AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, PROVIDING FOR THE REZONiNG OF
PROPERTY LOCATED AT 301 WEST MAIN WITHIN THE CITY OF
AUBURN, WASHINGTON, CHANGING THE ZONING
CLASSIFICATION FROM C-3 (HEAVY COMMERCIAL) TO C-2
(CENTRAL BUSINESS).
WHEREAS, Application No. REZ02-0002 dated December 20, 2002 has been
submitted to the City of Auburn, Washington, by Alonzo P. Cole, Jr. requesting the
rezoning of the parcel of land at 301 West Main C-3 (HEAVY COMMERCIAL) to C-2
(CENTRAL BUSINESS) and hereinafter described below and as identified ori Exhibit
"A" attached hereto and incorporated in this Ordinance by this reference; and
WHEREAS, said request above referred to the Heating Examiner for study and
public hearing thereon; and
WHEREAS, the Heating
Examiner, based upon staff review, held a public
hearing to consider the request in the Council Chambers of Auburn City Hall on
February 19, 2003, at the conclusion of which the Heating Examiner recommended the
approval of the rezoning of said property; and
WHEREAS, the City Council, on March 17, 2003, considered said request and
affirmed the Hearing Examiner's recommendation for rezone based upon the following
Findings of Fact and Conclusions of Law and Decision, to-wit:

FINDINGS OF FACT
Alonzo P. Cole, Jr., the owner of the property located at 301 West Main Street
(northwest comer of West Main Street and C Street NW) has requested that said
property be rezoned from the existing zone of C3, Heavy Commercial to C2,
Central Business. Both zones are commercial zones, with the primary differences
between the two being supplemental development standards (setbacks, building
orientation).
The subject property of approximately 16,500 square feet is currently fully
developed and in use as an office supply/furniture store, which is a permitted use in
both C2 and C3 Districts. There is no current proposal for redevelopment of the
property, or expansion of the existing structure. However, the structure currently is
more in conformance with C2 development standards than C3.
The property has the potential for re-use and/or redevelopment, and it is within the
Downtown Planning Area, specifically the "Main Street" planning area. Under C3
zoning, street-side setbacks would be required that would be in conflict with the
goals of the Downtown Plan for pedestrian-oriented commercial uses, especially in
the vicinity of the Aubum Transit Center.
Surrounding zoning for the site is C3. However, the Downtown Plan designates
the area for eventual transition to C2 zoning, the site is in close proximity to C2-
zoned properties, and the uses are compatible.
The undersigned Hearing Examiner has reviewed the evidence and viewed the site.
The contents of case file REZ02-0002 and the environmental file SEP02-0036 of
this project are hereby incorporated by reference and made part of the record.
CONCLUSIONS OF LAW
Based upon the staff recommendation, the Hearing Examiner has concluded that the
rezone may be approved based upon the following:
1. The proposal is consistent with the Comprehensive Plan Map designations, zoning
and existing uses in the area.

DECISION
For each of the above reasons, the recommendation of the Heating Examiner to the
Auburn City Council on this rezone application is approval.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Purpose. The above-cited Heating Examiner's Findings of Fact,
Conclusions of Law and Decision, are herewith incorporated in this Ordinance.
Section 2. The following property located at 301 West Main and identified on
Exhibit "A" attached hereto and incorporated in this Ordinance by this reference, in the
City of Auburn, County of King, State of Washington, be and the same is hereby
rezoned from C-3, (HEAVY COMMERCIAL) to a proposed zoning of C-2
(CENTRAL BUSINESS).
Section 3. Severability. The provisions of this ordinance are declared to be
separate and severable. The invalidity of any clause, sentence, paragraph, subdivision,
section or portion of this ordinance, or the invalidity of the application thereof to any
person or circumstance shall not affect the validity of the remainder of this ordinance, or
the validity of its application to other persons or circumstances.
Section 4. Recording. Upon the passage, approval and publication of this
Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this

Ordinance to be recorded in the office of the King County Auditor, Division of Records
and Elections.
Section 5. Implementation. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry out the directions of this
legislation.
Section 6. Effective date. This Ordinance shall take effect and be in force
five days from and after its passage, approval and publication as provided by law.
