WHEREAS, in 2002 the City of Auburn has entered into an agreement
with the Central Puget Sound Regional Transit Authority (Sound Transit)
whereby the City is entitled to lease the Commercial Tenant Areas of the Sound
Transit Parking Garage, located within the corporate boundaries of the City; and
WHEREAS, the City intends to sublease the Commercial Tenant Area
and use the revenues to recover operating and capital costs of the Commercial
Tenant Area, as an enterprise separate from other municipal operations of the
City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section '1: New Sections Created.
There is hereby created two new Sections 3.04.570 and 3.04.571 of the
Auburn City Code, to read as follows:
Chapter 3.04 FUNDS
Section: 3.04.570 Fund Created.
3.04.571 Administration.
3.04.570 Fund Created.
There is created a new fund in the treasury of the City, and all lease,
rental, and related revenue collected from tenants in the Sound Transit
Commercial Tenant Area shall be placed in this fund to be used solely for the

purpose of paying all or any of the operating and capital costs of the
Commemial Tenant Area.
3.04.571 Administration.
The fund shall be administered by the Mayor or designee in accordance
with applicable governmental accounting standards and requirements of the
Revised Code of Washington (RCW).
Section 2: Severability. If any section, sentence, clause, or phrase of
this ordinance should be held to be invalid or unconstitutional by a court of
competent jurisdiction, such invalidity or unconstitutionality shall not affect the
validity or constitutionality of any other section, sentence, clause or phrase of
this ordinance.
Section 3. Implementation. The Mayor is hereby authorized to
implement such administrative procedures as may be necessary to carry out
the directives of this legislation.
Section 4. Effective Date. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and publication, as
provided by law.
