AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, AMENDING SECTIONS 10.36.360,
10.40.020 AND 10.40.100 OF THE AUBURN CITY CODE, AND
CREATING A NEW SECTION 10.40.025 OF THE AUBURN CITY
CODE, RELATING TO PARKING ENFORCEMENT
WHEREAS, among the municipal responsibilities with which the City of Auburn is
charged are those involving parking enforcement; and
WHEREAS, parking enforcement is necessary to promote business activity by
providing customer parking, and parking opportunities for persons working in the
parking enforcement areas of the City; and
WHEREAS, with respect thereto, and in order to adequately avail enforcement
tools, it is appropriate to clarify which code provisions the violation of which could
implicate towing of vehicles illegally parked, adding Section 10.36.260 ACC, the
seventy-two hour parking limitation provision, and making changes consistent therewith.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION ONE. CODE AMENDMENT.
Section 10.36.360 of the City of Auburn Code is amended to read as follows:
10.36.360 Violation - Penalty.
Any vehicle parked in violation of ACC 10.36.190 and !0.36.27010.36.260
through 10.36.350 may be impounded by the chief of police of the city, and the cost of
such impounding shall be paid by the owner or operator of such vehicle before the
same is released, and any motor vehicle owner or operator who violates any of the
terms of ACC 10.36.190(B), (C), (D) or (E) has committed an infraction and shall pay a
fine of $50.00. Any motor vehicle owner or operator who violates any of the terms of
ACC 10.36.270 through 10.36.350 has committed an infraction and shall pay a fine of
$30.00 within 15 days from the date of issuance of such notice, or in the sum of $40.00
if paid after the fifteenth day from the issuance of such notice. Fines shall be paid

SECTION TWO CODE AMENDMENT.
Section 10.40.020 of the City of Auburn Code is amended to read as follows:
10.40.020 Three-hour parking limits.
All municipal off-street parking facilities operated by the city, unless posted
otherwise, are established as three-hour non-metered parking zones, which three-hour
parking limitation shall exist from 9:00 a.m. to 6:00 p.m. daily, excluding Sundays and
holidays; provided, however, the Auburn police chief is herewith granted, subject to the
approval of the Mayor, authority to declare parking moratoriums on 10 parking stalls-er
lesslots where he finds such mor~tor!ums moratoria in the best interest of the citizens of
Auburn. During such moratoria, the Auburn police chief is further granted, subject to thn
approval of the Mayor, authority to declare restrictions on parking and uses for such
parking, to control parking and vehicular traffic within the City. (Ord. 5111 § 2, 1998;

SECTION THREE CODE AMENDMENT.
Section 10.40.100 of the City of Auburn Code is amended to read as follows:
10.40.100 Violation - Vehicle impoundment.
In addition to the penalties specified in ACC 10.40.040 through 10.40.090, the
police department of the city may impound any vehicle parked in a municipal off-street
parking facility of the city in violation of ACC 10.40.010 through 10.40.025 and ACC,,
10.40.035. Any vehicle impounded pursuant to the terms of this chapter shall be placed
in such storage lot within the city limits as may be convenient to the police department,
and all charges for storage shall be paid by the registered owner of the vehicle before
the owner or any other person may take possession thereof. (Ord. 5111 § 2, 1998; 1957
code § 9.26.050.)
SECTION FOUR NEW CODE SECTION.
A New Section 10.40.025 of the City of Auburn Code is created to read as
follows:
10.40.025 Permit Parking Authorized
The Planning Director, with the Mayor's approval may issue permits for the throe
(3) hour municipal parkin.q lots that exempt the driver from the time requirements of
ACC 10.40.020.

SECTION FIVE. GENERAL SEVERABILITY.
If any provision of this Ordinance or the application thereof to any person or
circumstance is held to be invalid, the remainder of such code, ordinance or regulation
or the application thereof to other person or circumstances shall not be affected.
SECTION SIX. IMPLEMENTATION.
The Mayor is hereby authorized to implement such administrative procedures as
may be necessary to carry out the directives of this legislation.
SECTION SEVEN. EFFECTIVE DATE.
This Ordinance shall be in full force and effect five (5) days after publication of
the Ordinance Summary.
